ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITYAND INDEMNITY AGREEMENT

Event: 2017 NCAA® Women’s Final Four® Bounce Sat. April 1 and the 2017 Women’s Final Four Tourney Town ™ Fri. March 31, Sat. April 1, and Sun. April 2, including all activities and interactives therein (the “Events”).

In consideration for permitting Participant to participate in any way in the Events, the undersigned, for his/herself, and his/her respective heirs, personal representatives and assigns, agrees as follows:

Assumption of Risk: Participant hereby acknowledges and agrees that he/she understands the nature of the Event; that Participant is qualified, in good health, and in proper physical condition to participate therein; that there are certain inherent risks and dangers associated with the Event; and that, except as expressly set forth herein, he/she, knowingly and voluntarily, accepts, and assumes responsibility for, each of these risks and dangers, and all other risks and dangers that could arise out of, or occur during, Participant’s participation in the Event.

Release and Waiver: Participant hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the National Collegiate Athletic Association and its member institutions; NCAA Official Corporate Champions and Corporate Partners; State of Texas; City of ; The Big 12 Conference; Dallas County; Dallas Sports Commission; Pro Challenge Inc.; Dallas Convention and Visitors Bureau; and Center Operating Company; and Dallas Basketball Limited; Hillwood Development Company; Southern Methodist University, Texas Christian University, University of Arlington, University of , , FC Dallas, Dallas Sidekicks, , , , Frisco Rough Riders, Texas Legends; Jumper Bee Entertainment; Corporate Gaming, Inc; TLD Holdings, LCC; Turner Sports, Inc.; and/or MKTG, Inc.; each of their respective subsidiaries, subdivisions, affiliates and parent organizations, and their respective officers, employees, agents, hired vendors and subcontractors (collectively, the "Releasees"), from and for any liability resulting from any personal injury, accident or illness (including death), and/or property loss, however caused, arising from, or in any way related to, Participant's participation in the Events, except for those caused by the willful misconduct, gross negligence or intentional torts of the above parties, as applicable.

Indemnification and Hold Harmless: Participant hereby agrees to INDEMNIFY, DEFEND AND HOLD the Releasees HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages, losses, and liabilities including, but not limited to, attorneys’ fees, arising from, or in any way related to, Participant’s participation in the Event, except for those arising out of the willful misconduct, gross negligence or intentional torts of the above parties, as applicable. THE INDEMNITY CONTAINED IN THIS PARAGRAPH WILL APPLY EVEN IF AN INJURY IS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OR STRICT LIABILITY OF THE RELEASEES.

Permission to Use Likeness/Name: PARTICIPANT AGREES TO ALLOW WITHOUT COMPENSATION HIS/HER LIKENESS, OR HIS/HER CHILD’S LIKENESS (IF APPLICABLE), TO APPEAR IN MATERIAL, REGARDLESS OF MEDIA FORM, PROMOTING THE NCAA, ITS CHAMPIONSHIPS, EVENTS AND ACTIVITIES, INCLUDING THOSE OF ITS REPRESENTATIVES AND LICENSEES.

Severability: Participant expressly agrees that the foregoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgment of Understanding: Participant has read this assumption of risk, release and waiver of liability and indemnity agreement, and has had the opportunity to ask questions about the same. Participant fully understands this assumption of risk, release and waiver of liability and indemnity agreement, that he/she is giving up substantial rights in connection therewith, and that its terms are contractual, and not a mere recital. Participant acknowledges that he/she is signing this agreement freely and voluntarily.

Authority to Sign: The undersigned further warrants and represents, on behalf of him or herself, and any other participants(s) identified below, that he or she has the authority to sign this Agreement as an individual or as the parent and/or legal guardian of any other minor participant(s) identified below.
