RESOLUTION TO AUTHORIZE THE CREATION OF CARRIAGE HILL SECTION 22 LIGHTING DISTRICT

RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that

WHEREAS, Liberty Township Fiscal Officer Pam Quinlisk presented a request to create a lighting district for Section 22 of the Carriage Hill subdivision;

WHEREAS, Duke Energy has presented an Outdoor Lighting Service Agreement requesting three (3) Deluxe Acorn 50W LED Type III street lights on Winners Circle Drive located in the Carriage Hill subdivision; and

WHEREAS, Liberty Township has received payment from the developer for the first eighteen (18) months of service; and

THEREFORE, BE IT RESOLVED that the Liberty Township Board of Trustees hereby authorize the creation of the Carriage Hill Section 22 Lighting District for three (3) lights.

CASE NO. ZC20-001 LIBERTY FLATS – ZONING MAP AMENDMENT & PRELIMINARY PUD PLAN APPLICANT – CASTO

PROPOSED REQUEST: The applicant is requesting a Zoning Map Amendment for 29.14 acres of land from B-PUD (Business Planned Unit Development) to R-PUD (Residential Planned Unit Development), and Preliminary PUD Plan approval for a proposed 356-unit residential rental development that includes a clubhouse and pool. The public hearing for this request was continued by the Board of Trustees on June 2, 2020 to allow the applicant an opportunity to better demonstrate the transition from Liberty Center and to provide additional information.

BACKGROUND INFORMATION: The subject site is located on the north side of Liberty Way and on the west side of Taylor Street, and is part of the Liberty Center development. The following is an approval summary of Liberty Center:  July 2008 (Resolution #2008-090 - Attached): The subject property was rezoned from B-2 (General Business) to B-PUD (Business Planned Unit Development) for a multi-use development featuring retail, office, hotel, restaurant and residential uses for 110.99 acre.  October 2013 (ZC13-011 - Attached): Final PUD approved for Phase 1 o Phase 1 Project Size: 65.14 Acres o 1.4 Million Square feet multi-use development o Total tenant spaces: 155  October 22, 2015: Grand Opening Phase I Liberty Center  Today: Liberty Center is roughly 85% occupied when analyzing the amount of square footage available today. There is capacity to expand in the currently developed portion of the site. The restaurants, hotel and entertainment venues report higher than expected business while the existing retail spaces continue to slowly fill in. The office building is nearing capacity and there could be additional opportunities to add office into the existing Liberty Center development footprint. The Liberty Center Apartments have 238 units with 18 Different floor plans. The occupancy rate has remained steady over the lifetime of the project; however, construction challenges over the past couple of years has slightly reduce the occupancy rate to its current 96%.

1. The following is a comparison between the currently approved Preliminary B-PUD Plan (Z08- 013) and the Proposed Preliminary PUD Plan (Z2020-001). The calculations for the uses that were proposed within the area of this proposed zoning map amendment:

***Revisions from previous staff report denoted in red*** As illustrated in the table above, the proposed uses are being modified. Instead of the expansion of the current mix of uses in Liberty Center, the proposed use is 100% multi- family rental units with a pool and clubhouse.

2. It is important to note the development team changes that have taken place in the last couple of years. The Steiner + Associates team who created the master plan for Phase I and II is no longer leading the leasing and property management efforts for the property. As of December 1, 2019 Bayer Properties (based in Alabama) is overseeing all leasing activity. While the retail market nationwide is changing dramatically with the convenience and speed of online shopping options, Liberty Center remains focused on creating an environment to attract shoppers. They continue to attract niche and brand retail storefronts, and a large entertainment user (In The Game) is currently finalizing permits with the Township and County. Liberty Center continues to build its mixed-use environment by creating more events and opportunities for people to gather and connect. They have identified density as a key driver for a more vibrant and active center. The applicant provided a letter from Yaromir Steiner dated March 13, 2020, which expressed his support for the proposed development.

3. The 6.5 acre portion of the current B-PUD that fronts Liberty Way (to the south of the proposed zoning map amendment) will remain B-PUD and reserved for commercial uses. The eastern portion of the land is already developed as a self-storage facility. The remainder is vacant and could develop as commercial in the future. Since the original Preliminary PUD Plan would be impacted by the proposed Zoning Map Amendment, a new Preliminary PUD Plan would be necessary prior to any development of the property. The applicant is providing an access easement at the south end of Streets B and D for additional cross-access connections as this portion of the site develops.

