Hospital as per the detailed Scope of Work given at Annexure-I for Two Years, which may be extended further Six month under special circumstances with mutual acceptance/consent on same terms and conditions.

All amendments by the client till 7 days before the bid submission date shall be binding on the bidders. About AIIMS Bhopal

AIIMS Bhopal is apex healthcare institutes being established under act of parliament by the Ministry of Health & Family Welfare, Government of India under the Pradhan Mantri Swasthya Suraksha Yojna (PMSSY) with aim of correcting regional imbalances in quality tertiary level healthcare in Central India and attaining self-sufficiency in graduate and postgraduate medical education and training in Medical Sciences.

The AIIMS Bhopal premises spread over 154 Acres of land in the Saket Nagar area of the Bhopal city. A 960 bed tertiary Health care Hospital, Medical College, Nursing College, Library, Hospital service building (presently 125 beds operational and soon it will be upgraded to 500 beds), AYUSH, Hostels and faculty and staff quarters constructed in the AIIMS Bhopal premises. It has been established on the lines of the original All India Institute of Medical Sciences in New Delhi which imparts both undergraduate and postgraduate medical education in all its branches and related fields, along with nursing and paramedical training of personnel in all branches of health care sciences.

Scope of Work

The detailed scope of work for Patient Diet and Cafeteria Services required at AIIMS Bhopal is given in the Annexure-I Schedule of Requirement. All interested eligible Agencies/firms/food chains/caterers are requested for careful study it before filling e-tender enquiry for flawless bidding.

Two Bid System Terms & Conditions

 Validity of E-Tender & Period for Rate Contract: The validity of the e-Bid shall be for 180 days after opening the e-bids. The rates shall be valid for two years from the date of acceptance and Notification of award/conclusion of Contract Agreement in the Format given at Annexure-X. It may be extended further for Six Month with mutual consent and willingness same terms and conditions.

 EMD (Refundable after expiry of the e-Tender validity) AS PER SCHEDULE ON E- PROCUREMENT solutions PORTAL  No interest shall be payable on the Earnest Money Deposit to any participant in bidding.

All rows & columns on prescribed format should be filled and not left blank, may be struck as not applicable. Each document should be serially numbered and duly signed by the bidder with the rubber stamp of the firm on each page before uploading the documents on e-bid portal. The e-bid shall be submitted in 2 (Two) parts online:

(i) Techno-Commercial Bid: Techno-Commercial Bid Documents shall be opened first. The bid shall be evaluated as per Eligibility Criteria and evaluation method mentioned in the bid document.

Hospitals/reputed Government Institutions/PSU’s/Other reputed Institutions in India, where the Agency provided Patients’s diet and cafeteria services last Five Years in Chronological Order from FY-2011-2012 to FY-2015-2016 mentioning the amount of the annual cost of the order. X. Signed and scanned copy of List of Kitchen Equipment/Cutlery/Utensils required for AIIMS Bhopal Patient’s Diet (for at least 500 IPD Patients) and Cafeteria Services (expected at least 1000 Visitors per day) to be placed at AIIMS Bhopal by them. The AIIMS Bhopal Hospital will only provide space, water connection, electricity connection and cafeteria furniture. XI. Signed & scanned copy of the authority letter in the name who signing and submitting the e-bid document on behalf of proprietor / owner in case the owner/proprietor is not signing the e-Tender document. The Financial Bids must be submitted in the prescribed format in the e-Tender Module online in Annexure-VI (A) for Patient Diet Services and Annexure-VI(B) for etable items to be sold in Hospital Cafeteria. Rates:- a) Paitent Diet Services:- Contractor needed to be quote their rates for providing Patient Diet Services. The diet rate should be inclusive of all State/Central/Local Government taxes, Labour Cess, Duties, Statutory expenses and other expenses (i.e. Service tax if applicable). b) Cafeteria Services:- Rent, Electricity and Water Charges should be deposited by the Contractor to AIIMS Bhopal. c) i) Service Tax Claim and Deposition Liability:- For the Patient Diet Kitchen Services, the Contractor is liable to pay applicable Service Tax to concern Department on demand and it will be reimbursed to him after satisfying that it has been actually and genuinely paid by the Contractor. The Contractor will submit the Service Tax Claim along with monthly Bills. In case of Cafeteria Services vendor will be responsible for all statutory financial liabilities, AIIMS Bhopal will not reimburse any taxes etc.

Method of Bid Evaluations

I. Method for Pre-Qualification/Techno-Commercial Bid Evaluation: A. Pre-Qualification Bid /Techno-Commercial Bid Evaluation shall be done on the scale of 100 points with the following details for marking process for suitability. The matrix for evaluation of Pre-Qualification and Techno-Commercial Bids on the scale of 100 marks shall be as follows:- Techno-Commercial Bid Evaluation will carry out under 100 points scale as below:- a) Turnover of the Bidding agency: 20 marks b) Availability of Trained & Qualified Human Resource: 20 marks c) Past five years Performance on providing Patient Diet Services: 20 marks d) Managerial capability: 20 marks e) Observance of applicable laws including Food safety & standards regulation Act 2006 & Labour laws : 20 marks Notes:- a). Turnover of the Bidding Agency (Total 20 Marks) i) The turnover or part thereof relating to similar nature Patient Diet Services/Dietary Services/Cafeteria Services in any Govt. Hospital/PSU’s/Institutions/Reputed Private Hospitals etc. The marks be awarded on scale of 5 on each completed Work Order/Contract Agreement details basis (4x5=20 Marks). For Qualify for next Stage bidder should at least 15 marks in this Criteria. b). Availability of Qualified Human Resource (Total 20 Marks) i) Available strength of staff with Firm ( 10 Marks) ii) Capacity of hire staff in time allowed for commissioning of service (5 Marks); iii) Comparative assessment of skills of contract workers to be deployed (5 Marks). For Qualify for next Stage bidder should at least 15 marks in this Criteria c). Past Performance (20 Marks) i) If bidder has rendered similar service at least 4 Institutions in past Five FYs (2x4=8 Marks);

