CEDB & Appeals Body 2016/17 (July – December) Decision of 7 July 2016 Liverpool FC - Mamadou Sakho (doping) Circumstances of the case On 17 March 2016, the Liverpool FC player Mr. Mamadou Sakho (the “Player”) underwent a doping control test after the UEFA Europa League match between Manchester United FC and Liverpool FC. The analysis of the Player’s A sample (the “Sample”) revealed the presence of a substance called Higenamine, this analysis was carried out at the World Anti-Doping Agency (“WADA”) accredited laboratory in Cologne (the “Cologne Laboratory”). On 22 April 2016, UEFA notified the Player of this finding, noting that in conformity with the WADA Prohibited List of 1 January 2016, the above substance is prohibited at all times, in-and out-of-competition under the category S3. Beta-2 agonists, and its presence in the sample may result in a possible anti- doping rule violation. On 28 April 2016, disciplinary proceedings were initiated by UEFA against the Player in respect of his alleged breach of the UEFA Anti-Doping Regulations (the “ADR”). Following a request from the Player, on 28 April 2016, the Chairman of the CEDB decided to provisionally suspend the Player from participating in all matches for which he would otherwise be eligible for a period of 30 days, this provisional suspension was not subsequently extended by the Chairman of the CEDB. Legal framework Article 2 (1) (a) and 4 (1) of the UEFA Anti-Doping Regulations. Decision WADA has not formally communicated any determination to its accredited laboratories and that some (if not all) WADA accredited laboratories are uncertain of Higenamine’s status on the prohibited list. In light of the foregoing, the CEDB decided to dismiss the case against the Player.     !1 M. J. Grant [email protected] ‘That’s what it’s all about’? Football songs, religious hatred, and the strange case of The Hokey Cokey Author’s note on the text below: Herein lies a tale. The article presented here was originally submitted to an academic human rights journal, and was sent back to me for only minor revisions after peer review. After these revisions were done, however, the editors of the journal asked me to make clearer the practical implications of my conclusions. This led to me redrafting the last section of the article, to include the numbered points on what lessons could be learned and what measures could be adopted in light of the points raised. One of these points focuses on the necessity of human rights education and training, specifically with reference to the right to freedom of expression, and necessary restrictions of that right . The editors accepted most of these points but felt that, here, I should have stressed how the songs cited can be used to demonstrate what is and what is not “hate speech”. Since I felt that this actually contradicted my argumentation as a whole, and if it was to be dealt with properly would open up a whole new can of worms, I cut the relevant point in its entirety – I was already far over the word limit, and by this stage the review and revision process had taken the best part of a year. The editors deemed this latest version almost ready for publication, but requested that I include a new paragraph in the conclusion.

Introduction The study of the transfer market constitutes one of the key areas of research of the CIES Football Observatory. This report analyses the paying fee transfers having taken place since 2010 which involved teams of the five major European championships: the English Premier League, the Spanish Liga, the German Bunde- sliga, the Italian Serie A and the French Ligue 1. The first chapter analyses from a historical perspective the sums invested in transfer fees. The second part presents the financial accounts at club level from the latest trans- fer window, as well as the principle net mon- etary flows between leagues.
