NOTICE OF EXEMPTIONS

PURSUANT TO SECTION 22 OF THE RAILWAY SAFETY ACT (CANADA) AS ADOPTED BY THE RAILWAY SAFETY ADOPTED PROVISIONS REGULATION B.C. REG. 210/2004 (M161/2004) (“RSA”)

Pursuant to Section 22(2) of the Railway Safety Act (RSA) the Minister of Transportation and Infrastructure may, by notice, on any terms and conditions specified in the notice, exempt • a specified railway company, specified railway equipment or specified railway work from the application of a specified provision of regulations in respect of matters referred to in section 18(1) or (2.1) or of the rules in force under section 19 or 20 or • a specified person from the application of a specified provision of regulations in respect of matters referred to in section 18(2) if in the opinion of the Minister the exemption is in the public interest and is not likely to threaten safe railway operations.

On March 11, 2020 the World Health Organization declared a pandemic outbreak of novel coronavirus (COVID – 19).

On March 16, 2020 the Provincial Health Officer issued the Order of the Provincial Health Officer “Class Order (mass gatherings) re COVID -19.

By cover letters dated March 20, 2020, the Director General, Railway Safety, on authority of the Minister of Transport, issued Notice of Exemption X-20 – 04 and Notice of Exemption X – 20 – 03, each dated March 20, 2020, in respect of the railway companies listed in each Notice (the “Federal Exemption Notices”).

By letter dated April 2, 2020 Technical Safety BC advised me that Technical Safety BC (“TSBC”) supports the approach illustrated in the Federal Exemption Notices as further detailed in the TSBC letter. EXEMPTIONS

Having taken the foregoing into consideration, I am of the opinion that exemptions, on an interim basis, from the application of the specified provisions of the following rules and regulations referenced in paragraphs 1 through to and including 3, below in this Notice, on the specified terms and conditions, set out in paragraphs A and B, are in the public interest and are not likely to threaten safe railway operations.

THEREFORE, I hereby provide notice that: 1. each railway company, as defined in the Railway Safety Act S.BC.C 2004, c.8, holding an operating permit issued under section 11 of the Railway Safety Act (BC) including the railway companies listed in Appendix “A” to this Notice (collectively, the “Railway Companies”) are exempted from the application of the following specified provisions of the following listed rules and regulations: a. Section 10(1) of the Railway Employee Qualification Standards Regulations,

That part of Paragraph 7.1 c) of the Rules Respecting Track Safety requiring that “Recertification must be completed at intervals not exceeding three years.”, c. Paragraph 7.3 d) of the Rules Respecting Track Safety, and d. save and except for the Rapid Transit Company and Intransit BC Limited Partnership, Part A (vii) of the General Rules, of the Canadian Rail Operating Rules,

and I hereby provide further notice that: 2. British Columbia Rapid Transit Company is exempted from the application of Section 2.4.1 of the SkyTrain Rule Book; and 3. Intransit BC Limited Partnership is exempted from the application of Section 4.1.1(e) of the Canada Line Rail Operating Rules,

all, subject to the following terms and conditions: A. that each of the Railway Companies, British Columbia Rapid Transit Company and Intransit BC Limited Partnership, shall keep records of any person whose qualification period has been extended subject to and in accordance with this Notice, and B. that the exemptions set out in this Notice do not remove or qualify the obligation on the part of each of the Railway Companies, British Columbia Rapid Transit Company and Intransit BC Limited Partnership to ensure that persons have the necessary knowledge to safely undertake their duties.

The exemptions set out in this Notice will be in effect until the earlier of November 1, 2020 or the effective date of a further notice by the Minister of Transportation and Infrastructure that these exemptions are revoked.
