COMMUNIQUE OF AFRICAN THINK-TANKS ON THE ELECTION LAWS (AMENDMENT) BILL 2017 IN KENYA October 07, 2017 - Nairobi, Kenya

This Communique follows a one-day intensive consultations by African think-tanks on the proposed Election Laws (Amendment) Bills, 2017. We concluded that the proposed Bills must be passed if Kenya is to ensure a credible, free and fair election on October 26. This is also the only way of ensuring that the Supreme Court does not annul the fresh elections on the basis of technicalities and processes.

1. The Proposed Amendments: The Election Laws (Amendment) Bills 2017 published on September 28, 2017, and now before Senate and the National Assembly. The Bills before the joint House of Parliament include amendments to the Independent Electoral and Boundaries Commission Act No. 9 of 2011; Elections Act No. 24 of 2011; and the Election Offences Act No. 37 of 2016. 2. Why the Bills: The amendments reflect a desire to secure elections in order to protect lives, property and entrench democracy, good governance, and rule of law. This is in line with international norms, particularly the principle of the Responsibility to Protect (R2P). Collectively, the Bills seek to: • Fortify and secure the October 26 fresh election and future presidential elections; • Insulate elections from mischief by election officers; • Remove ambiguities in the law relating to the conduct of election and transmission of results; • Avert the risk of the Chairperson of IEBC being unable or unwilling to declare the winner; and • Forestall the possibility of the overturning of results of another election by the Supreme Court on the basis of a flawed process rather than the results (the will of the people).
