Broadcasting Corporation Idasa’s democracy Index foRewoRd 1 Foreword Idasa developed the Democracy Index to assess the depth of democracy in South Africa. In its initial iteration, designed by Robert Mattes and Richard Calland, the Index comprised 150 questions. These were honed to a list of 100 questions in 2005 and the same questions were used for Idasa’s subsequent South Africa Democracy Index in 2010. The research re- lies on expert analysis to answer a set of questions that interrogate how closely, in practice, - cisions about public affairs; and, how equal are citizens to one another in this accountability elections, accountability, political rights and human dignity. Idasa is expanding the Index into southern Africa in an effort to broaden the capacity of individuals and organisations monitoring and supporting democratic governance efforts in the sub-region. As the Idasa Democracy Index is tested in a range of countries, the tool will be enhanced and nationalised. The hope is that citizens of any country can use the Democracy Index to assess and debate the current state of their democracy. The purpose of the scores is to assist citizens in making their own judgements, based on the information available, to stimulate national debate, and to provide democracy promoters with a tool for identifying issues and needs that can be addressed through education, advocacy, training, in- stitution building and policy revision. This is the inaugural Index for Zambia and is intended to set a benchmark for democracy to be measured against in the future. All of the authors, and one of the co-editors, are Zambian or based in Zambia. Together, their depth of expertise is grounded in years devoted to activism, civil society, academia and government. Authors were asked to provide a numerical score for each question and a narrative justifying their rating. The group convened twice to ensure both a common un- derstanding of the Index and peer review of the ongoing assessment process. The second of these meetings took the form of a validation workshop at which other members of civil society, academia and government were invited to give feedback and comment on the analy- expert reference group, ultimately this is an individual expert assessment. As such, each set of Democracy Index results stands on its own and is not suitable for statistical comparison across years or cross-country comparative ranking. It is through its use by Zambians that the Idasa Democracy Index can enhance research capacity, assist representative groups to lobby for greater democratic depth and quality, and spark participatory engagement between governments and citizens. Three republics have emerged since Zambia gained independence from the United Kingdom in 1964. At the beginning of the First Republic, struggle leader Kenneth Kaunda of the United National Independence Party (UNIP) was elected president. His leadership became increasingly authoritarian and intolerant of opposition. These traits culminated in a constitutional amendment creating a one-party state and the birth of the Second Republic in 1972. Zambia was a one-party state until 1991. As opposition through political parties was impossible during this time, growing dissent was channelled through various groups and or- ganisations, including Christian churches, trade unions and other civil society organisations (CSOs).

    Legalbrief | your legal news hub Friday 01 October 2021 Zambia’s Constitutional Court shows it is strongly independent Until almost the last minute, high-ranking foreign guests as well as ordinary Zambians were in the dark: would the presidential swearing-in ceremony for Edgar Lungu go ahead on Tuesday this week as scheduled? It all depended on the courts. It was touch and go: then, just hours before the event, came news that the High Court judge approached by the opposition to stop the ceremony had declined to grant the application, saying that as a single judge he lacked jurisdiction in the matter. And so Tuesday’s planned swearing-in took place after all, with the opposition United Party for National Development promising that this was not the end of the matter and that further court challenges could be expected. Zambia’s contentious 11 August elections have been dominated as much by the courts as by vote-casting. A new constitution, finalised before parliament was dissolved for the elections, was supposed to have made the polls and their results more stable. Among others, it provided for a two-stage process if required: a presidential candidate would have to win at least one vote more than 50% of the ballot in order to avoid going to a second round run-off. But what actually happened severely tested the efficacy of this provision. The Patriotic Front’s Lungu, who won the last elections by barely 28 000 votes, won 50.35% this time. His main rival, in this election and the last, Hakainde Hichelema, won 47.67% of the votes.

    Country Gender Profile Democratic Republic of the Congo Final Report March 2017 Japan International Cooperation Agency(JICA) IC Net Limited EI JR 17-045 Summary The Socio-Economic Situation and Gender in the DRC The General Social, Political, and Economic Situation of the DRC Conflicts following its independence and its oppressive dictatorship have become complex and prolonged owing to factors such as ethnic tension and disputes about control over mineral resources. The eastern part of the country is still unstable. Of the population in the DRC, which is blessed with vast land and abundant natural resources, 63% still live under the poverty line, and the economic inequality among the population is widening. Gender As indicated by the Gender Inequality Index and SIGI, gender relations in the DRC are determined by strong male-dominant gender norms. Women’s political participation is limited; women account for only 8.4% of the National Assembly and 4.6% of the Senate (2010), which is one of the lowest in Africa, and 6th from the bottom among 51 African countries. The 2015 revision of the electoral law dropped the 30% quota for women, which is considered a retrogressive sign. Women’s labour participation is high (70.7%), and almost the same as that of men (73.2%); however, women are in a more difficult situation than men. Women’s unemployment rate was 6.7% in 2014 while that of men was 9.4%. Women’s labour is concentrated in agriculture and the informal sector and gender norms limit their access to productive assets such as land and capital.

The ruling Movement for Multiparty Democracy (MMD) exerted considerable influence through its patronage and allotment of government resources. In a 2008 by-election, then-vice president Rupiah Banda was elected president in generally free and fair multiparty elections. Security forces reported to civilian authorities. Human rights problems included unlawful killings; torture, beatings, and abuse of suspects and detainees by security forces; official impunity; life-threatening prison conditions; arbitrary arrests and prolonged pretrial detention; long trial delays; arbitrary interference with privacy; restrictions on freedom of speech, press, assembly, and association; government corruption; violence and discrimination against women; child abuse; trafficking in persons; discrimination based on sexual orientation and against persons with disabilities; restrictions on labor rights; forced labor; and child labor. RESPECT FOR HUMAN RIGHTS Section 1 Respect for the Integrity of the Person, Including Freedom From: a. Arbitrary or Unlawful Deprivation of Life There were no reports that the government or its agents committed politically motivated killings; however, security forces committed unlawful killings during the year. The Legal Resources Foundation (LRF), an independent human rights nongovernmental organization (NGO) that counseled victims' families and represented them in actions against the government, consistently investigated and publicized such incidents; however, the government rarely punished perpetrators.
