General obligation bonds allow the state to borrow money to finance capital improvement projects. The principal and interest on the bonds are paid out of property taxes. The specific amount of property taxes collected in a given year is attributable to a number of factors, including the amount of debt service required for existing general obligation bonds, the projected debt service required for the new bond issue, the latest assessed valuation of net taxable property, cash balances in bond debt service accounts, the date of issuance, and the actual interest rate obtained on the bond sale.

Based on current projections, the State Board of Finance estimates that the three bonds will generate a maximum of $140.2 million at the current State property tax mill levy rate of 1.36 mills. If all three bonds are approved by the voters in November 2012, the average cost to the owner of a property worth $100,000 over a 10-year period will stay at a flat rate of $8.04 per year. Of that $8.04 average cost per year, $6.88 is attributable to the higher education bond, $0.59 to the senior facilities bond, and $0.56 to the library acquisitions bond. If any of the bonds are not approved, the State property tax mill rate could decline slightly.

A bond represents a sum of money borrowed by a government to finance capital improvement projects. The government promises to repay the amount borrowed, plus interest, over a period of time. The bonds are called “General Obligation” because payment of the debt service (principal plus interest) is a general obligation of the county and its property owners. That is, the bonds are backed by the full faith and credit of the county.

General Obligation bonds require approval by the voters and are repaid from a portion of the property taxes. The current tax for county bond obligation is 89.7 cents per thousand on debt service for the county. The owner of property assessed at $100,000 would pay $29.90 in debt service on bonds. Because old bonds are being retired as the new bonds are requested, passage of the bonds will generally not result in property tax increases.

Bernalillo County General Obligation Bonds

Bernalillo County will ask the voters to authorize the issuance of General Obligation bonds for the 2012 bond cycle (years 2013-2014) totaling $20,100,000. The projects have been grouped according to their general purposes into six ballot questions. General Obligation Bonds are grouped by purpose so that voters have the option of approving one purpose and not another. Once approved, the funds must be used for the approved purposes only.

Bond Question No. 1 - Library Bond Question No. 4 - County Buildings

Albuquerque Gross Receipts Tax Revenue Bonds for Paseo del Norte and I-25 Interchange Improvements Gross Receipt Taxes

New Mexico does not have a sales tax. It has a gross receipts tax instead. This tax is imposed on persons engaged in business in New Mexico, but in almost every case the person engaged in business passes the tax to the consumer. In that way the gross receipts tax resembles a sales tax. Gross Receipts Tax Revenue bonds for the proposed Paseo del Norte and I-25 interchange improvements would be issued against the expectations of gross receipts tax revenue to be collected by the City of Albuquerque.

Paseo del Norte and I-25 Interchange Bond Question

Shall the City of Albuquerque issue up to $50,000,000 of its gross receipts tax revenue bonds to study, acquire property for, design, develop, improve, construct, reconstruct, rehabilitate, renovate, modernize, sign, enhance, landscape and otherwise improve the Paseo del Norte and I-25 interchange?

Proposition to Amend Albuquerque’s Minimum Wage Ordinance

Proposing to amend Albuquerque’s 2006 minimum wage ordinance to raise the minimum wage in the city from the current rate of $7.50 to $8.50 per hour starting in 2013, and to adjust the minimum wage each year after that to keep up with the rising cost of living. The ordinance will also require that, starting in 2013, employers of tipped employees like waitresses and waiters be paid at least 45% of the minimum wage in cash wages from their employers, and that starting in 2014, tipped employees be paid at least 60% of the minimum wage in cash wages from their employers, with the rest of the minimum wage provided either in tips or cash wages. Currently tipped employees are allowed to be paid mostly with tips. The measure will continue the current ordinance’s provision allowing employers that provide certain health care or child care benefits to pay $1.00 less than the minimum wage.

There is a typographic error in the phrasing of this proposition that makes it appear that employees will owe employers money. The New Mexico Supreme Court has ruled that the wording of the original petition should appear intact on the general election ballot. The court noted that there was sufficient public attention to the proposition to allow voters to understand the nature of the typographic error and to vote on the merits of the proposition.
