    November 19, 2014 Mortgage Servicing: Takeaways from Interview with Source at FHA; A Close Look at FHA Certification Process for HUD Auction Conclusion On November 19th, the FHA’s Office of Asset Sales will conduct the latest round of auctions of defaulted FHA- held mortgage notes. Bidders are likely to include investment companies tied to specialty mortgage servicers implicated in a host of problems with financial regulators related to their efficiency and fitness at servicing mortgages—for example, it has been reported that Altisource Residential, a company affiliated with Ocwen, was a losing bidder in an auction in June. These regulatory problems could jeopardize the companies’ ability to bid at the auction: As part of the qualification process, potential bidders must attest to a number of questions on the qualification statement, including inquiries about regulatory risks. As explained below, potential bidders must disclose past and ongoing regulatory sanctions including debarments and suspensions; agreements to pay penalties; federal and state enforcement actions; or investigations related to federal lending laws. While none of these factors serves as a per se bar to being qualified to bid on the distressed assets, they present opportunities for the bid reviewers at FHA’s Office of Asset Sales to scrutinize the bidders for their regulatory risk and fitness to deal with such a pool of high-touch mortgages. Key points for stakeholders to consider include: Some Risk, But FHA Reluctant. The auction is a sealed-bid process, and FHA does not identify the bidders until the bidders are final and ranked. If they are participating, Altisource and other mortgage companies (including Nationstar and Walter Investment Management) that are currently receiving regulatory scrutiny are likely to be at some risk of not qualifying for the auction, although FHA seems reluctant to prohibit bidders from participating in auctions unless they are clearly barred from doing mortgage business by state or federal authorities.

Introduction and Summary The Twin Cities metropolitan area is one of the least diverse and most affluent regions in the nation. It once operated the nation’s most effective program to ensure education and housing integration and fairness. In the early 1990s, there were very few segregated schools in the Twin Cities. Today there are more than 130. The region is much more segregated than Portland and Seattle—the areas most often cited as its primary competitors. Recently the deeply segregated neighborhoods of the Twin Cities experienced an unusually harsh period of decline and disinvestment. Nothing comparable happened in Portland and Seattle. At one time, the Twin Cities implemented one of the most integrative affordable housing programs in the nation, but its housing integration program was abandoned in 1986. School integration efforts have also been in decline since the late 1990s. In recent years, subsidized housing programs have largely been centered on building and rebuilding housing in the poorest parts of the region. In recent decades, the central cities have captured a disproportionate share of subsidized housing funding. A large part of the short-term rationale for this is economic development, but in the longer run, the strategy hurts these areas and the region by further concentrating poverty in just a few neighborhoods.

LEE 3, POOI LENG NG 3 ABSTRACT This paper examines the price differential between properties traded in the auction market and private negotiated market. With the exception of anecdotal information which suggests that auctioned or foreclosed properties in Malaysia tend to be sold at a deep discount, no study has thus far attempted to quantify this foreclosure discount. We uncover this question by examining listing price of apartment properties in Kuala Lumpur during 2009-2014. For each of the auctioned apartment in our sample, we match it with comparable non-auctioned apartment located in the same building block. This matching strategy essential net out the locational and neighbourhood characteristics of the properties, thus, allowing us to attribute the price differential to the “stigma effect” associated with auctioned or foreclosed properties. We document that auctioned apartments are listed at a discount of 34% as compared to apartments listed in the private negotiated market. SALES PROCEDURES SECTION I - POLICY 10-1 Properties available for sale shall be publicly advertised for a period of 10 days. Bid openings must be public and shall be conducted on the first workday following expiration of the 10-day period. The advertisement shall provide for an Extended Listing Period and properties not sold will remain available until sold or relisted under different terms. SECTION II - INTERNAL CONTROL OBJECTIVES 10-2 The Chief Property Officer, or designee, reviews the files on all properties sold where the selling price varies from the appraised value. 10-3 Sales contracts are awarded to the acceptable highest net offeror in accordance with HUD program requirements. 10-4 Upon Receipt, all collections of funds related to sales activity, including earnest money deposits, are promptly deposited and appropriate documentation is maintained. 10-5 Confidentiality is exercised by offices using facsimile machines to receive sales offers. Facsimile offers should be placed immediately into envelopes and sealed. The Chief Property Officer should designate an individual to control receipt of facsimile sales offers. 10-6 Segregation of Duties. Within the Field Office, separation of duties is maintained between the approval of sales contracts and the collection of earnest money deposits. SECTION III - SALES PROGRAMS 10-7 Insured Sales. Properties which in their present condition meet the intent of the Minimum Property Standards (MPS) described in Handbook 4905.1, Requirements for Existing Housing, One to Four Family Living Units.