ii) If previous output of the bidder was found satisfactory on quality parameters in respect of service provided by him based on the performance report submitted by him (2x4=8 Marks); iii) If the previous work of the bidder has been appreciated or criticized by the previous Institution, where the Service Provided similar nature services in past Five FYs ( 1x4=4 Marks) For Qualify for next Stage bidder should get at least 10 marks in this Criteria. d). Managerial Capability of the Participating Firm ( 20 Marks) i) The nature of organization such as proprietorship, partnership, society or Company (6 Marks) ; ii) The number of supervisory staff available or proposed to be hired ( 6 Marks); iii) If the contract is awarded:- a) Manner and mode by which Labour productivity is proposed to be improved (4 Marks); (b) Presentations /Assurances in regard to time within which complaints of poor or indifferent services shall be attended (4 marks). For Qualify for next Stage bidder should get at least 10 marks in this Criteria. e). Observance of Labour Laws (20 Marks) i) If previous output of the bidder was found satisfactory on quality parameters in respect of the service under consideration (4 Marks); ii) Issuance of Standing order covering among other things working hours, uniform allowance, weekly offs, maternity benefits given by them to their Employees on previous similar nature works handled by the Participating firm ( 4 Marks); iii) Valid EPF Registration and Provident Fund Contribution deposited in respective EPFO in respect of their Employees on previous similar nature works handled by the Participating firm (4 Marks); iv) Valid ESIC Registration for ESIC contribution deposited in respective ESIC Office in respect of their Employees on previous similar nature works handled by the Participating firm ( 4 marks); v) Payment of Bonus as per prevailing Labour Law Act and paying Employee’s salaries on Bank Accounts of engaged workforce on or before 7th of Each of month (4 marks); For Qualify for next Stage bidder should get at least 10 marks in this Criteria.

B. All bidders are required to prepare their Technical Presentations (if required) in accordance with the above mentioned Evaluation parameters. The duration of the presentation shall be 15 minutes as per the following a) Technical Presentation by the agency. b) Display of one DCDP [Demi Chef de Partie (chef)], Captain and Steward in their uniform. c) Question and answers by the Committee. The bidder scoring 60 or more points out of 100 shall qualify and be considered as technical responsive. The decision of the Technical Evaluation committee shall be final and no representation in this regard shall be accepted. The price bids of only technically responsive bid shall be opened. The responsive Bidder are advised to be present at the time of price bid opening (time, date and venue will be informed to responsive Bidder). Note: The Bidders are advised to provide authentic and relevant information in bid (eligibility and technical) as well as during technical presentation to enable the evaluation committee to make proper judgment and for better assessment. For this purpose, they are advised to visit at AIIMS Bhopal for assessment on any working day from 11:00 Hrs. to 15:00 Hrs at least one week prior to stipulated bid submission date. Inabilities to provide information required or satisfactorily prove the statements or veracity of claims would go against the Bidder. No claim made subsequently shall be accepted or entertained by AIIMS Bhopal. II. Method of Evaluation of Financial Bid:- A. The Financial Bid shall be evaluated based on following criteria: a. The Financial bid is to be quoted strictly as per the format given in ANNEXURE-VI(A) amd ANNEXURE-VI(B) online in Financial Bid Slot of E-Tender solution portal of AIIMS Bhopal. b. If financial bid is not quoted as per the given format in ANNEXURE-VI (A) for Patient Diet Kitchen Services and ANNEXURE-VI(B) Price Quote for items to be sold in the Cafeteria online, the bid is liable to be rejected or the evaluation committee may make its own judgment regarding the total monthly cost of the price bid quoted by the bidder. B. Financial Bids Evaluation: - For the scoring of Price (Financial) bids formula LEC/EC, where LEC stands for “Lowest Evaluated Cost” and EC stands for “Evaluated Cost” shall be applied.

The Angency’s who’s quoted rates for maximum number of Diet Orders will found L-1 will be asked for match the L-1 Rates of rest of Diets Orders/Items for which his quote are not found L-1, so that the overall contract for providing Patient Diet Services to be awarded to Single Agency on Overall L-1 Rates which expected to be obtained through this open Tender enquiry.

The AIIMS Bhopal will also award AIIMS Bhopal Hospital Cafeteria on overall L-1 rates quoted for etable items, here also the Agency is liable to match L-1 prices quoted by other participating Bidders. Both services shall be awarded to only one vender. The Engaged Agency is liable to run both services as per the Terms and Conditions mentioned in this Tender Enquiry Document.