4. When the existing Liberty Center B-PUD was approved, a Traffic Impact Study (TIS) was completed for the entire development, which included the subject property, and improvements were recommended/required to accommodate the traffic volume that was anticipated from the overall development. At that time, while the approved Preliminary PUD Plan did not illustrate direct access to the west from Cincinnati-Dayton Road, it was recommended/required that an access drive be provided to the west to Cincinnati-Dayton Road. The applicant is proposing a significantly less dense development with no commercial uses, which will drastically reduce the number of estimated vehicle trips from the site. The applicant did prepare a TIS, which was approved by the Butler County Engineer’s Office on April 1, 2020, which confirms that an access drive to Cincinnati-Dayton Road is not needed to accommodate traffic from the proposed development and Liberty Center. (Attached is the BCEO approval and the TIS Executive Summary) Instead, the applicant is proposing an Access Easement at the southwest corner of the site, the applicant is proposing an Access Easement along the entire length of Street A, as well as stubbing streets B and D to the south property line (including sidewalks), which could provide eventual access to Cincinnati- Dayton Road via an access drive that would need to be coordinated through development of the parcels along Liberty Way (see attached illustration of planned access to Cincinnati- Dayton Road). This planned access drive has already been constructed at the rear of two commercial properties but would need to be coordinated through the remainder.

5. Pedestrian crosswalks were added at all major intersections within the site, as well as at the Taylor and Bales Street intersection and Taylor and Gibson Street intersection. These connections will promote pedestrian movement to and from Liberty Center.

***Revisions from previous staff report denoted in red*** 6. The Butler County Engineers Office believes access to Cincinnati-Dayton Road is vital for long-term traffic flow. (See BCEO Comment #1 (e) below.) If the rezoning and Preliminary PUD Plan is approved an updated Traffic Impact Study shall be required that confirms the needed improvements for the proposed development and the Liberty Center B-PUD, which shall be subject to approval by the BCEO. All Final PUD Plans shall incorporate the recommended/required improvements of the TIS. At a minimum, the roadways at the southwest corner of the site shall be stubbed into the south property line to better facilitate the connection to Cincinnati Dayton Road as the parcels to the south develop. As previously stated in Staff Comment #4, the applicant received approval of the TIS from the BCEO, which confirms that no traffic improvements are required; however, the BCEO recommends provisions to achieve eventual access to Cincinnati-Dayton Road for overall accessibility of the site.

7. The applicant is providing 692 694 spaces for the 356 units (1.94 parking spaces per unit). The parking requirements listed in Table 7.6-A of the Liberty Township Zoning Resolution require 2 spaces per unit or 712 spaces. The applicant feels the demographic of their clients and proximity to the more urban Liberty Center require tenants to have fewer cars than in a traditional suburban type development.

8. The applicant is proposing a 5,725 SF clubhouse with a 2,000 SF pool. According to Table 7.6-A of the Liberty Township Zoning Resolution the Clubhouse and pool are required 1.0 space per 100 SF of water surface area for the pool. The applicant’s preliminary plan shows 67 on street parking spaces surrounding the Clubhouse, which are counted towards the total number of parking. The Clubhouse and pool will be reserved exclusively for the residents of the subject property, not including the adjacent Liberty Center residential portion to the east or the general public. Staff feels that due to the close proximity to the units reserving spaces exclusively for the clubhouse is not necessary.

9. The applicant provided preliminary building elevations for Multi-Family Rental Units and the Clubhouse, which illustrates a high quality design and use of quality exterior building materials. The architectural design and building materials should be approved with the Final PUD Plan of each phase, which should be similar in nature to the submitted preliminary building elevations.

10. The applicant provided two cross sections of the proposed townhomes that would front on Taylor Street, as compared to the existing buildings on the other side of the road to better illustrate the transition from existing Liberty Center from AC Marriott, movie theater and the adjacent buildings. They show that the proposed townhomes are 36’ tall, which is taller than the initial buildings on the other side of the road, and how they relate to the taller hotel and theater buildings.

11. The applicant provided an illustration showing Taylor Street with the proposed townhomes depicted and the existing buildings in Liberty Center to better represent the transition. The applicant believes the proposed buildings would effectively transition from Liberty Center as originally proposed.

12. The applicant has provided a PowerPoint presentation outlining the typical finishes in the individual units. The document illustrates high quality materials; kitchens will feature countertops, stainless-steel appliances, modern faucets, pendent lighting and tile backsplashes. Bathrooms will include granite countertops, tile flooring, rainfall showerheads and modern

***Revisions from previous staff report denoted in red*** light fixtures and faucets. If approved, all Final PUD submittals should confirm and reflect these represented quality interior finishes.

13. The private street design should be approved with the Final PUD Plan for each phase, which should be designed in accordance with the current BCEO standards. All drives and parking lots should utilize continuous curbs throughout.

