PROPOSED RESOLUTION NO. 17-049

A RESOLUTION RELATING TO ASSESSMENTS; DETERMINING THE NECESSITY FOR HAVING CLEANED AND CLEARED CERTAIN PROPERTY WITHIN THE CITY OF LAKELAND; PROVIDING FOR THE ASSESSMENT OF LIENS AGAINST SUCH PROPERTY FOR EXPENSES INCURRED IN THE CLEANING AND CLEARING THEREOF; PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF

LAKELAND, :

SECTION 1. The City Commission of the City of Lakeland, Florida, does hereby determine that it is necessary for the convenience, comfort, use and safety of the public and property owners within the City that properties located within the City of Lakeland, Florida, be kept cleaned and cleared of all debris and unsanitary growth and accumulation thereon.

SECTION 2. Pursuant to the provisions of Chapter 86 of the Code of the City of Lakeland, the Code Enforcement Division has ordered and directed that the properties, more particularly described in Section 3 hereof, be cleaned and cleared of all unsanitary debris, accumulation or growth. Upon notice, the owners of said properties have failed to respond and the City has contracted for the cleaning and clearing of said properties. The cost and expense of such cleaning and clearing and the cost of making such assessment shall be paid from the assessment on each property so cleaned and cleared, and such assessment is hereby declared a lien

1 against the property, superior in dignity to all other liens except liens for taxes. Each

assessment shall bear interest at the rate of eight percent (8%) per annum,

commencing on the effective date of this Resolution.

SECTION 3. The properties which required cleaning, clearing and removal of debris, the names of the owners of record, and the cost of such cleaning, clearing, and removal of debris, are as shown on Exhibit “A” attached hereto.

SECTION 4. An assessment roll has been prepared assessing the cost of

such cleaning and clearing against each property described in Section 3 and the

assessment has been approved by the City Commission at an Equalization Hearing.

SECTION 5. This resolution shall take effect immediately upon its passage.