Understanding of Terms & Conditions: It shall be presumed that the terms & conditions mentioned in the e-Tender document including amendments/corrigendum if any have been read understood and duly accepted entirely by the bidder. 2. Non-Transferability of this e-Tender/Work Contract: E-Tender forms and Work Contract are not transferable in any circumstances during entire validity period of E-Tender/Work Contract. The Successful Bidder/Agency shall not engage any sub-contractor or sublet/transfer the contract to any other agency/person in any manner.

3. Validity Period of Tenderers and Contract 3.1 Bid Validity: The E-Tender shall be valid for a period of 180 days from the date of its Techno- Commercial Bid Opening and may be further be extended if AIIMS Bhopal requested in writing for to do the same and the Tenderer is willing to extend the same on the same rates mentioned in his bid for further period if any.

3.2 Period of Contract : The initial period of Two Years, which is extendable for further period of Six Months with mutual consent and willingness on same terms and conditions.

4. Earnest Money Deposit of Rs. 50,000/- (Fifty Thousand):-

4.1 The Tenderer shall deposit the amounts indicated as above in the E-Tender Notice as Earnest Money Deposit (EMD). The Earnest Money shall be deposited in the form of FDR/Demand Draft/Bank Guarantee (if bidder interested to submit EMD in the form of BG, it must be submitted in the Format given at Annexure-VIII) in favour of “Director, AIIMS Bhopal” accompany with Techno-Commercial Bid Document. The failure or omission to deposit the Earnest Money Deposit shall disqualify the E-Tender and the AIIMS Bhopal shall exclude from its consideration such disqualified E-Tender(s). No interest shall be payable by the AIIMS Bhopal in respect of such deposited Earnest Money.

4.2 If AIIMS Bhopal accepts the e-Tender, the Earnest Money shall be appropriated towards Security Deposit payable by the Tenderer in accordance with the Conditions of Contract. Alternatively on payment of the required amount of the Performance Security, the Earnest Money shall be returned to the Tenderer.

5. Forfeiture of EMD:-

5.1 The Tenderer shall not revoke his E-Tender or vary its Terms and Conditions without the consent of the AIIMS Bhopal during the validity period of E-Tender, failing which the Earnest Money deposited by it in total shall be stand forfeited by the AIIMS without prejudice to its other rights and remedies and the Tenderer shall be blacklisted to submit a E-Tender to the AIIMS for execution of any work during the next twenty-four (24) months effective from the date of such revocation.

5.2 If the successful Tenderer does not pay the Performance Security Deposit in the prescribed time limit or fails to sign the Contract Agreement, the Earnest Money Deposited of him will be in total forfeited by the AIIMS Bhopal.

6. Refund of Earnest Money

The Earnest Money in case of all the unsuccessful Tenderers shall be refunded after the issuing of Notification of Award to successful Tenderer. The EMD in case of successful Tenderer will be released after receipt of Performance Security Deposit.

7. PERFORMANCE SECURITY DEPOSIT (for 33 Months):- The successful Bidder will liable to deposit 10% of the annual estimated value of the Contract (i.e. Rs. 2,50,000/- Two Lakh Fifty Thousand only) one time as Performance Security Deposit in favour of “Director, AIIMS Bhopal” by way of Fixed Demand Receipt/Demand Draft/Performance Bank Guarantee in the format given at “Annexure-IX” drawn from any nationalized/Commercial Bank refundable after expiry of the e-Tenders/or after the completion of 30 Monts period + 3 months (valid for i.e. 33 months). No Interest shall be paid by AIIMS Bhopal on deposited Performance Security to any successful Service provider. No dues certificate from the concerned departments/authorities. Performance Security Deposit/EMD is liable to be forfeited if the bidder withdraws or impairs or derogates the bid in any respect. 8. Cost of E-Tender preparation, Registration on E-Tendering portal and Submission:-

The Tenderer shall bear all costs associated with the preparation of E-Tender Document, Registration on E-Tendering Portal of AIIMS Bhopal and submission of its E-Tender. The AIIMS shall in no case be responsible or liable for these costs, regardless of the conduct or the outcome of the E-Tendering Process.

9. Eligible Tenderer Only those Tenderer who fulfill the eligibility criteria having sufficient experience for handling Patient Diet Kitchen and Cafeteria Services as mentioned in E-Tender Document are eligible to submit their E-Tenders for this work. The documents indicated against each of the eligibility criteria shall be required to be submitted along with the Techno- Commercial Bid to establish the eligibility of the Tenderer. However all criteria mentioned in the Eligibility Criteria of the E-Tender Document over-rides all other criterions.

10. Relationship with Official(s) The Tenderer shall not be associated presently or in the past with any of the office bearers of AIIMS, either directly or indirectly. The Tenderer shall furnish self declaration on his letter head for the same. If any information so furnished shall be found to be untrue or

false, the Tenderer shall be liable to be disqualified and the Earnest Money accompanying such E-Tender shall stand forfeited to the AIIMS. If the Information so furnished shall be found to be untrue or false during the currency of the contract, the Tenderer shall be held to be in default and the Contract if any awarded to it shall be liable to be terminated with its consequences.

