    NZ Herald Album review: Rodriguez, Cold Fact By Lydia Jenkin 7:00 AM Friday Jul 6, 2012 Like a young Bob Dylan crossed with Jose Feliciano, with the poetic story-telling skills of Don McLean or Paul Simon, imparting the cold facts with a sly attitude, Sixto Rodriguez is an unsung hero of 70s counter-culture. A true rock 'n' roll star. Born and raised in Detroit to Mexican parents, and discovered by a couple of producers who saw him playing in a dive bar, Rodriguez is a rare songwriter, who can encapsulate a whole world of emotion in two potent lyrical lines. He has a knack for winding wry observations into a melody that produces elusive musical magic. That magic should've made him a big name when Cold Fact was released in 1970, the songwriting matched by skilful production, which leaves his world-weary American drawl to the fore, and builds up beautiful classic instrumental layers, along with the odd scorching guitar lick. The tenderness of Crucify Your Mind contrasts with the jaunty cheek of I Wonder, the cheerful resignation of Establishment Blues with wistful-on-reflection Jane S Piddy. Oddly, it was ignored in America, as was his second album Coming From Reality. Despite the songs full of insight into American urban life, they didn't connect with the wider public. But there were thousands of liberal young groovers in South Africa, Australia and even a few in New Zealand who regarded him as highly as The Beatles or Jimi Hendrix. Forty years on, a brilliant documentary called Searching For Sugar Man, which details his remarkable story, is being released (it's playing at the NZ International Film Festival) and there's been a resurgence of interest in Rodriguez, hence the re-release of both albums.

It was last Sunday morning and I’d spent the weekend googling recent developments in the story of Rodriguez, the construction worker who woke up one morning to discover he was actually a pop star in a parallel universe called Mzanzi. I checked his appearances on big-time American TV talk shows, scanned emotional fan mail on his website and watched several clips of foreign audiences erupting in standing ovations after screenings of Searching for Sugar Man, Malik Bendjelloul’s magical documentary about Rodriguez’s life, death and miraculous resurrection. Somewhere along the line, it struck me that Rodriguez’s global triumph is actually a huge compliment to people like me — white South Africans born in the baby boom, raised on the apartheid moonbase and converted in the Sixties to the cause of long hair and teen rebellion. The rest of you would not get it, so I ran my idea past Segerman, who laughed and said: “You know then,” thereby identifying himself as an ex-hippie of exactly my own persuasion. As the whole world is now aware, Segerman is the psychedelic music enthusiast who set out in the l990s to unravel the mystery of the missing Sugar Man. Rodriguez was supposed to be dead, but Segerman and Craig Bartholomew found him living in poverty in Detroit’s ruined downtown and brought him back to South Africa, where he stood dazed and dumbfounded in an outpouring of love from thousands of fans who had waited decades to see his face.

These contracts gave him the exclusive rights to Rodriguez’s songs. Balk claims that while under this exclusive arrangement, Rodriguez conspired with Defendant Clarence Avant to release an album called Cold Fact behind Balk’s back, falsely attributing authorship of the songs to others. While the album never took off here, it became a hit in South Africa—something unknown even to Rodriguez until many decades later. When the story of the album’s success became the feature of the 2012 Oscar-winning 2:14-cv-11767-LJM-RSW Doc # 96 Filed 12/06/16 Pg 2 of 31 Pg ID <pageID> documentary Searching for Sugarman, Balk claims he suddenly realized he had been cheated, so he sued Avant to recover the money he lost out on over the years. The problem for Balk is that discovery yielded undisputed evidence that tells a different story: that he did little for Rodriguez and effectively gave up on him, abandoning their arrangement.
