SUBJECT: LATE INFORMATION

1.0 INTRODUCTION

1.1 The information below has been received since compilation of your Agenda. The following also includes suggested adjustments to the recommendations further to the receipt of late plans and/or information.

2.0 ITEM 7 - PLANNING APPLICATIONS

REPORT NO. 1 – 8 TOLLGATE CRESCENT, INDUSTRIAL ESTATE, BURSCOUGH

(a) Condition 6 has been altered so that it reads more clearly:

The southern access as shown hatched on drawing number AL_90_002 received on 17th March 2008 shall be physically and permanently closed and the existing verge/footway of the vehicular crossing shall be reinstated in accordance with the County Council specification for Construction of Estate Roads, prior to any use of the site by construction or other traffic.

REPORT NO. 3 – GENERAL HOSPITAL, WIGAN ROAD, ORMSKIRK

(a) Observations of Borough Planner

It is considered appropriate to impose two further conditions relating to cycle storage and bin storage for the proposed apartment block. Conditions

9. No part of this development shall be brought into use until space and facilities for cycle parking have been provided for the apartments (plots 248 – 253) in accordance with a plan to be submitted to and approved in writing by the Local Planning Authority and these facilities shall be retained thereafter for that specific use.

10. No part of this development shall be brought into use until space and facilities for bin storage have been for the apartment (plots 248 – 253) in accordance with a plan to be submitted to and approved in writing by the Local Planning Authority and these facilities shall be retained thereafter for that specific use.

Reasons:

9. In the interests of providing alternative means of transport for the future occupants of the development as required by Policy SC6 of the Replacement Local Plan.

10. To safeguard the amenity of adjacent properties and the area generally and so comply with the provisions of Policy GD1 in the West Lancashire Replacement Local Plan.

REPORT NO. 5 – LAND REAR OF 407 MOSS LANE, HESKETH BANK

(a) Observations of Borough Planner

The applicant has requested that the hours of operation on the site with regard to the movement of delivery vehicles and loading and unloading of vehicles shall take place between the hours of 0700 to 1900 Monday to Saturday and 0730 to 1200 on Sunday and Bank Holidays. It is considered that this will not result in any adverse impact on the amenities of neighbouring properties or on the character of the area and therefore it is recommended that the following conditions relating to the restriction of the hours of operation should read as follows;

8. The movement of delivery vehicles and loading and unloading of vehicles shall take place between the hours of 0700 and 1900 Monday to Saturdays and 0730 and 1200 on Sundays and Bank Holidays.

9. No machinery shall be operated on the premises between the hours of 1900 and 0700 on Monday to Saturday and 1200 and 0730 on Sunday and Bank Holidays

Reasons:

REPORT NO. 7 – BLYTHE HALL, BLYTHE LANE, , ORMSKIRK

(a) Paragraphs 6.14 to be amended to read:

Paragraph 6.14 should include reference to the fact that the site’s landscape value of regional importance is identified because of its proximity to the former Burscough Priory Site which lies to the east of the hall. This is highlighted in the Natural Areas and Areas of Landscape History Importance Supplementary Planning Guidance (SPG). The SPG asks for archaeological investigations to be undertaken to protect sites and features of interest and that new development to be sympathetic to the features of interest. The mitigation measures in this case would be to have an archaeological report undertaken to see if the fields have any significance to the Burscough Priory site.

(b) Paragraph 6.15 has altered to read:

Care should be taken to ensure the historic character and significance of the site is not harmed by any development. However I feel this can be dealt with by a condition requiring an archaeological investigation to be carried out at the site. In terms of the listed building, the proposal will not harm its setting. However I feel that the formal nature and appearance of the railings around the track would harm the landscape character of the site in terms of its Green Belt location, contrary to policy GD1.

(c) Reason for refusal number 2 has been altered to read;

The proposed development conflicts with Policy GD1 of the West Lancashire Replacement Local Plan in that the proposed gallops track would by virtue of its size, design and positioning be detrimental to both the visual amenity of the Green Belt and its landscape character.