11. Inspection of Patient Diet Kitchen/Cafeteria Site and Sufficiency of E-Tender The Tenderer is expected to work out their own rates based on the detailed description of Patient Diet Kitchen and Cafeteria works, required kitchen utensils, Raw items, Qualified and Trained Manpower assessment, requested specifications and conditions, Statutory Taxes, Labour Laws compliances, Licenses and finally arrive at the cost of the Patient Diet Kitchen and Cafeteria Services. The Tenderer shall be deemed to have satisfied itself before e-Tendering as to correctness and sufficiency of its E-Tender. The rates and prices quoted shall, except as otherwise provided, cover all its obligations under the contract and all matters and things necessary for proper completion and maintenance of the Patient Diet Kitchen and Cafeteria Services. Where necessary, before submitting its Commercial Bid the Tenderer should inspect and examine the AIIMS Bhopal Hospital, Saket Nagar, Bhopal-462020 (MP) site and shall satisfy itself about present IPD patient load in functional wards and OPD Patient, Staff and Visitors Load to presently operated Cafeteria cum Canteen, the quantities and nature of the Patient Diet Kitchen and Cafeteria Work/Service and materials/equipments/utensils/resources necessary for the completion of the Works/Services, means of access to the site, the accommodation it may require, and in general, obtain all necessary information as to risk, contingencies and other circumstances which may influence or affect its E-Tender. No extra charges consequent on any misunderstanding or otherwise shall be allowed.

12. Place of Submission of E-Tender The Complete E-Tenders in the manner specified under the Two bid System (i.e. Techno- Commercial Bid and Financial Bid in prescribed formats) needs to be submitted online in the E-Tendering portal of AIIMS Bhopal (i.e. http://www.e- Tenderwizard.com/AIIMSBHOPAL) and the only requested hard copies of Techno- Commercial Bid Documents in sealed Envelope clearly superscripted E-Tender ID and addressed to “The Director, AIIMS Bhopal, Saket Nagar, Bhopal-462020 (MP) India and the Name of Tenderer with contact details in lower left corner of the Envelope must be dropped in the E-Tender Box kept in the Office of Medical Superintendent, AIIMS Bhopal Hospital, Saket Nagar, Bhopal-462020 (MP) by in person before the closing date of submission as given in the e-Tendering portal against this e-Tender ID.

13. Last Date for Submission 13.1 Sealed E-Tenders shall be dropped in the E-Tender Box kept at the address specified above not later than the time and date specified in the E-Tender Notice in the Schedule of E-Tender displayed in the E-Tendering Portal of AIIMS Bhopal. In the event that the specified date for the submission of E-Tender is declared a holiday, the E-Tenders will be dropped in the E-Tender Box kept in the Office of Medical Superintendent, AIIMS Bhopal Hospital, Saket Nagar-462020 (MP) up to the appointed time on the next working

day. On line submission of Bids is needed to be done within the stipulated date and time in the E-Tendering portal.

13.2 The AIIMS Bhopal may, at its discretion, extend this deadline for submission of E-Tenders by amending the E-Tender Documents/uploading the Pre-Bid Meeting Clarification, in which case all rights and obligations of the AIIMS Bhopal and Tenderer will thereafter are subject to the deadline as extended.

13.3 Any E-Tender received by the AIIMS Bhopal after the deadline for submission of E-Tender prescribed by the AIIMS Bhopal, pursuant to the clause above, will be rejected and /or returned unopened to the Tenderer.

14. Modifications and Withdrawal of Offers The Tenderer may modify or withdraw its E-Tender after its submission, provided that a written notice of modification or withdrawal is received by the AIIMS Bhopal prior to the closing date and time prescribed for submission of E-Tender. No E-Tender can be modified by the Tenderer, subsequent to the closing date and time for submission of E- Tender.

15. Process to be Confidential: Information relating to the examination, clarification, evaluation and comparison of E- Tenders and the award of a Contract shall not be disclosed to Tenderers or any other person not officially concerned with such process until the award to the successful Tenderer has been announced.

16. Preliminary Scrutiny: The AIIMS Bhopal will scrutinize the E-Tender to determine whether they are complete, whether any errors have been made, whether required technical documentation have been furnished, whether the documents have been properly signed, and whether the E-Tenders are generally in order. The AIIMS Bhopal will also determine the substantial responsiveness of the E-Tender. For purpose of these clauses, a substantially responsive E-Tender is one that confirms to all the terms and conditions of the E-Tender Documents without material deviations. The AIIMS’s Bhopal determination of a E- Tender’s responsiveness is to be based on the contents of the E-Tender itself without recourse to extrinsic evidence.

A E-Tender determined as not substantially responsive will be rejected by the AIIMS Bho pal and may not subsequently be made responsive by the Tenderer by correction of the non-conformity. The AIIMS Bhopal may waive any minor infirmity or irregularity in a E-Tender which does not constitute a material deviation. This shall be binding on all Tenderers and the AIIMS Bhopal reserves the right of such waivers.

17. Method of Bid Evaluation: Method of Bid Evaluations given in detail just after NIT above.

18. Clarification of Offers: To assist in the scrutiny, evaluation and comparison of E-Tenders, the AIIMS Bhopal may, at its discretion, ask some or all Tenderer for technical clarification of their E-Tender. The

request for such clarifications and the response shall be in writing. To speed up the E- Tender process, the AIIMS Bhopal, at its discretion, may ask for any technical clarification to be submitted by means of email by the Tenderer. In such cases, original copy of the document describing the technical clarifications must be sent to the AIIMS Bhopal by means of courier/in person/ if required AIIMS Bhopal officials may visit the location for which completion certificate enclosed by firm for fulfilling the requisite criteria to cross check.