14. All signage shall be approved with the Final PUD Plan.

15. A detailed grading and drainage plan shall be provided with each Final PUD Plan, which should demonstrate how the stormwater is being handled for the site according to the Butler County Stormwater Regulations.

16. A detailed landscape plan shall be provided with each Final PUD Plan, which shall illustrate extensive landscaping in the primary locations (entrances and highly visible locations). Additionally, Street trees should be provided at a rate of one (1) tree per 40 feet on center. Trees should be 1.5” caliper at the time of planting. All street trees should be set back a minimum of 20’ from the intersections to preserve the appropriate sight distance. The required distance should be measured from where the radius of the intersection begins.

All open space, street trees, and associated landscaping, stormwater facilities (retention ponds and detention basins), trails and paths will be the responsibility of Liberty Flats and should be maintained regularly in good condition and free of debris. All paths should be regularly maintained in good condition.

OTHER AGENCY COMMENTS:  Liberty Township Zoning Commission The Liberty Township Zoning Commission conducted a public hearing on May 18, 2020 for the proposed request and made a recommendation of approval to the Liberty Township Board of Trustees. This recommendation is attached for reference.

 Butler County Planning Commission The Butler County Planning Commission conducted a public hearing on March 10, 2020 for the proposed request and make a recommendation of approval of the proposed request. This recommendation is attached for reference.

 Butler County Engineer’s Office 1. The Traffic Impact Study (TIS) was approved by the BCEO on April 1, 2020, which confirmed that no additional traffic improvements are required with the Liberty Flats development; however, it was noted that it was imperative that the future access locations to Liberty Way and Cincinnati Dayton Road are able to be constructed in a reasonable manor in terms of horizontal and vertical profiles. (Note: the below comments regarding the TIS have been addressed by the applicant with an updated TIS, which have been incorporated into the approved TIS. 2. Traffic Impact Study or TIS has been received by BCEO. Comments are as follows a. Please use LU 220 – Low Rise instead of LU 221. LU 220 seems to be a better fit for the proposed residential development. b. No need to change but prefer trip distribution percentages to be rounded to nearest 5%.

Direct all trips generated by Liberty Flats to Taylor Street. Do not show trips using Tyler’s Place Blvd. e. Currently, the submitted site plan only shows access to Taylor Street. All indications show Taylor Street will be able to handle the traffic generated from Liberty Flats. My concern is secondary access for EMS and BCEO’s desire to achieve access to Cincinnati Dayton Road. (As you may remember, Steiner’s original full build-out site plan, Phase 2, required access to Cincinnati Dayton Road at Liberty Centre Drive.) The BCEO still believes access to Cincinnati Dayton Road is vital for long term traffic flow. How will the current site plan allow for this future connection? f. Since there is a Public Access Easement for Taylor Street, and county has involvement with Community Authority, what modifications (if any) to development agreement need to occur. Planning Department may want to consult with Prosecutor's office. 2. Storm Water Report (Page 3) under design criteria, there is a discrepancy as to Critical Storm. 3. The pre-development Tc seems low while the post-developed Tc seems high. 4. Pre-developed use of straight row crops is not CN value for this property as row crops haven't been on-site since 2012. A more appropriate ground cover should be considered.

 Butler Soil & Water Conservation District 1. Maintain a 75 ft stream buffer easement, a geotechnical study is recommended for the area near Eden Silt Clay Loam soils (EcE2) which are slipprone (this area is near the northeast end of the property, along the retaining wall area), there are high water tables present in this area - if basements are constructed it is the responsibility of the developer to make sure they are dry.

 Liberty Township Fire Department 1. The Liberty Township Fire Department has meet with the developers to discuss their requirement earlier in the year. They discussed street widths, hydrant spacing, FDC placement, water sources and emergency vehicle access. At this time, LTFD does not have any issues the proposed development.

ACTION: The Board of Trustees shall approve, approve with conditions, or deny, of the proposed request for a Zoning Map Amendment from B-PUD to R-PUD and the Preliminary PUD Plan. If the request is approved, the conditions listed in the attached Draft Notice of Decision and Resolution should be considered.

