E-mail: [email protected] Accepted 7 June 2019 Pakistan and Afghanistan are facing terrible law and security conditions under the influence of militant organizations like al-Qaeda and Tahrik-e-Taliban etc. after 9/11 incident. These militant organizations destroyed the peace structure and good relations between both countries. They promoted militancy and terrorism in different forms of bombing, suicide attacks on security forces and innocent people. They manipulated the innocent people under the shadows of wage Jihad, and ensured them for the protection of Muslims in the world. The governments of both countries have been suffering militancy and terrorism since NATO attacks on Afghanistan. Foreign hands have also been involved in spreading militancy and internal affairs of both countries. This resulted in deterioration of peace relations between two neighboring countries, especially after 9/11 incident. The governments of both countries have failed to create peaceful environment for the development of their natives for last seventeen years.

Scholar at the School of Law, Zhongnan University of Economics and Law, China Abstract Kulbushan Yadhav Case is a unique case in which an Indian spy was caught during the operation of security forces in Pakistan in 2016. He was allegedly involved in sponsoring terrorism in the provinces of Baluchistan and Sindh in Pakistan. He confessed all the offenses committed by him which was telecasted on TV channels across the world. Kulbushan Yadhav was serving Commander of Indian Navy that confessed that he funded BLA and BRA named illegal terrorist organizations in the Province of Baluchistan while working for Indian Intelligence Agency RAW. He further confessed that he visited Karachi twice and gathered intelligence pertaining to Pakistan’s Navy. He also admitted that there are many other RAW agents like him working in He was sentenced to death in Pakistan. India denied the confession of Kulbushan Yadhav again and again. India approached International Court of Justice in 2017 which initially stayed the execution of death sentence against Kulbushan Yadhav. In the final verdict of the case the International court of Justice (ICJ) granted consular access to India and ordered review of death sentence of Kulbushan Yadhav in July 2019. India’s plea for the release of Kulbushan Yadhav was rejected.

Kulbhushan Sudhir Yadhav alias Hussein Mubarak Patel was detained in March 2016 during a Counter- Intelligence Operation from Mashkel area of Balochistan for his involvement in "spying" and "subversive activities” in Pakistan.1 Strongly reacting to the verdict, Indian Foreign Secretary S. Jaishankar handed over a demarche to Pakistan's High Commissioner Abdul Basit and said that if Pakistan hanged alleged Indian spy Kulbhushan Yadhav, it will be considered "a case of premeditated murder".2 Also, India decided not to release about a dozen Pakistani prisoners, who were to be repatriated on April 12.3 Pakistan had handed over a dossier containing evidence of Indian subversive activities within its territory, to United Nations (UN) Secretary General Antonio Guterres in January 2017. Despite evidences and confessions by Kulbhushan, India denied that he was in any way connected to the government and called the proofs presented as “baseless accusation”. Kulbhushan, on the other hand, himself confessed that the Indian intelligence agency RAW had tasked him to carry out “criminal and anti-national” activities in Pakistan.

The large scale military operation Zarb-e-Azb, which gained momentum after the massacre of school children in APS Peshawar by TTP terrorists, has restored the writ of the government in FATA and has largely reduced the capabilities of terrorists in Pakistan. However, the terrorists leadership survived the wrath of Pakistan Army by retreating to safe havens in Afghanistan. The terrorists having been unable to capture and control territory as they used to, are now resorting to suicide attacks against soft targets to make their presence felt. One such attack was conducted on August 8, 2016. The well planned and coordinated attack resulted in the deaths of at least 93 people, lawyers being half of them. On the morning of August 8, President Baluchistan Bar Association, Advocate Bilal Anwar Kasi, was murdered near Mengal Chowk on Manno Jan Road by assailants on motor bike. Distance between target killing of Kasi and Civil Hospital The body was taken to Government Hospital where senior lawyers and members of Baluchistan Bar Association gathered to pay respect. In a well conceived plan, the terrorists dispatched suicide bomber to the same hospital where they correctly predicted the arrival of large number of lawyers, media persons and social activists. The suicide bomber blew himself in the middle of the gathering killing and injuring a large number of people.
