Williams Thesis Committee: Ramdas Lamb, Chairperson Helen Baroni Ned Bertz Abstract As a religiously diverse society and self-proclaimed secular state, India is an ideal setting to explore the complex and often controversial intersections between religion and law. The religious freedom clauses of the Indian Constitution allow for the state to regulate and restrict certain activities associated with religious practice. By interpreting the constitutional provisions for religious freedom, the judiciary plays an important role in determining the extent to which the state can lawfully regulate religious affairs. This thesis seeks to historicize the related development of two jurisprudential tests employed by the Supreme Court of India: the religious denomination test and the essential practices test. The religious denomination test gives the Court the authority to determine which groups constitute religious denominations, and therefore, qualify for legal protection. The essential practices test limits the constitutional protection of religious practices to those that are deemed ‘essential’ to the respective faith. From their origins in the 1950s up to their application in contemporary cases on religious freedom, these two tests have served to limit the scope of legal protection under the Constitution and legitimize the interventionist tendencies of the Indian state. Additionally, this thesis will discuss the principles behind the operation of the two tests, their most prominent criticisms, and the potential implications of the Court’s approach.

    Travancore Devaswom Board Why in news? The Travancore Devaswom Board and temple thantri’s Thazhamon family were referred often in the Sabarimala temple controversy. What are the temple boards in Kerala? Kerala has five Devaswom Boards, autonomous bodies under the state government, which manage the temples in the state and their assets, and ensure their smooth operation. Three out of five boards are Travancore, Cochin and Malabar Devaswom Boards. They manage around 3,000 temples among them. The other two are two temples, the Sree Koodalmanikyam Temple in Thrissur, and the Sri Guruvayur Temple, which have their own Devaswom Boards. All temples owned by the Travancore royal family passed under state control following the creation of the United States of Travancore and Cochin on 1949. The Travancore Devaswom Board (TDB), a separate, autonomous body to run the temples in the erstwhile princely state of Travancore was set up. With the formation of Kerala state in 1957, the TDB came under the state government. What are their functions? Travancore Devaswom Board (TDB), the erstwhile royal family of Pandalam, and temple thantri’s Thazhamon family have stakes in the administration, traditions and rituals at the Sabarimala temple. 1. Travancore Devaswom Board (TDB) The Board has a president and two members, who are nominated by the government. The TDB runs 1,249 temples, including Sabarimala. Sabarimala contibuted Rs 342 crore to the TDB in the last fiscal, Rs 73 crore of which was ploughed back into the shrine. The TDB appoints priests, assistants and other staff in its temples; it made history last year by appointing Dalit priests.

DEEPA DAS ACEVEDO* Temples, Courts, and Dynamic Equilibrium in the Indian Constitutiont Must all states have fixed constitutional identities? Does democ- racy necessarily entail citizen-sovereignty? This Article uses ethno- graphic data from India to argue that the answer to both questions is "no." In the aftermath of a massive stampede in 2011, the Kerala High Court initiated an overhaul of the complex executive, legislative, and judicial network that governs the famous Hindu temple at Sabari- mala. The court's conflicting goals were to avoid further consolidating government authority over the temple and to further empower officials so that they could undertake needed reforms. Ultimately the court did both-and neither-in an instance of judicial balancing that reflects the two visions of sovereignty in India. On the one hand, Indian consti- tutional law and judicialpractice reflect a conventional vision of sov- ereignty, in which sovereign authority is wholly vested in citizens and merely exercised on their behalf by the state.

Introduction The irony that is nurtured by the society is to impose a rule, however unjustified, and proffer explanation or justification to substantiate the substratum of the said rule. Mankind, since time immemorial, has been searching for explanation or justification to substantiate a point of view that hurts humanity. The theoretical human values remain on paper. Historically, women have been treated with inequality and that is why, many have fought for their rights. Susan B. Anthony, known for her 2 feminist activity, succinctly puts, “Men, their rights, and nothing more; women, their rights, and nothing less.” It is a clear message. 2. Neither the said message nor any kind of philosophy has opened up the large populace of this country to accept women as partners in their search for divinity and spirituality. In the theatre of life, it seems, man has put the autograph and there is no space for a woman even to put her signature. There is inequality on the path of approach to understand the divinity. The attribute of devotion to divinity cannot be subjected to the rigidity and stereotypes of gender. The dualism that persists in religion by glorifying and venerating women as goddesses on one hand and by imposing rigorous sanctions on the other hand in matters of devotion has to be abandoned.