WHEREAS, the Butler County Planning Commission conducted a public hearing for the proposed request on Tuesday, March 10, 2020 and made a motion to recommend approval of the Zoning Map Amendment to the Liberty Township Zoning Map as presented; and,

WHEREAS, the Liberty Township Zoning Commission opened the public hearing on Monday, April 20, 2020 and made a motion to continue the public hearing until May 18, 2020; and,

WHEREAS, the Liberty Township Zoning Commission continued the public hearing for the proposed request on Monday, May 18, 2020 and made a motion to recommend approval of the proposed Zoning Map Amendment to the Liberty Township Zoning Map as presented; and,

WHEREAS, a public hearing was conducted by the Liberty Township Board of Trustees on Tuesday, June 2, 2020 at 6:00 p.m. to review the proposed Zoning Map Amendment to the Liberty Township Zoning Map; and,

WHEREAS, all those present for the hearing who wished to be heard voiced their opinions with respect thereto; and,

WHEREAS, the Liberty Township Board of Trustees continued the meeting on June 2, 2020 and announced that the public hearing would resume on June 16, 2020 at 6:00pm; and,

WHEREAS, the public hearing was continued by the Liberty Township Board of Trustees on Tuesday, June 16, 2020 at 6:00pm to resume the public hearing for the proposed Zoning Map Amendment to the Liberty Township Zoning Map; and,

WHEREAS, said application was reviewed by the Board of Township Trustees and determined to be consistent with the Liberty Township Comprehensive Plan; now,

THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees do hereby [accept/overturn] the recommendation of the Liberty Township Zoning Commission and [approve/deny] the request for a Zoning Map Amendment from B-PUD (Business Planned Unit Development) to R-PUD (Residential Planned Unit Development District) and a preliminary PUD Plan, subject to the details listed in the staff report, all attached exhibits, and the following conditions:

1. The portion of the subject property that will remain B-PUD (Business Planned Unit Development) shall be governed by all prior Preliminary PUD Plans for Liberty Center. Since the Zoning Map Amendment alters the previously approved Preliminary PUD Plan for the B-PUD making it impractical to develop as previously approved, a new Preliminary PUD Plan shall be required for the B-PUD prior to any development. 2. An updated Traffic Impact Study shall be prepared and submitted to the Butler County Engineer’s Office for review and approval, which shall demonstrate that the anticipated traffic volumes are being accommodated. All Final PUD Plans shall illustrate all recommended/required improvements of the Traffic Impact Study. 3. An access easements shall be provided along the entire length of Street A, and Streets B and D shall be stubbed at the south property line (including sidewalks) south property line at the southwest corner of the site and in alignment with Street D to coordinate facilitate a future alternate access to Liberty Way and to Cincinnati Dayton Road. 4. Sidewalks shall be provided as they are illustrated on the approved Preliminary PUD Plan and as determined necessary on the future Final PUD Plan, which shall ensure good pedestrian access throughout the development, to Liberty Center and to the planned alternate route to Liberty Way and Cincinnati Dayton Road. Crosswalks shall be provided in all locations where a sidewalk crosses the street, including across Taylor Street. 5. The architectural design and building materials shall be approved with the Final PUD Plan of each phase, which shall be similar in nature to the submitted preliminary building elevations that illustrate a high quality design and the use of quality exterior building materials. 6. The interior finishes in all units shall be similar in nature to the submitted samples showing high quality materials such as granite countertops, stainless-steel appliances, modern faucets, pendent lighting and tile backsplashes in the Kitchens; and Granite countertops, tile flooring, rainfall showerheads and modern light fixtures and faucets in the Bathrooms. The details for the interior finishes shall be provided with the Final PUD Plan. 7. A detailed plan shall be provided with the Final PUD Plan for the clubhouse, pool and greenspace areas, which shall demonstrate quality amenities, programming and landscaping of a high-end apartment development that creates a modern and urban environment. 8. The clubhouse and its associated facilities shall be for the exclusive use of the residents of the R-PUD portion of the development. If the clubhouse is intended to be open to the apartments in the Liberty Center B-PUD, a Final PUD Plan shall be required to evaluate the parking availability and additional parking may be required. 9. All private roadways shall be approved with the Final PUD Plan for each phase, which shall be designed in accordance with the current BCEO standards with regard to materials and compaction for public streets. All roadways and parking lots shall utilize continuous curbs throughout. 10. All access drives, parking lots, building access, fire hydrant locations and other fire department concerns shall be addressed and reflected accordingly on the Final PUD Plans. 11. A detailed grading and drainage plan shall be provided with each Final PUD Plan, which shall demonstrate how the stormwater is being handled for the site according to the Butler County Stormwater Regulations. 12. A detailed landscape plan shall be provided with each Final PUD Plan, which shall illustrate extensive landscaping in the primary locations (entrances and highly visible locations). Street trees shall be provided at a rate of one (1) tree per 40 feet on center and trees located in the parking areas. Perimeter buffers shall be provided along the south and west property lines where it is adjacent to existing and planned commercial uses and not demonstrated how it will be integrated and transitioned accordingly. All trees shall be 1.5” caliper at the time of planting. All street trees shall be set back a minimum of 20’ from the intersections to preserve the appropriate sight distance. The required distance shall be measured from where the radius of the intersection begins. 13. All open space, street trees, landscaping, sidewalks and amenities shall be maintained regularly in good condition and free of debris.