19. Rejection of Bid on account of False/Wrong information: Furnishing of wrong information and false documents will make the Bidder ineligible for bidding and liable to be debarred/blacklisted from participation in E-Tender enquiries/Open E- Tenders/Conventional Tenders/Annual Rate Contracts by the client and /or other Government’s hospitals/departments.

20. The past performance of the bidder and other criteria as given in the Eligibility Criteria will be taken into consideration for award of Contract.

21. The Bidder will have to furnish documents in support of the information submitted by him in the e-Tender. Original documents shall be checked for verification as and when required.

22. In case of any attempt for cartelization by Bidder with a view to hike up the prices, all bids will be rejected and the Contractor will be blacklisted and bid security EMD will be forfeited.

23. If any required information /documents are not submitted, then the bid of the concerned Bidder will be rejected and shall not be considered. No representation in this regard will be entertained in latter stage.

24. The Bidders are expected to be present at the time of online opening of e-Tenders; however, the bids will be processed even when no Bidder/representative is present as per declared schedule.

25. The decision of the Director AIIMS Bhopal regarding approval of bids shall be final and binding on all Bidders.

26. A prospective Bidder requiring any clarification of the Bidding Document shall attend the pre-bid meeting on date and time scheduled on e-Tender portal in the office of the Medical Superintendent.

27. No further correspondence shall be entertained after opening of the E-Tenders.

28. Any person who is in Govt. Service anywhere or an employee of the institute should not be

made a partner to the contract by bidder directly or indirectly in any manner whatsoever.

29. The individual signing the e-Tender document/bids or any document forming part of the bid on behalf of bidder, shall be responsible to produce a proper power of attorney duly executive in his favour stating that he/she has authority to bind other such person of the bidding agency as the case may be in all matters pertaining to the contract including the arbitration clauses. In case the bidder, so signing, fails to provide the said power of attorney the client may, without prejudice to other civil and criminal remedies cancel the bid and hold the signatory liable to all cost and damages. In case of registered or unregistered partnership firm, all the partners should sign the bids. In case of change of any person signing the agreement on behalf of limited company or firm, he/she will produce a letter of authority /resolution passed by the company empowering him/her to sign the agreement on behalf of the Bidder /company or firm.

30. The personnel, whose services are provided by the bidder, shall at least all times and for all purposes be the employees of the Bidding Agency and on no account personnel so appointed and recruited by the Bidding Agency will have any claim for appointment, continuous recruitment or regularization etc. against the client.

31. In every case in which by virtue of the Workman’s Compensation Act, the client if obliged to pay compensation to such person employed by the bidding agency in execution of the work, the Government of India/Client will be entitled to recover from Bidding Agency the amount of compensation so paid.

32. The successful Agency will execute the Contract Agreement on Non-Judicial Stamp Paper worth of Rs. 100/- and commence the work at Client site on or before Thirty (30) days’ time on issuing of Notification of Award at AIIMS Bhopal Hospital in the specified location of Patient Diet Kitchen and Cafeteria.

33. The bidding agency shall be responsible for verifying the antecedents of its staff/employees working in AIIMS Bhopal, by police verification and will keep attendance and other relevant records at its cost and will produce these on demand of any authority. The list containing the names/addresses of the personnel appointed by the bidder/agency shall be made available to the Client with their bio-data within 15 days from the date of deputing. The same shall also be provided in the form of CD giving out photographs and detail of the staff within one month of commencement of work at AIIMS Bhopal premises.

34. The Successful Bidder/Agency shall have a license under Contract Labour (R&A) Act, 1970 and also submit a copy of such license with bidding documents. The Successful Bidder/Agency shall abide by all the necessary provisions of various other Labour

Laws/Acts viz. ESI/Bonus, Workmen’s Compensation and any other laws and rules applicable in this regard.

35. The Successful Bidder/Agency shall have license under Food Safety and Standard Regulation Act 2006 and submit a copy of such license with bid. The Successful Bidder/Agency shall abide by all the necessary provisions of various other requirement of this act.

36. The Successful Bidder/Agency, himself, shall be responsible for any type of statutory/ mandatory claims or penalties in light of the default with reference to the above provisions.

37. The Successful Bidder/Agency shall procure all raw material & consumables that will include all perishable, Liquid Petrolium Gas(LPG), dairy, consumables that include cleaning agents, chemicals and consumables etc to run the F& B Operations and submit the bills for the reimbursement to the client on monthly basis. The approval of authorized representative of the client shall be obtained before placing the purchase order. The client shall have the discretion regarding the quality and quantity of the stores. The proper record of such stores shall be maintained by the store keeper of the Successful Bidder/Agency. The client can carry out surprise checks of the stores without any prior intimation. The Successful Bidder/Agency shall be required to raise tax invoice, wherever applicable, to seek the reimbursement of expenditure made on procurement of the raw material and consumable from the Institute. The Successful Bidder/Agency would also be required to provide copies of the rate contract for verification of the rates which could be charged on Cost + procurement management fee basis.

38. Arrangement of LPG Cooking Gas Cylinders& compliance of Fire Safety Rules. (a) The Caterer shall be required to make himself necessary arrangement for cooking and keep LPG Gas refills in sufficient quantity for cooking purposes on his own cost as per the prevailing Rules and Regulation of LPG Gas Agencies.

