Office of the Parliamentary Counsel Drafting Guidance OFFICE OF THE PARLIAMENTARY COUNSEL DRAFTING GUIDANCE __________________________________ June 2020 INTRODUCTION Introduction This guidance has been produced by the Drafting Techniques Group of the Office of the Parliamentary Counsel. The guidance is for members of the office. It is meant to help them in their task of making it as easy as possible for readers to understand the Bills that we produce. It is tailored to our particular needs. So it is not meant to be a comprehensive guide to legislative drafting or to clarity in legal writing. For example, some things which assist clarity such as layout or typography are outside our control and so are not discussed. Nor is this document meant as a guide to statutory interpretation or past drafting practice. Members of the office are asked to have regard to the guidance. But everything in the guidance is subject to the fundamental requirement that drafts must be accurate and effective, and drafters will need to take their particular requirements into account. It follows that there will be departures from what is said here. If you have any suggestions or comments to make on the guidance, the Drafting Techniques Group will be grateful to receive them.   • The Constitutional Role of the Privy Council and the Prerogative 3
    Foreword The Privy Council is shrouded in mystery. As Patrick O’Connor points out, even its statutory definition is circular: the Privy Council is defined by the Interpretation Act 1978 as the members of ‘Her Majesty’s Honourable Privy Council’. Many people may have heard of its judicial committee, but its other roles emerge from the constitutional fog only occasionally – at their most controversial, to dispossess the Chagos Islanders of their home, more routinely to grant a charter to a university. Tracing its origin back to the twelfth or thirteen century, its continued existence, if considered at all, is regarded as vaguely charming and largely formal. But, as the vehicle that dispossessed those living on or near Diego Garcia, the Privy Council can still display the power that once it had more widely as an instrument of feudal rule. Many of its Orders in Council bypass Parliament but have the same force as democratically passed legislation. They are passed, unlike such legislation, without any express statement of compatibility with the European Convention on Human Rights. What is more, Orders in Council are not even published simultaneously with their passage. Two important orders relating to the treatment of the Chagos Islanders were made public only five days after they were passed. Patrick, originally inspired by his discovery of the essay that the great nineteenth century jurist Albert Venn Dicey wrote for his All Souls Fellowship, provides a fascinating account of the history and continuing role of the Privy Council. He concludes by arguing that its role, and indeed continued existence, should be subject to fundamental review.

    PART I INTRODUCTION 1. WHY DOES THE PRESENT LAW NEED REFORM? 1.1 Our Sixth Programme of Law Reform1 recommended that “there should be a comprehensive review of the law on limitation periods with a view to its simplification and rationalisation.” We noted that the law is “uneven, uncertain and unnecessarily complex” as demonstrated by the following examples: (1) Adrian is injured when operating an unsafe electric mower. He seeks compensation for his injuries. If he sues the manufacturer in the tort of negligence, or the seller of the mower for breach of contract, he has three years from the date of the injury to bring his claim, subject to the courts’ discretion to extend time. If he sues the manufacturer under the Consumer Protection Act 1987 (so as to avoid having to prove negligence) he has three years from the date of the injury to bring an action, subject to the court’s discretion to disapply the period; but his right of action under the 1987 Act is extinguished entirely if he does not sue within 10 years from when the mower was first bought. (2) Barbara was sexually abused by her uncle, Colin, from a young age until she was 14 years old. She is now 25 and suffers from a depressive illness and personality disorder. She has recently come to realise that her illness and disorder can be attributed to Colin’s abuse. But her action against Colin for trespass to the person will be time-barred (the limitation period being six years after she was 18).

I have been asked to provide a note for the Independent Advisory Group on Stop and Search on the legislative gaps which might be left if consensual stop and search were abolished in Scotland. That note follows. I should note that it has been prepared in a very short timescale and is not intended to represent an authoritative or exhaustive review of the relevant law or principles, but I hope that it is of some assistance to the Group. Background 2. At common law, the police may search the person of anyone they have lawfully arrested. Beyond this, however, there is (except in cases of urgency) no common law power of search. The principle remains that set out by the Lord Justice-General (Inglis) in Jackson v Stevenson (1897) 2 Adam 255 at 260: ...a constable is entitled to arrest, without a warrant, any person seen by him committing a [crime], and he may arrest on the direct information of eye witnesses. Having arrested him, I have no doubt that the constable could search him. But it is a totally different matter to search a man in order to find evidence to determine whether you will apprehend him or not. If the search succeeds... you will apprehend him; but if the search does not succeed, you will not apprehend him. Now, I have only to say that I know of no authority for ascribing to constables the right to make such tentative searches, and they seem contrary to constitutional principle.

The absence of such a mono- document delineating these rights meant that there was no concept of a higher law or a supreme law which could only be altered or amended by extraordinary methods. 2 The traditional orthodox approach in the UK was that due to Parliamentary sovereignty, all primary legislation it passes is of equal status, 3 the principles of interpretation to be applied to these Acts is that they are to be construed according to the ordinary and literal meaning of the language used. However this conventional attitude was gradually evolving and the new assessment was finally articulated in the 2002 case of Thoburn v. He recommended that we should acknowledge that there are a hierarchy of Acts of Parliament: “there exists rights which should properly be classified as constitutional or fundamental….
