Remember California Has Own Joint-Employer Standard By: Bianca Saad, CalChamber Advocacy It’s important for employers to keep in mind that California has its own set of rules when it comes to joint-employer liability. A recent top story discussed the proposed rule recently announced by the National Labor Relations Board (NLRB), which would change the standard for determining joint-employer status under the National Labor Relations Act (NLRA). As a reminder, the NLRA covers all employers involved in interstate commerce (subject to certain jurisdictional limits), except airlines, railroads, agricultural operations and government entities, which are governed by other federal or state laws (i.e., the Railway Labor Act, the California Agricultural Labor Relations Act, etc.). In California, different tests may be applied for determining if there is a joint-employer relationship depending on the legal issue—such as wage-and-hour liability, sexual harassment, or coverage and responsibilities under the Family Medical Leave Act and the California Family Rights Act. and organizations that have served and continue to serve as members, directors, committee members, partners and friends. I am so appreciative of all the support I have received and I have learned so much from this valuable and enriching experience. I am appreciative of the Chamber staff that are always dedicated and loyal to the Chamber. The positive and collegial relationship I have had with the business community, the volunteers, the chamber staff and the city of Irwindale staff and elected officials will always be for me the high point of my tenure with this organization. The next chapter for me will include more time for my husband who has been my rock for 20 years, more visits with my daughter and her family including my seven grandchildren, more time to volunteer for those causes I hold near and dear, more time for road trips and travel here and abroad, more time to read and continue to learn, and more time walking that precious dog of mine. I may even join the world of freelance and do the things I enjoy (writing, marketing, helping organizations thrive). Life is short so I hope to make this chapter memorable. In closing, I will do all I can to make this transition as smooth as possible for all concerned. I wish this Chamber and all of you the very best of luck and great success in the future. I am confident that all of you along with a new CEO will continue with the mission and vision and take this Chamber to great heights. Thank you for giving me the opportunity to work for the Irwindale Chamber these past 5 years. I am proud to call you friends and hope to keep in touch with many of you. 7 (Employer Standards - continued from coverpage) The Industrial Welfare Commission and the California workers, fining the chain more than $4.57 million in damages Supreme Court adopted a broad definition of joint employer and penalties.