(b) The Caterer shall be responsible for any loss/theft of the LPG Gas Cylinders and other Equipment provided to him by the Institute or he him self arranged in the premises of AIIMS Bhopal.

(c) The Caterer is liable for compliance of norms of Gas Cylinder Rules, 2004 under Explosives Act 1884 (4 of 1884) for commercial activities.

39. Payment shall be reimbursed on submission of monthly payment claim against Number of Patient Diet provided during the month with all the supportive documents basis within One month (30) days/considerable time from the date of receipt of bill duly certified &

recommended by designated officer in charge.

40. In case of delay in release of monthly payment Bill of the agency should ensure timely submission of the required documents to the client for early release of payments and in the meantime make payments to its engaged manpower & consumable without affecting the work.

41. In case any person engaged by the contractor is found to be inefficient, quarrelsome, infirm, and invalid or found indulging in unlawful or union activities, the bidder/agency will have to replace such person with a suitable substitute at the direction of the competent authority at short notice.

42. The AIIMS Bhopal will not provide any sort of accommodation to the staff or person deployed by the Successful Bidder/Agency and no lodging will be allowed in the premises of the Client at any time.

43. The AIIMS Bhopal shall not provide the free food to the staff or person deployed by the Successful Bidder/Agency. Provision for providing meals to the staff deployed on duty, their charges and payment mode would be discussed and finalized at the time of entering into Contract Agreement with the successful bidder/Agency.

44. Every Patient Diet kitchen/Cafeteria staff shall wear the prescribed neat and clean uniform according to season affixing thereon the badge mentioning on the same, his name and designation of the worker provided by the Successful Bidder/Agency at his own cost.

45. The Successful Bidder/Agency shall not engage the staff below the age of 18 years. All the staff deployed by the Successful Bidder/Agency shall be medically fit and their antecedent be verified prior to the deployment in the Institute.

46. Smoking cigarette, bidi, chewing, pan, Gutkha etc. is strictly prohibited inside the Institute’s premises. Non-Compliance may lead to suitable penalty /termination of contract.

47. If any complaint of misbehavior and misconduct comes into the knowledge of the Client then all such responsibility shall be of the Successful Bidder/Agency and any loss owing to negligence or mishandling by the staff, the Successful Bidder/Agency shall himself be responsible to make good for the losses so suffered by the institute.

48. In any case notwithstanding anything contrary contained in any of the provisions of the Contract Agreement, the liability of the either party against any risk other than bodily injury and statutory non-compliances shall not exceed total amount invoiced by the

agency/bidder during the preceding financial year i.e. April to March or Rs. 10 million whichever is less per occurrence.

49. The Successful Bidder/Agency shall not, at any stage, cause or permit any sort of nuisance in the premises of Client or do anything which may cause unnecessary disturbance or inconvenience to others working there as well as to the general public in the client premises and near to it.

50. The Successful Bidder/Agency shall, for providing kitchen & cafeteria services, ensure the following: -

50.1 That a daily report for provided Patient Diets in various wards as per the Diet Order communicated by Ward Nursing Incharge/Dietecian of AIIMS Bhopal properly recorded & all record shall be maintained properly.

50.2 That its staff does not smoke/drink/abuse drugs at the place of work.

50.3 That any specific work related to Patient Diet Kitchen and cafeteria assigned to it by the Client or any officer authorized by him is carried out by him diligently and well in time.

50.4 The vendor may also furnish that the salary wages shall be distributed in full as per Minimum Wages Act by the Successful Bidder/Agency to the deployed staff preferably before 7th of each month on their Bank Accounts.

51. Tax deduction at source shall be governed by the prevailing rules.

52. The Client (AIIMS Bhopal) reserves the right to:

52.1 Amend the scope and value of any of contract (i.e. Patient Diet Kitchen or Cafeteria Services ) under this Work Contract.

52.2 Reject or accept any application without assigning any reasons thereof and

52.3 Reject all applications and cancel the e-Tender.

52.4 The Client/Employer/ Consultant shall neither be liable for any such actions nor be under any obligation to inform the Applicants.

53. PENALTY CLAUSES 1) In case the agency fails to commence / execute the work within prescribed period in the agreement or fail to deposit the performance security will invite forfeiture of the EMD. Client reserves the right to impose the penalty as detailed below for violation of contract terms and conditions on each occasion:

