GOVERNMENT OF INDIA INFORMATION AND BROADCASTING LOK SABHA STARRED QUESTION NO:339 ANSWERED ON:15.12.2005 LICENCES FOR NEW TV CHANNELS Khaire Shri Chandrakant Bhaurao Will the Minister of INFORMATION AND BROADCASTING be pleased to state: (a) the details of the new TV Channels having been granted telecasting licences in the country during the last three years; (b) whether the Government is aware that in the emerging competitive environment in the broadcasting industry, some TV Channels have been indulging in telecasting news lacking factual basis repeatedly to the viewers; (c) if so, whether the Government has received complaints in this regard during the last one year; (d) if so, the details thereof; and (e) the action taken by the Government thereon? Answer THE MINISTER OF INFORMATION AND BROADCASTING AND PARLIAMENTARY AFFAIRS ( SHRI P.R. DASMUNSI ) (a) to (e) : A Statement is laid on the Table of the House. STATEMENT REFERRED TO IN REPLY TO PARTS (a) to (e) OF LOK SABHA STARRED QUESTION NO.339 FOR ANSWER ON 15.12.2005 (a) : The Ministry has permitted 94 private TV channels to be uplinked from India since January, 2003. A list of such channels is placed at Annexure. (b) to (e) : All programmes telecast on TV channels transmitted/retransmitted through the Cable/DTH network are required to adhere to the Programme Code prescribed under the Cable Television Networks (Regulation) Act, 1995. The Government had received complaints against three news channels. No action was taken on one complaint as the Inter-Ministerial Committee constituted to look into violation of the Programme & Advertising Code was of the view that there was no violation. -

COMPETITION COMMISSION OF INDIA Case No. 36/2012 Dated: 05/09/2012 IN THE MATTER OF: BIG CBS Networks & Anr. … Informants V. TATA Sky Ltd. … Opposite Party ORDER UNDER SECTION 26(2) OF THE COMPETITION ACT, 2002. The present information was filed under section 19(1)(a) of the Competition Act, 2002 (‘the Act’) by BIG CBS Networks Pvt. Ltd. and Reliance Television Pvt. Ltd. (together referred to as ‘informant’) against Tata Sky Ltd. (‘OP’) alleging abuse of dominant position in contravention of section 4 of the Act. 2. BIG CBS Networks Pvt. Ltd. is stated to be a joint venture between Reliance Broadcast Television Pvt. Ltd. (wholly owned subsidiary of Reliance Television Pvt. Ltd.) and CBS Broadcasting Inc. (a company incorporated under the laws of the State of Delaware, USA). The informant distributes TV channels such as BIG CBS SPARK, BIG CBS PRIME, BIG CBS LOVE, BIG CBS PUNJABI and BIG MAGIC etc. 3. The OP is stated to be a joint venture between Tata Sons and the Star Group (‘Sky’). It is a Direct To Home (DTH) service provider. The informant submitted that the OP was a popular and dominant DTH operator with a subscriber base ranging between 26% to 35% and it communicated its leadership in the market to the informant through the email dated 10.02.2012. It was further submitted that, Star India Pvt. Ltd. held substantial interest in the OP, a leading broadcaster in India. 4. The Sky network is alleged to be the ultimate owner of Star India and it telecasts channels such as Star World, Nat Geo Adventure, Nat Geo Wild, FOX Crime etc. -
