TOTAL UPGRADER PROJECT ENERGY RESOURCES CONSERVATION BOARD APPLICATION NO. 1551460 ALBERTA ENVIRONMENT ENVIRONMENTAL PROTECTION AND ENHANCEMENT ACT APPLICATION NO. 001-245130 WATER ACT FILE NO. 00245404 Take Notice that Total E&P Canada Ltd. (Total) has applied to the Energy Resources Conservation Board (ERCB) and Alberta Environment (AENV) for approval to construct, operate, and reclaim a 47 200 cubic metres per stream day oil sands bitumen upgrader, the Total upgrader project. The proposed project would be constructed in two phases with Phase 1 scheduled to commence operation in 2014 at a capacity of 24 000 cubic metres per stream day and Phase 2 scheduled to commence operation in 2018 at a cumulative capacity of 39 200 cubic metres per stream day. Debottlenecking post 2018 would bring the proposed project to a capacity of 47 200 cubic metres per stream day. The proposed project would be located in Strathcona County on all or part of Sections 18, 19 and 20 of Township 55, Range 21, West of the 4th Meridian and would include water facilities and water pipelines to be located on all or part of Sections 24, 25 and 26 of Township 55, Range 22, West of the 4th Meridian. This Notice of Application is being distributed to advise interested persons that the applications are available, and that the ERCB, AENV and other government departments are now undertaking a review of the applications. Nature of the Application Total has prepared and submitted the following applications:

• Application No. 1551460 to the ERCB, pursuant to Section 11 of the Oil Sands Conservation Act. In support of its proposal and as part of this application to the ERCB, Total has also submitted an environmental impact assessment (EIA) report to AENV. The EIA report forms part of the application to the ERCB.

• Application No. 001-245130 to AENV, pursuant to the Environmental Protection and Enhancement Act (EPEA) for an EPEA approval for the construction, operation, and reclamation of a 47 200 cubic metres per stream day oil sands bitumen upgrader and associated infrastructure. • An application (File No. 00245404) to AENV, pursuant to Sections 37 and 50 of the Water Act, to authorize the diversion of up to 12 264 000 cubic metres of water per year from the North Saskatchewan River at SE 36-55-22-W4M, approval of the site water management plans for the construction and operation of the upgrader, and approval to divert existing surface water runoff around the plant site.
