(Jack) Walsh Q.C.* This paper has been prepared at the invitation of the University of New Brunswick Law School, as part of their Digital Law Collection Project. Any views expressed are those of the author and not the Office of the Attorney General of New Brunswick. DNA Typing? A magazine article in the late 1980’s, which I read with only passing interest, is my first recollection of DNA typing. Not having a background in science, and a pathological aversion to anything requiring a formula to understand, what did I know (or care) about molecular biology or population genetics. Besides, as a line prosecutor in the Miramichi Region of New Brunswick, I should be forgiven for not grasping the looming utility, to my own day to day work, of Englishman Sir Alex Jeffreys breakthrough in applying molecular technology to human identification1. Enigmatically, not long after, I was charged with the responsibility of shepherding DNA typing evidence into one of the first criminal cases in Canada and the first serial murder case, Her Majesty the Queen v. Allan Joseph Legere; the longest and most notorious homicide trial in New Brunswick’s history. It was my facetious fortune for this case to mean so much to the citizens of New Brunswick, to the residents of my home region of the Miramichi and for the case to become the biggest test for the RCMP’s fledging forensic DNA laboratory program. Miramichi resident Allan Joseph Legere was serving a life sentence for murder.

    Combining Familial Searching and Abandoned DNA: Potential Privacy Outcomes and the Future of Canada’s National DNA Data Bank Amy Conroy* Since Alec Jeffreys discovered the identifying potential of DNA in 1984, ge- netic science has become a mainstay of criminal investigations around the world.1 DNA may be retrieved from a crime scene in the form of blood, saliva, skin cells, hair, or other genetic material, and an anonymous DNA profile developed from the genetic tissue.2 If a perfectly matching profile for the crime scene profile can be located from genetic tissue obtained from an identified individual, police will have extremely valuable evidence placing the identified person at the crime scene. At the present time, Canada operates a Special Handling Unit (SHU), which is located in Sainte-Anne-des-Plaines, Québec ( just outside of Montréal). The fact that Canada only has one supermax prison while its neighbor to the south, with which it shares many cultural, economic, and legal similarities, has a federal supermax and a supermax facility in almost each state is somewhat unusual. 鑕鑊鑗鑒鑎鑘鑘鑎鑔鑓鐅鑋鑗鑔鑒鐅鑙鑍鑊鐅鑕鑚鑇鑑鑎鑘鑍鑊鑗鐑鐅鑊鑝鑈鑊鑕鑙鐅鑋鑆鑎鑗鐅鑚鑘鑊鑘鐅鑕鑊鑗鑒鑎鑙鑙鑊鑉鐅鑚鑓鑉鑊鑗 The sequence of events surrounding and leading to this current state of affairs is long and complicated. This chapter reviews the process by which Canadian correctional practitioners experimented with different supermax-like facili- ties and recounts the events that led to the construction of the current facility in Sainte-Anne-des-Plaines. In order to accomplish this goal, this study primarily relies upon a review of secondary data. The research focuses on scholarly materials, publicly avail- able government documents, newspaper and magazine articles, and materials available on the World Wide Web concerning the construction and manage- ment of SHUs in Canada.2 The Development of the Canadian Special Handling Unit Similar to the United States, Canada has both provincial and federal prisons.

[Robert] Winters took [Allan Legere] to the washroom, where [Allan Legere] faked needing toilet paper and escaped out of the hospital. He had hidden a collapsed TV antenna in his rectum and a piece of metal in a cigar to open both his cuffs and leg shackles. His body belt remained buckled. In the parking lot he pushed Peggy Olive inside her car and took her and the car. May 7, 1989: Max Ramsay was beaten, tied up and robbed. His wallet was found in Newcastle along with his 1986 Chrysler New Yorker. May 10, 1989: Mary Susan Gregan of Chatham saw someone in her window and called the police. Four days later she found her jewelry gone. May 16, 1989: Joe Irving and Cathy Mecure of Chatham both saw a man in a field; [Joe Irving] recognized [Allan] Legere. Michael Sproull of the Kelly Road area, near where the Glendennings* lived, saw a suspicious male. May 22, 1989: David and John Tanasichuk, brothers, escaped from [prison in] Dorchester N.B. Both became suspects in the Flam murder. They were found in a hunting camp near the Harcourt area. Considered inept and disorganized, they were questioned and eliminated as suspects, but charged with being unlawfully at large. May 27, 1989: Someone broke into Joe Irving’s home, stole a duffle bag, pie and $100 worth of meat from a freezer.
