MONTCLAIR BOARD OF EDUCATION GOALS 2020-2021

BE IT RESOLVED that upon the recommendation of the Superintendent that the Montclair Board of Education adopts the attached Montclair Board of Education Goals for the 2020-2021 school year.

BOARD GOALS 2020-21

1. The Board believes in the importance of communicating its governance role and Board functions to the community. During the 2020-21 school year, the Communications Committee will work with the Superintendent and District Administration, to develop and improve, through collaboration, an understanding within the district and the Montclair Community, how the Board operates. The Committee will keep the Board informed through their monthly reporting.

2. The Montclair Public believes “All Students Can Learn” and “Every Child is Special”. To that end, the Board will work with the Superintendent, through its policies, to ensure that every student attending is treated equitably, without bias, and is supported to meet their needs. Every Montclair Public School student will have the opportunity to attain their highest level of learning and achievement.

In order to meet this goal, the Board will:

Direct the Superintendent and District Administration to ensure every student has access to all levels of instruction and the assistance needed to acquire opportunities to enter higher level classes; to monitor all academic programming, and to make sure that it effectively meets the needs of all learners.

Direct the Superintendent to use data to inform decision making regarding the planning and implementation of staff development opportunities that will promote best practices in the classroom, to monitor and analyze student progress, and make recommendations that will focus on equity advocacy, as related to student achievement and educational opportunity.

Direct the Superintendent to inform the Board regularly on student achievement and pertinent action planning geared to facilitating positive student outcomes, and supporting academic growth.

Direct the Superintendent to use data as a foundation for presentations that involve curricular changes, new program initiatives, and fact-finding for problem solving purposes.

3. Through the careful alignment of the budget to Board and District goals, the Board will build the capacity to assure the sound and fiscally responsible disposition of district resources in a manner that benefits all students. This will include careful reporting and analysis of the systems and programs that impact educational goals, and will include analysis of special needs programs; s sustained focus on fiscal spending, attention to infrastructure and technology, and a strong and effective relationship with the Board of School Estimate.

4. The Board will create an infrastructure addressing virtual and physical needs for best in classroom educational opportunities for 21st Century learning environments. To that end, the Board recognizes that: Agenda/Public Board Meeting Monday, August 17, 2020 Page 6

Modern learning opportunities require a 1:1 device to student ratio. The Board will work with the Superintendent to fund IT operations and user experience to create a department to support the modern learning needs of students, with a focus on equitable access to all student populations.

Our facilities are in need of modernization from structural to HVAC, to ergonomics. To facilitate current and future best practices, the Board will create an LRF that is malleable with a futuristic outlook.

Classrooms will be designed to accentuate learning, safety, and effortless teaching.

5. The Montclair Board of Education believes Restorative Justice Practices build community and promote healthy relationships among educators and students.

In 2018, the Board entered into an initiative with the Montclair Education Association, and the Montclair Community through Community Partners and Stakeholders, to bring Restorative Justice to the Montclair School District. This included staff, administrator, board, and community training, and implementation of Restorative Justice in four pilot schools. Staffing includes a Teacher on Special Assignment in each of the pilot schools, and a Coordinator to oversee the initiative. During the 2020-21 school year the Board will:

Direct the Superintendent and District Administration to support the continued implementation of Restorative Justice by expanding the number of pilot schools, support staff and administrator training, determine that Professional Development in Restorative Justice practices are provided to staff, and review and evaluate the initiative with the Coordinator.

Review and revise policies with the inclusion of restorative practices.

Allocate funding during the budget process for the continued implementation of Restorative Justice in the district.

CONDEMNING RACISM AND AFFIRMING THE BOARD’S COMMITMENT TO AN INCLUSIVE SCHOOL ENVIRONMENT FOR ALL

WHEREAS, members of the Montclair Board of Education, as well as the Montclair Public Schools staff and administration, are saddened and outraged by the recent events that demonstrate the racism and injustice that persists in our country; and

WHEREAS, racism and hate have no place in our schools or our society, and we must protect the constitutional rights of every person who lives, works, and learns, in our community; and

WHEREAS, racial inequality and bias-both explicit and implicit-have a detrimental impact on the education of Black Students, Students of Color, and Others; and

WHEREAS, schools have the responsibility to work to eliminate racism and bias through the development of policies that serve as a template for this commitment and guide the education of students and the professional development of staff and by working with the broader community; and

WHEREAS, as a Board of Education, we must lead, and each of us, individually and collectively, is responsible for creating and nurturing an anti-racist learning environment where every child is respected and valued for who they are. We must actively acknowledge, address and prevent racism and practices of bias that occur as a result of district policies, practices and actions; and

WHEREAS, we must ensure that our school district will be a place of safety in our community for our students and their families, as we build and strengthen trust with those we serve, and we model the acceptance of all people.