a) First instance the penalty should be @5% of cost value of concerned monthly payment claim, b) Second instance, Client reserve the right to cancel the contract and withhold the agreement and forfeit the Performance Security Deposit/EMD as applicable and job shall be get done from L2 vendor at the cost of the Agency. The defaulting Bidder/Agency will be blacklisted for next five years. c) The amount payable for the preceding month can be partially/ fully deducted depending on the severity of default in case of non-compliance with work stipulations, post the commencement of Patient Diet & Cafeteria Services Contract. 2) the designated committee or Authority or any person nominated by or on behalf of the Client will able to impose a penalty up to Rs. 1000/- on the first occasion upon the agency in the event of breach, violation or contravention of any of the terms and conditions contained herein brought to the notice of the Client. If the lapse is repeated again the extent of penalty will be doubled on each such occasion. The decision of the said officer/committee in this regard shall be final and binding upon the agency. Some of the instances in which penalty would be imposed are enumerated below. (But these are not exhaustive and penalty may be imposed on any violation/breach or contravention of any of the terms and conditions as well as assigned duties and responsibilities). a) If the personnel working in kitchen (i.e. Patient Diet Kitchen and Cafeteria) are not found in proper uniform and displaying their photo identity card. b) If the personnel found indulging in smoking/drinking/sleeping during duty hours. c) Penalty will also be imposed if the behavior of personnel(s) found is discourteous to anyone in the hospital including staff or patients. d) If any personal found performing duty by submitting a fake name and address, the services of such person shall be terminated and the agency will be held responsible for such lapse. e) If any personnel found on duty other than those mentioned in the approved list is supplied by the agencies to the hospital authorities. f) In the case of any loss/theft of AIIMS BHOPAL property or any patient property, the committee will consider the circumstances leading to the loss and if the responsibility is fixed on the agency, the Institute will make good the losses by deducting the cost of loss from the security deposit/or next month’s bill in one or more installments.

3) In case of any foreign substance like hair, insect, worm, stones etc. are found in patient meal, the contractor shall be penalized with a penalty of Rs. 1000/- for 1st such case, Rs. 2500/- in case of 2nd instance and if it occurs more than 2 times than a deduction of Rs. 5000/- in multiple of number of such complaints would be imposed in the respective month’s bill.

54. CONTRACT TENURE (EXTENSION): i) The contract will be valid for TWO YEARS from the date of engagement of the agency subject to annual review of the performance of the Agency by the Client on same terms and conditions on mutual agreement basis. It shall be the discretion of the client for extension of contract for further Six Month subject to satisfactory performance of the agency. ii) After the completion of the assigned responsibilities across the tenure of the contract, Client, at his sole discretion and mutual consent, may extend the contract maximum for Six Months subject to satisfactory personal quality certification by Designate Inspection Committee or Authority or any person nominated by or on behalf of the Client to assess the performance of the agency. iii) In exceptionally deserving case Client, at his sole discretion and mutual consent, may consider further extension of the period of contact for which independent assessment of performance could be sought. iv) Client will decide the commencement of the service which will be duly notified at the time of Award of E-Tender.

55. Payment Terms:- 1. The payment to the service provider shall be made as per actual Diets supplied by him during the month on his accepted price and not exceed quoted price (supported by wages paid to workers through ECS / their ESIC and EPF/Service Tax Deposit challan/statement). The deployment of manpower may require to be workout as per the current load of Patient Diet Kitchen Service and Cafeteria Services requirement, which may vary as per need basis and would be assessed on dynamic basis. Monthly assessment and review for deployment of manpower to handle services efficiently is needed to be done by Contractor along with the Nodal Officer of Patient Diet Kitchne Services of AIIMS Bhopal Hospital.

2. The service provider shall raise bill by the first week of next month (i.e. after completion of each month). The payment shall be made preferably within Thirty (30) days of submission of bill. Disputed amount or amount on which clarification is required may be held up till the time matter is sorted out. However, rest amount shall be released by due date to avoid the sustanibility of services in larger patient. 3. Bill along with all supportive documents should be submitted to the Administration branch before 5:00pm otherwise bill will be deemed to be submitted on the next working day. 4. Payment from Client shall be made by electronic fund transfer to the supplier’s account by NEFT or RTGS for which purpose agency is expected to submit their complete bank details. 5. Penalty would be in terms of part of negligence, which would be deducted and reflected in month’s payment. 6. Along with payment claim for providing Patient Diet Services, the details of Payment paid to the deployed manpower must be submitted with following documents for further processing of the bill: a. ECS Statement duly verified by Bank Officer of concerned branch of Bank where the Agency having the Bank Account for monthly salary disbursement in the bank account of employees on or before 07th of every month by the service provider (as a proof of compliance to ensure that monthly salary paid is not less than the statutory provision of minimum wages act as applicable in Bhopal Madhya Pradesh for the respective category of worker, and as being charged from Client, the employee shall be paid at least the quoted). Client may approve acceptance of other equivalent documents if judged adequate to confirm compliance in lieu of ECS statement for salary payment on recommendation of the management committee. b. Monthly Statement of ESIC deposit done against the work force deployed c. Monthly Statement of EPF deposit done against the work force deployed d. Bonus payment to be reimbursed (as per actual subject to maximum as quoted in the price bid format) after submission of proof of credit in the bank account of employee 10. The payment to the contractor shall be released only verification of the contracted service through a checking mechanism enforced by Designate Inspection Committee or Authority or any person nominated by or on behalf of the Client (i.e. AIIMS Bhopal) to assess the performance of the agency, both in terms of quantity and quality.

56. ARBITRATION AND LAW: 1. All disputes and differences arising out of, or in any way, concerning this agreement (except those, the decision whereof is otherwise, hereinbefore provided for) shall be referred for sole arbitration by any person to be nominated by the Director, AIIMS Bhopal. The venue of Arbitration shall be Bhopal (MP), India. The award of the arbitrator so appointed shall be final and binding on both the parties and judgment may be entered thereon, upon the application of either party, by any court having jurisdiction. 2. Indian laws shall govern this contract. 3. The existence of any dispute(s) or difference(s) or the initiation or continuance of the arbitration proceedings shall not permit the Parties to postpone or delay the performance by the parties of their respective obligations pursuant to this Contract. The venue of the arbitration shall be Bhopal (MP) , India. 4. As & when the performance of the contractor is found to be unsatisfactory, the contractor would need to approach independent assessor for adjudication. Failure to improve the performance to the satisfaction of the department and decision of independent assessor shall be considered as a valid cause for termination of contact. The nomination of Independent Assessor will be mutually decided by the Contractor and the Client, in case of any dispute, the decision of the Director, AIIMS BHOPAL shall be final and binding on both Contractor and Client.

