Is It Time to Welcome a New Political Tribe on The Horizon? By Jacob Hess I am among the sizeable number of conservatives today who feel cut off and alienated from the “mother party” of Republicans in America today – given how little the predominant right-tribe seems to represent many of our values and core convictions anymore. Like Mitch Daniels, who worked under Reagan and Bush presidencies, “I feel homeless." I’m also aware of a not-insignificant number of liberals who are concerned with some of the ascendant “social justice warrior” themes on the left – similarly unsure how this increasingly illiberal intolerance of ideological diversity represents their own core values. These parallel trends raises perhaps the obvious question: Is it time for the disgruntled, the alienated, and the hungry-for-something-better to find each other – and make that something better happen?! Glimpses of a new aggregation. I’ve been tasting some of these possibilities for years in my work with Joan Blades and Debilyn Molineaux at Living Room Conversations, with Liz Joyner at the Village Square, and the larger gathering of people from all walks of life within the National Coalition of Dialogue & Deliberation. Along the way, we’ve been heartened to find many are making unorthodox cross-political connections in their own personal lives, as documented in the Respect & Rebellion initiative to showcase red-blue friendships across America. And of course, this is central to what the larger “transpartisan” movement has tried to do over the last two decades, led by people like Jim Turner, Lawry Chickering, John Steiner, & Mark Gerzon - and more recently, by the inspired founders of Better Angels, the Bridge Alliance, and Bridge USA. -

As a result, this thesis is mainly concerned with the capacity of words, iterated within the archive of social media, to haunt us— both culturally and informatically. Through hauntology, this study hopes to understand a modern discourse community that is bound by an epideictic framework that specializes in the deconstruction of the individual’s ethos via the constant demonization and incitement of past, current, and possible social media expressions. The primary goal of this study is to understand how these practices function within a capitalistic framework and mirror the performativity of capital by reducing affective human interactions to that of a transaction. -

RULES OF THE FABIAN SOCIETY 1 The name of the Society shall be the Fabian Society. 2 The Fabian Society consists of socialists. It therefore aims for a classless society, where a just distribution of wealth and power assures true equality of opportunity. It holds that society, through its democratic institutions, should determine the overall direction and distribution of economic activity, and seeks to promote where appropriate the social and co-operative ownership of economic resources. It argues for strong and accountable public institutions reflecting the values of public service to meet need. It believes in an active democracy, characterised by liberty, tolerance and respect for diversity. It aims at the implementation of the Charter of the United Nations and the Universal Declaration of Human Rights, and seeks the creation of effective international institutions to uphold and promote world peace and sustainable development. It seeks to secure these ends by the methods of political democracy. The Society, believing in equal citizenship in the fullest sense, is open to persons, irrespective of race, gender, sexual orientation, age, disability or creed, who commit themselves to its aims and purposes and undertake to promote its work. Its activities shall be the furtherance of socialism and the education of the public on socialist lines by the holding of meetings, lectures, discussion groups and conferences, the promotion of research into political, economic and social problems, national and international, the publication of books, pamphlets and periodicals, and by any other appropriate methods. The Society shall be affiliated to the Labour Party. 3 The Society as a whole shall have no collective policy beyond what is implied in Rule 2; its research shall be free and objective in its methods. -

Carved into the wall beside him is a quote from the preface of Animal Farm: “If liberty means anything at all, it means the right to tell people what they do not want to hear.” It’s a snappy slogan that fits neatly into a tweet, but whenever I walk past this effigy of the English writer that I most admire, it makes me cringe. Surely the author of Nineteen Eighty-Four would understand that people don’t want to hear that 2+2=5? For Orwell’s quote is not a defence of liberty; it’s a demand for licence, and has become a foundational slogan for those who wilfully misconstrue one for the other. Over the past decade, the right to make inflammatory statements has become a hot button issue for the reactionary right, who have constructed tropes such as political correctness and virtue signalling to enable them to police the limits of social change while portraying themselves as victims of an organised assault on liberty itself. The latest creation in their war against accountability is “cancel culture”, an ill-defined notion that takes in corporate moves to recognise structural racism, the toppling of statues, social media bullying, public shaming and other diverse attempts to challenge the status quo. -

Rhode* This article explores the leadership challenges that arose in the wake of the 2020 COVID-19 pandemic and the widespread protests following the killing of an unarmed Black man, George Floyd. Lawyers have been key players in both crises, as politicians, general counsel, and leaders of protest movements, law firms, bar associations, and law enforcement agencies. Their successes and failures hold broader lessons for the profession generally. Even before the tumultuous spring of 2020, two-thirds of the public thought that the nation had a leadership crisis. The performance of leaders in the pandemic and the unrest following Floyd’s death suggests why. The article proceeds in three parts. Part I explores leadership challenges during the COVID-19 pandemic and the missteps that put millions of lives and livelihoods as risk. It begins by noting the increasing frequency and intensity of disasters, and the way that leadership failures in one arena—health, environmental, political, or socioeconomic—can have cascading effects in others. Discussion then summarizes key leadership attributes in preventing, addressing, and drawing policy lessons from major crises. Particular attention centers on the changes in legal workplaces that the lockdown spurred, and which ones should be retained going forward. Analysis also centers on gendered differences in the way that leaders addressed the pandemic and what those differences suggest about effective leadership generally. Part II examines leadership challenges in the wake of Floyd’s death for lawyers in social movements, political positions, private organizations, and bar associations. -

The Rules of #MeToo Jessica A. Clarke† ABSTRACT Two revelations are central to the meaning of the #MeToo movement. First, sexual harassment and assault are ubiquitous. And second, traditional legal procedures have failed to redress these problems. In the absence of effective formal legal pro- cedures, a set of ad hoc processes have emerged for managing claims of sexual har- assment and assault against persons in high-level positions in business, media, and government. This Article sketches out the features of this informal process, in which journalists expose misconduct and employers, voters, audiences, consumers, or professional organizations are called upon to remove the accused from a position of power. Although this process exists largely in the shadow of the law, it has at- tracted criticisms in a legal register. President Trump tapped into a vein of popular backlash against the #MeToo movement in arguing that it is “a very scary time for young men in America” because “somebody could accuse you of something and you’re automatically guilty.” Yet this is not an apt characterization of #MeToo’s paradigm cases. -