EXECUTIVE SUMMARY

The site for the proposed Liberty Flats development consists of approximately 29.136 acres located north of Liberty Way and west of Taylor Street, in Liberty Township, Butler County, Ohio.

The proposed Liberty Flats development will consist of the following land use and density:

Liberty Flats Development

Land Use Density Multifamily Housing (Low-Rise) 356 Dwelling Units

Full build out of the proposed Liberty Flats development is estimated in 2021. The design horizon year for this study is 2041 (full build out + 20 years).

The roadways that will provide access to the site are Liberty Way and Taylor Street. Currently, Taylor Street serves the existing Liberty Center development, which is located to the east of the proposed Liberty Flats development. Direct access to the proposed Liberty Flats development is to be located along Taylor Street.

Provisions for future access to Liberty Way and Cincinnati-Dayton Road are provided through two (2) access easement located at the south property line.

Bayer Becker corresponded with representatives of the Butler County Engineer’s Office (BCEO) to establish the parameters of the study. As such, the following key intersection defines the study area of this report:

x Liberty Way and Taylor Street, an existing signalized intersection.

The site is immediately surrounded by residential and commercial land uses; however, medical and recreational land uses are also available within a one-mile radius.

Other developments within the study area include the Liberty Center, located to the east of the site and The Oaks at Wetherington development, located to the south beyond Liberty Way. Relative to the existing mixed-use Liberty Center development, it is understood that vacant commercial, office, retail,

The Oaks at Wetherington development is currently under construction and will also consist of a mixed-use development including residential, retail, office, and restaurant land uses. No roadway improvements are planned for the study area.

Based on the analysis contained in this report, there are no improvements recommended to accommodate 2021 and 2041 No-Build Traffic Projections (excluding site traffic). More specifically, the key intersection yielded a satisfactory level of service (LOS) “D” or better at all intersections during the AM and PM critical peak hour periods.

Similarly, based on the analysis contained in this report, there are no roadway improvements recommended to accommodate 2021 and 2041 Build Traffic Projections (including site traffic). Satisfactory LOS results are estimated for AM and PM peak hours.

Compliance with Applicable Codes Based upon engineering judgment and the analysis contained in this report, the proposed Liberty Flats development will not significantly impact operations on the adjacent roadway network.

RESOLUTION TO REQUEST LIBERTY TOWNSHIP’S SHARE OF FUNDS FROM THE BUTLER COUNTY CORONAVIRUS RELIEF DISTRIBUTION FUND

RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that

WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act, 116 Public Law 136, (the CARES Act) was signed into law by the President of the United States on March 27, 2020; and

WHEREAS, the Ohio General Assembly established a process for distributing funds provided by the “Coronavirus Aid, Relief, and Economic Security Act” in House Bill 481 of the 133rd General Assembly (HB 481); and

WHEREAS, HB 481 requires subdivisions receiving funds under Section 1 of the act, to pass a resolution affirming that funds from the County Coronavirus Relief Distribution Fund may be expended only to cover costs of the subdivision consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations before receiving said funds; and WHEREAS, Liberty Township is requesting its share of funds from the Butler County Coronavirus Relief Distribution Fund.

FURTHERMORE, in compliance with HB 481, be it resolved by the Board of Trustees of Liberty Township that Pam Quinlisk Township Fiscal Officer take all necessary action to: (1) On or before October 15, 2020, pay any unencumbered balance of money in the Liberty Township’s local coronavirus relief fund to the [County Name] County Treasurer; (2) On or before December 28, 2020, pay the balance of any money in the Liberty Township’s local coronavirus relief fund to the state treasury in the manner prescribed by the Director of the Ohio Office of Budget and Management; and (3) Provide any information related to any payments received under HB 481 to the Director of the Ohio Office of Budget and Management as requested.

THEREFORE BE IT RESOLVED the Board of Trustees of Liberty Township affirms that all funds received from the Butler County Coronavirus Relief Distribution Fund pursuant to HB 481 be expended only to cover costs of the Township consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations and guidance only to cover expenses that: (1) Are necessary expenditures incurred due to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19); (2) Were not accounted for in [Township Name] Township’s most recently approved budget as of March 27, 2020; and (3) Were incurred during the period that begins on March 1, 2020, and ends on December 30, 2020.