THEREFORE, BE IT RESOLVED that we, members of the Montclair Board of Education, stand steadfast in our commitment to foster an inclusive educational environment where every student, teacher, support professional, administrator, parent/caregiver, and community member is treated with dignity and respect, as well as our commitment to continue fighting for racial justice, human and civil rights for all.

BE IT RESOLVED that upon the recommendation of the Superintendent, the Board of Education appoints Detail Associates as Asbestos Management, Indoor Air Quality, and Public Employees Occupational Safety and Health Administration (PEOSHA) Officer, and Anthony Bispo, Director of Buildings & Grounds, as Asbestos Hazard Emergency Response Act (AHERA) Officer, for the Montclair Board of Education, to serve in such office until the next organizational meeting of the Board and until their respective successors are duly appointed and qualified. REVISED DESIGNATION OF DISTRICT AFFIRMATIVE ACTION OFFICER/ TITLE IX COORDINATOR FOR THE 2020-2021 SCHOOL YEAR

WHEREAS, the Montclair Board of Education is required to comply with the regulations of Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act; and WHEREAS, in accordance with district policies no student in the Montclair Public Schools shall be denied access to or benefit from any educational program or activity solely on the basis of race, color, creed, religion, sex, ancestry, national origin or handicap; and WHEREAS, as required by N.J.A.C. 6:4-1.3, each public school district must appoint an Affirmative Action Officer/Title IX Coordinator as the district’s chief equity officer; and WHEREAS, part of the responsibilities of the Affirmative Action Officer/Title IX Coordinator is to create a Three-Year Comprehensive Equity Plan which includes the Comprehensive Needs Assessment; BE IT RESOLVED that upon the recommendation of the Superintendent, the Board of Education designates Damen Cooper, Director of Personnel, to serve as the district’s Affirmative Action Officer/Title IX Coordinator until a respective successor is duly appointed and qualified.

AMENDMENT TO THE 2020-2021 GENERAL FUND REVENUE BUDGET

WHEREAS, the State of New Jersey Department of Education initially provided state aid amounts for the 2020-2021 budget on February 27, 2020, with the Montclair Board of Education receiving the following categorical aid:

Categorical Transportation Aid $ 1,175,389 Categorical Special Education Aid $ 5,640,860 Categorical Security Aid $ 755,225 Adjustment Aid $ 322,539 Total Categorical Aid $ 7,894,013

WHEREAS, due to a statewide shutdown, the State of New Jersey Department of Education amended the 2020-2021 state aid figures for all NJ School Districts in July 2020, which resulted in the following revised state aid figures for the Montclair Board of Education:

Categorical Transportation Aid $ 1,175,389 Categorical Special Education Aid $ 5,444,123 Categorical Security Aid $ 755,225 Adjustment Aid $ 322,539 Total Categorical Aid $ 7,697,276

WHEREAS, due to the reduction in state aid caused by the statewide shutdown, the New Jersey Department of Education has allowed school districts to utilize unassigned general fund surplus to cover the shortfall in state aid by Board Resolution provided the resolution is provided to the County Executive School Superintendent prior to August 14, 2020 and the Board approves the resolution at the Board of Education’s August meeting;

BE IT RESOLVED, that upon the recommendation of the Superintendent, the Board of Education amends the 2020-2021 general fund revenue budget as follows:

USE OF FACILITIES AT SALVATION ARMY COMMUNITY CENTER, 2020-2021 SCHOOL YEAR

WHEREAS, the Montclair Board of Education has been offered space at their facility with no fee by the Salvation Army Community Center for use by special education students transitioning from 12th grade into adult life at age 21 to work with them in a collaborative relationship with our Transition Program for the 2020-2021 school year, and

WHEREAS, the County Superintendent has approved the Application for Temporary Instructional Space for the 2020-2021 school year,

BE IT RESOLVED that upon the recommendation of the Superintendent, the Board of Education approves the use of facilities at Salvation Army Community Center, 13 Trinity Place, Montclair, New Jersey, for the 2020-2021 school year.

WRITE OFF OF NEGATIVE STUDENT FOOD SERVICE BALANCES AS OF JUNE 30, 2020

WHEREAS, the Montclair Board of Education has attempted to make collection on food service student account receivable balances and has been unsuccessful in this attempt; and

WHEREAS, the Business Administrator has reviewed the negative food services balances as of July 27, 2020 and has determined that the following should be written off of the Food Service accounting records as of June 30, 2020:

Negative Balances: Active Students that Qualified for Free or Reduced Meals $ 14,276.14 Inactive Students $ 19,941.81

BE IT RESOLVED that upon the recommendation of the Superintendent, the Board of Education approves writing off the food service balances for active students that qualified for free or reduced meals and inactive students effective June 30, 2020.

