This document outlined how the London Borough of Hillingdon would carry out its statutory duties in collating and reviewing information on land which may have contamination issues, in order to identify contaminated land in the borough under Part IIA. Members of the Cabinet approved some revisions to the implementation of the strategy in September 2005. The third strategy review follows in the wake of the second revision to the Contaminated Land Statutory Guidance published in 2012 by DEFRA (Department of the Environment, Food and Rural Affairs) with the aim to clarify the approach for identifying and determining contaminated land. This review brings the original strategy document up to date by highlighting any changes in legislation and guidance, reporting on the progress made in implementing the strategy and identifying the work that remains to be completed. The priorities of the strategy remain the same. These are: 1. To protect human health 2. To protect controlled waters 3. To protect designated ecosystems 4. To prevent damage to property 5. To prevent any further contamination of land 6. To encourage voluntary remediation 7. To encourage reuse of brownfield land The aims of the strategy were updated in 2007 and have been integrated into Council policies where possible, remain as follows: 1. To fulfil the Council’s duties under the Part IIA legislation 2. To bring about environmental improvements to create a clean and attractive borough 3. To encourage voluntary remediation and the reuse of brownfield land 4. To limit the impact of contamination from Council owned land 5. To raise awareness and promote understanding of land contamination issues The work relating to these aims remain complex. The strategy review focuses specifically on how the strategic inspection work is being implemented by the Environmental Protection Unit (EPU), providing details on how information on sites is collected, and used to prioritise the sites for strategic inspection and determine if further detailed investigation is required. Details of the Council’s approach to the determination and remediation of contaminated land will be provided in the Contaminated Land Remediation Strategy in due course. However, Chapter 8 of this document summarises some of the land contamination investigation and remedial work undertaken in the borough over the last decade, including at the only site determined contaminated land under Part IIA, and designated a special site. The strategy review also highlights the importance of working together with other sections of the Council to achieve the aims of the strategy, primarily by sharing information, and the contributions other sections of the Council make in managing land contamination matters in Hillingdon. As intended, the Planning regime (Development Management) continues to be the main avenue for bringing about the voluntary remediation of contaminated land. In accordance with the revised statutory guidance 2012 this strategy and its progress will be reviewed in 5 years and effort will be made to ensure that the principles of this strategy inform any future strategic plans and policies for the borough. Note: Formal consultation with statutory/specialist consultees (Appendix 3), stakeholders (Appendix 4) and the wider public was undertaken prior to publishing the final document. Policy G9 is divided into two parts. On Development Plans, Part A, 1) and 2) are identical to the previous wording; do you see the previous reference to London’s Foundations as superfluous in the policy. For development proposals, Part B says “where relevant” but this is unnecessary. In B 2), developments should also protect SSSIs. In paragraph 8.9.2, when referring to SSSIs it should say “Interest” not “Importance” The paragraph states that “London’s geodiversity Sites are shown in Figure 8.1”. However, it says “National/Regional Geodiversity Importance” and the LGP would like SSSIs to be shown. (Peter: Does the map layer I sent you from Natural England work for you?) As they are part of the Plan, LGP would like LIGS also to appear (with correct LF numbers) on figure 8.1. On Figure 8.1, although it says the reference numbers come from SPG 2012, they bear no relation to London’s Foundations. The numbering of sites in LF should be used. In the table below, I have tried to allocate the number given in figure 8.1 to show the problem. I have tabulated the sites below, with the new sites 60‐72 marked with red numbers.

    Environmental Protection Unit Contaminated Land Inspection Strategy London Borough of Hillingdon Contaminated Land Inspection Strategy, 2001 Executive Summary Part IIA of the Environmental Protection Act 1990 provided a new statutory regime for the identification and control of contaminated land. Local Authorities have a duty to produce a written inspection strategy for the identification of contaminated land within their area. Following the consultation on the draft inspection strategy revisions have been made to create this strategy document to be adopted by the Council as of July 2001. The presence of a contaminant on land does not always mean that the land will be identified as contaminated land within the Council’s inspection strategy. For a piece of land to be identified as ‘contaminated land’ all of the following elements have to be identified: Source: a contaminant, which is in, on, or under the land that has the potential to cause significant harm to a receptor; Receptor: a target for the contaminant, these include living organisms, controlled waters, ecosystems, and property; and Pathway: one or more routes by which a receptor can become exposed to a contaminant. The main purpose of this inspection strategy document is to outline how the Council will identify areas of the Borough where both receptors and contaminants are present and determine the likelihood of significant harm or the pollution of controlled waters being caused via a particular pathway. The Environmental Protection Unit (EPU) will be responsible for implementing the Council’s contaminated land inspection strategy and to carry out its contaminated land enforcement duties. The Council will work in partnership with external agencies and other interested parties, whenever possible, in dealing with the issue of identification and remediation of contaminated land.
