Two case studies help unravel characteristics of this dominant discourse: The Federal Bureau of Investigation’s attempt to delegitimize the Nation of Islam by characterizing its leadership and doctrine as violent, racist, and unorthodox; and the Central Intelligence Agency and State Department’s simultaneous effort to validate Islam and Islamism in the Middle East by positing them as ideological forces against communism and Arab Nationalism. Interactional and interdisciplinary consideration of archived rhetorical artifacts uncovers how motives to expand US empire, quell anti-imperial and anti-racist resistance, and advance early Cold War objectives encouraged executive agents to reframe Islam.

William Preston and the Revolutionary Settlement BY RICHARD OSBORN Patriot (1775-1778) Revolutions ultimately conclude with a large scale resolution in the major political, social, and economic issues raised by the upheaval. During the final two years of the American Revolution, William Preston struggled to anticipate and participate in the emerging American regime. For Preston, the American Revolution involved two challenges--Indians and Loyalists. The outcome of his struggles with both groups would help determine the results of the Revolution in Virginia. If Preston could keep the various Indian tribes subdued with minimal help from the rest of Virginia, then more Virginians would be free to join the American armies fighting the English. But if he was unsuccessful, Virginia would have to divert resources and manpower away from the broader colonial effort to its own protection. The other challenge represented an internal one. A large number of Loyalist neighbors continually tested Preston's abilities to forge a unified government on the frontier which could, in turn, challenge the Indians effectivel y and the British, if they brought the war to Virginia. In these struggles, he even had to prove he was a Patriot. Preston clearly placed his allegiance with the revolutionary movement when he joined with other freeholders from Fincastle County on January 20, 1775 to organize their local county committee in response to requests by the Continental Congress that such committees be established.

This is the case of Islam.’ —Tariq Ramadan.] WHAT ‘IF THE ARAB SPRING turns ugly’—asks Vail Naser, the author of The Shia Revival: How Conflicts within Islam will Shape the Future? ‘The Arab Spring is a hopeful chapter in Middle Eastern politics, but the region’s history points to outcomes. There are no recent examples of extended power-sharing or peaceful transition to democracy in the Arab world. When dictatorships crack, budding democracies are more than likely to be greeted by violence and paralysis. Sectarian divisions—the bane of many Middle Eastern societies—will then emerge, as competing groups settle old scores and vie for power.’ True it was in the past, but not necessarily it would be so in the future. After all, social formations are changing. For centuries, Islam had represented the greatest military power on earth. In the medieval period, between the sixth and fifteenth centuries, Islam was the leading civilization in world, with its great and powerful kingdoms, industries, commerce, creative science, and letters. Its geographical expansion came in three main waves of successively: Arabs, Mongols, and Ottoman Turks. Since the eleventh century, after the conquest of Mongols, Persians, and Turkish armies, Arab lands had been controlled by foreign powers. Most of the region was ruled by the Ottoman Empire for centuries.

    Exercising Passive Personality Jurisdiction Over Combatants: A Theory in Need of a Political Solution ERIc TALBOT JENSEN* Abstract On March 4, 2005, a car carrying Nicola Calipariand Andrea Carpani,members of the Ital- ian Ministry of Intelligence, and Giuliana Sgrena, a journalist who had been taken hostage one month before and who hadjust been releasedand was on her way back to Italy, was traveling to the Baghdad Airport. The car wasfired on by U.S. forces from a checkpoint, killing Mr. Calipariand wounding Ms. Sgrena and Mr. Carpani. As a result of this tragic event, a joint investigation occurred, but Italy and the United States could not agree on the results. The United States determined that the soldiers involved had acted appropriately. Italy disagreed, and on February 7, 2007, Mario Lozano, a U.S. Army National Guardsman,was indicted by Italianprosecutors who declared that Lozano could be tried in absentia because the case was "political." The trial occurred, and the decision was announced on October 25th. Judge Garganiruled that the law of the flag, or the law of the soldier'ssending state, prevailsover a claim of passive person- ality jurisdiction in a case like this. This paper analyzes Judge Gargani'sdecision and determines that he is correct. Absent another internationalagreement, the exercise of passive personality crim- inaljurisdiction over a combatantfor combatant acts is inappropriatewhen the combatant's sover- eign is seized of the case. Rather, because the combatant is acting on behalfof the sovereign, any claim against the combatant should be resolved through political means.
