Projet D'ordonnance Portant Adaptation De La RÉPUBLIQUE FRANÇAISE ———— Ministère du travail, de l’emploi, de la formation professionnelle et du dialogue social ________ Projet d’ordonnance portant adaptation de la partie législative du code du travail, extension et adaptation de diverses dispositions relatives au travail, à l’emploi et à la formation professionnelle à Mayotte NOR : ETSD1713735R/Rose-1 RAPPORT AU PRÉSIDENT DE LA RÉPUBLIQUE Monsieur le Président de la République, L’article 120 de la loi n°2016-1088 du 8 août 2016 relative au travail, à la modernisation du dialogue social et à la sécurisation des parcours professionnels a, dans les conditions prévues à l'article 38 de la Constitution et dans un délai dans un délai de quatorze mois dix-huit mois à compter de la promulgation de la loi, autorisé le Gouvernement à prendre par ordonnance les mesures nécessaires pour : 1° Rendre applicables à Mayotte, le cas échéant avec les adaptations nécessaires, les dispositions du code du travail relevant du domaine de la loi, ainsi que pour rendre applicables à Mayotte les dispositions spécifiques en matière de travail, d'emploi et de formation professionnelle relevant du domaine de la loi et applicables en ces matières en métropole ou dans les autres collectivités régies par l'article 73 de la Constitution ; 2° Procéder à l'abrogation du code du travail spécifique applicable à Mayotte. La présente ordonnance, prise sur le fondement de ces dispositions, rend applicable à Mayotte les dispositions du code du travail qui n’y avaient pas à ce jour été étendues, en procédant aux adaptations rendues nécessaires du fait de la spécificité de ce territoire, après la concertation avec les organisations syndicales de salariés et les organisations professionnelles d’employeurs représentatives à Mayotte prévue par le même article 120 de la loi du 8 août 2016 précitée. Le chapitre Ier (articles 1er à 9) modifie ainsi en conséquence les huit parties de la partie législative du code du travail. 2/35 Les principales adaptations apportées au droit commun du travail résultent pour l’essentiel : - du maintien de dispositions actuellement applicables à Mayotte, portant notamment sur la commission consultative du travail, organe de consultation regroupant sous l’égide de l’Etat les organisations syndicales et professionnelles locales, les jours fériés spécifiques à cette collectivité ou le contrat de génération ; - de taux ou de seuils spécifiquement adaptés pour tenir compte de la situation économique et sociale de Mayotte, comme pour le régime d’indemnisation du chômage, la garantie financière des entreprises de travail temporaire, l’obligation d’emploi de travailleurs handicapés, l’allocation spécifique de solidarité ou le financement de la formation professionnelle ; - à la prise en compte de l’application progressive des dispositions du code de la sécurité sociale à Mayotte. Le chapitre II (articles 10 à 31) a pour objet de : - rendre applicable à Mayotte sans adaptation les dispositions relatives au droit du travail, de l’emploi ou de la formation professionnelle définies dans les codes autres que celui du travail, telles que celles portant sur les conditions de travail des assistants maternels et familiaux, des éducateurs et aides familiaux définies dans le code de l’action sociale et des familles, à la formation professionnelle prévue par le code de l’éducation, au salaire minimum des pigistes défini par le code de la propriété intellectuelle, aux sportifs professionnels mentionnés par le code du sport et aux conducteurs routiers, aux gens de mer ou au personnel aérien déterminés par le code des transports ; - rendre applicable à Mayotte des dispositions liées relevant d’autres codes nécessaires à la mise en place du code du travail à Mayotte, tels que la procédure de référé devant le tribunal du travail et des prud’hommes ou les dispositions du code de la sécurité sociale relatives à l’indemnisation ou à l’allégement de cotisations pour les créateurs d’entreprise ; - procéder au toilettage des dispositions législatives faisant référence au code du travail applicable à Mayotte rendues nécessaires du fait de son abrogation. Enfin, le chapitre III (articles 32 à 39) prévoit la date d’entrée en vigueur des dispositions de la présente ordonnance au 1er janvier 2018, ainsi que l’abrogation du code du travail applicable à Mayotte à la même date, sous réserve des mesures différées ou transitoires suivantes pour tenir compte notamment des équilibres socioéconomiques et permettre leur mise en œuvre effective par les employeurs, les salariés, ainsi que les organisations syndicales et professionnelles : - les dispositions du code du travail relatives aux services de santé au travail, au compte personnel de formation et au compte d’engagement citoyen constitutifs du compte personnel d’activité sont rendues applicables au 1er janvier 2019 ; - les dispositions relatives au chèque emploi service universel et au chèque emploi associatif entrent en vigueur au 1er janvier 2020 ; 3/35 - les dispositions relatives au conseil des prud’hommes, au portage salarial, à la prévention de la pénibilité et ses conditions de mise en œuvre, à la journée de solidarité et du financement du congé individuel de formation pour certains salariés sont rendues applicables au 1er janvier 2022 ; - les normes techniques de sécurité des machines et des équipements de travail sont rendues applicables au 1er janvier 2022 au plus tard ; - la durée légale hebdomadaire de 35 heures du travail est rendue applicable à Mayotte au 1er janvier 2018 pour les entreprises d’au moins 20 salariés. Pour les autres entreprises, elle est applicable au 1er janvier 2019. Cette mise en place est assortie de l’obligation de respect d’une rémunération mensuelle brute minimale correspondant à 169 fois le taux du salaire minimum garanti au 31 décembre 2017, ainsi qu’une aide de l’Etat à l’intention des entreprises ayant fait baisser le temps de travail de leurs salariés ; - les modalités de compensation liées aux transferts de compétences au conseil départemental de Mayotte qu’entraîne l’application du code du travail sont rendues applicables au 1er janvier 2018, notamment en matière de formation professionnelle et d’aide à la création d’entreprise. Whereas in some cases the principles of separation of powers or of parliamentary autonomy prevent police forces from entering parliamentary premises − meaning that these legislative chambers rely on in-house security services – in others the security of parliaments is ensured exclusively by the police or other state forces with responsibilities in the area of security, defence or civil protection.
