THE SOCIAL SECURITY LEGISLATION (APPLICATION) (NO.15) ORDER 1999

Coming into operation in accordance with Article 1

In exercise of the powers conferred on the Department of Health and Social Security by section 1 of the Social Security Act 1982(a), and of all other enabling powers, the following Order is hereby made:-

Citation and commencement

1. This Order may be cited as the Social Security Legislation (Application) (No.15) Order 1999 and shall, subject to section 1(6) of the Social Security Act 1982, be deemed to have come into operation on the same date as the Social Security Legislation (Application) (No. 4) Regulations 1997(b).

Interpretation

2. (1) Schedule 2 to the Social Security Legislation (Application) (No. 4) Order 1997 (which applied the Social Security Benefits Up-rating Order 1997(c) to the Island) shall be amended in accordance with the following paragraph.

EXPLANATORY NOTE

(This note is not part of the Order)

1. This Order which comes into operation on the same day as the Order that applied the Social Security Benefits Up-rating Order 1997 to the Island amends Schedule 10 to the Jobseeker's Allowance Regulations.

01 2. When the Jobseeker's Allowance Regulations were applied to the Island it was agreed that Domestic Assistance Grants should be the same as the Single Payment provisions within the Supplementary Benefit scheme. Therefore in April 1997 the Supplementary Benefit single payments and the Jobseeker's Allowance domestic assistance grants were up-dated and equalised and an Order was approved by Tynwald which amended the Supplementary Benefit (Single Payments) Regulations 1981. However the amendment to the Jobseeker's Allowance Regulations was omitted in error.

3. This Order corrects the omission from the annual up-rating order submitted to Tynwald in October 1997 providing for the up-rating of reciprocal benefits in relation to Jobseeker's Allowance Regulations 1996. The Order does not affect the entitlement of any individual as the provisions have been applied administratively pending their application by Order.