RESOLVED that pursuant to N.J.A.C. 6A:23-2.11 (c) 3, the Montclair Board of Education certifies that no line item account has encumbrances and expenditures, which in total exceed the line item appropriation in violation of N.J.A.C. 6A:23-2.11 (a), and that pursuant to N.J.A.C. 6A:23-2-11 (c) 4, after review of the board secretary’s monthly financial reports, in the minutes of the Board each month, the Montclair Board of Education certifies that no major account or fund has been over expended in violation of N.J.A.C. 6A:23-2.11 (b), and

BE IT FURTHER RESOLVED that the Montclair Board of Education approves the attached 2020-2021 Summer Bill List #2 in the amount of $2,813,875.93.

BE IT FURTHER RESOLVED that the Montclair Board of Education does hereby approve the request for tax levy from the Township of Montclair in the amount of $5,462,653.00 for the month of August 2020.

BE IT FINALLY RESOLVED that upon the recommendation of the Superintendent, the Montclair Board of Education acknowledges receipt of the Secretary’s Report for the month of June 2020, and Treasurer’s report for the month of June 2020.

RESOLUTION OF THE BOARD OF EDUCATION OF THE TOWNSHIP OF MONTCLAIR IN THE COUNTY OF ESSEX, NEW JERSEY AUTHORIZING THE USE OF COMPETITIVE CONTRACTING FOR THE SOLICITATION OF PROPOSALS FOR A SOLAR POWER PURCHASE AGREEMENT IN CONNECTION WITH ITS ENERGY SAVINGS IMPROVEMENT PROGRAM

WHEREAS, The Board of Education of the Township of Montclair in the County of Essex, New Jersey (the “Board” when referring to the governing body and the “School District” when referring to the legal entity and territorial area governed by the Board) has selected Honeywell International, Inc. (“Honeywell”) to serve as its Energy Services Company (“ESCO”) to assist with the implementation of its Energy Savings Improvement Program, which is expected to include provision for a solar power purchase agreement among its proposed energy conservation measures; and

WHEREAS, pursuant to pursuant to N.J.S.A. 18A:18A-4.1 et seq. and as prescribed by Local Finance Notice 2009-10, dated June 12, 2009, the Board may use competitive contracting in lieu of public bidding for procurement of a solar power purchase agreement; and

WHEREAS, pursuant to N.J.S.A. 18A:18A-4.3(a), the Board is required to pass a resolution authorizing the use of competitive contracting; and

WHEREAS, pursuant to N.J.S.A. 18A:18A-4.3(b), 4.4, 4.5 and 4.6, the competitive contracting process, including the preparation of a request for proposals (the “ESCO RFP”), solicitation of proposals, and award of a contract based upon the methodology set forth in the aforesaid RFP, must be administered by the Board’s purchasing agent, legal counsel or business administrator with the assistance of its ESCO; now, therefore,

BE IT RESOLVED BY THE BOARD OF EDUCATION OF THE TOWNSHIP OF MONTCLAIR IN THE COUNTY OF ESSEX, NEW JERSEY, AS FOLLOWS:

Section 1. This Board of Education hereby determines to use competitive contracting pursuant to N.J.S.A. 18A:18A-4.1 et seq. and as prescribed by Local Finance Notice 2009-10, dated June 12, 2009, for the selection of a qualified power purchase agreement provider (“PPA Provider”) to assist with a proposed solar project to be undertaken in accordance with the School District’s Energy Savings Improvement Program and authorizes its ESCO, Honeywell, with the assistance of counsel, to prepare a request for proposals (“RFP”) for the solicitation of the PPA Provider, to publish such solicitation as required by law and to take other steps necessary to enable the School District to enter into a power purchase agreement with the provider selected in accordance with the RFP. Other appropriate representatives of the School District are authorized to assist in the preparation, publication and review of the RFP and the proposals as permitted and required by law.

Section 2. This resolution shall take effect immediately.

WHEREAS, The contract is awarded without competitive bidding as a “Professional Service” in accordance with the Public School Contract Law, N.J.S.A. 18A:18A-5(a)(1), because it is for services performed by persons authorized by law to practice a recognized profession, and

WHEREAS, The Montclair Board of Education is in need of professional services for Electric Panel Upgrades at Montclair High School and Hillside Elementary School, and