57. FORCE MAJEURE: i. “Force Majeure” shall mean any event beyond the reasonable control of the Client or the Bidder/Agency, as the case may be, and which is unavoidable notwithstanding the reasonable care of the party affected. ii. If either party is prevented, hindered or delayed from or in performing any of its obligations under the Contract by an event of Force Majeure, then it shall notify the other in writing of the occurrence of such event and the circumstances thereof within fourteen (14) days after the occurrence of such event. iii. No delay or nonperformance by either party hereto caused by the occurrence of any event of Force Majeure shall a. constitute a default or breach of the Contract

b. give rise to any claim for damages or additional cost or expense occasioned thereby c. If and to the extent that such delay or nonperformance is caused by the occurrence of an event of Force Majeure. iv. Notwithstanding clause (iii) above, Force Majeure shall not apply to any obligation of the Client to make payments to the Agency herein.

58. Risk Purchase:- In the event of the Agency’s failure to provide ordered services as per the contract the client reserves the right to procure the services from any other source at the Bidder’s risk and the cost and the difference in cost shall be borne by the bidder. Further, the purchaser shall retain the right of forfeiture of Performance Security and or any other action(s) as deemed fit.

59. Fall Clause:- If at any time during the contract period, the contractor/bidder reduces the rates for such outsourcing of services as are covered under this e-Tender enquiry, to any organization (including any hospital/department of at rate lower than the rates quoted under this contract, he shall forthwith reduce the rates payable under this e-Tender for such services after the coming into force of such reduction, the rate of services shall stand correspondingly reduced.

60. JURISDICTION: Notwithstanding any other court or courts having jurisdiction to decide the question(s) forming the subject matter of the reference if the same had been the subject matter of a suit, any and all actions and proceeding arising out of or relative to the contract (including any arbitration in terms thereof) shall lie only in the Court of Competent Civil jurisdiction in this behalf at Bhopal (MP) and only the said Court(s) shall have jurisdiction to entertain and try any such action(s) and/or proceeding(s) to the exclusion of all other Courts.

61. NOTICES: Any notice, request, or consent sought pursuant to the e-Tender shall be in writing and shall be deemed to have been made when delivered in person to an authorized

representative of the Party to whom the communication is addressed, or when sent by speed post, email, or facsimile to such Party i.e. the Client or Bidder.

62. TERMINATION: The Client may terminate the Contract, by not less than thirty(30) days’ written notice of termination to the Bidder/Agency, to be given after the occurrence of any of the events specified in paragraphs (i) to (iv) of this Clause and sixty (60) days’ in the case of the event referred to in (v) below : i. if the Bidder/Agency does not remedy a failure in the performance of their obligations under the Contract, within thirty (30) days after being notified or within any further period as the Purchaser may have subsequently approved in writing; ii. if the Bidder/Agency becomes insolvent or bankrupt; iii. if as a result of Force Majeure, the Bidder/Agency is unable to perform a material portion of the Services for a period of not less than sixty (60) days; or ii. If the Bidder/Agency, in the judgment of the client has engaged in corrupt or fraudulent practices in competing or in executing the Contract.

For the purpose of this clause: a. “Corrupt Practice” means the offering, giving, receiving or soliciting of anything of value to influence the action of a public official in the selection process or in contract execution. b. “Fraudulent Practice” means a misrepresentation of facts in order to influence a selection process or the execution of a contract to the detriment of the Purchaser. c. the Client, at its sole discretion, decides to terminate this Contract.

64. LAW GOVERNING THE CONTRACT: - The laws of the Government of India shall govern this contract. The Court of Bhopal shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract. 65. If as a result of post payment audit any over payment is deducted in respect of any work done by the Agency or alleged to have been done by the Agency under this e-Tender, it shall be recovered by the AIIMS Bhopal from the Agency. 66. If any under payment is discovered, the amount shall be duly paid to the Agency by the AIIMS Bhopal. The Tenderer shall liable to provide all the relevant records copies during the concurrency period of Contract or otherwise even after the Contract is over, whenever required by AIIMS Bhopal.

( B ) Terms and Conditions for operating Cafeteria Services:- The terms and conditions for operating Cafeteria Services at AIIMS Bhopal are as follows: - 1. Items/Services to be provided by the Caterer (a). The Caterer shall allowed to sale Food, Meals, Tea, Coffee, Juices, Milk, Packed Water and Snacks etc. as required by or for the visiting OPD Patients, IPD Patient’s Attendants, Students, Faculty, Staff and Other Guests in the Cafeteria of AIIMS Bhopal from time to time, within The Institute’s Cafeteria Area, which is situated at AIIMS Bhopal Hospital Building, UGF, Near Dentistry OPD, Saket Nagar, Bhopal. The menus/items to be supplied by the Caterer shall be as mentioned in Annexure-VI(B)

(b). The Cafeteria shall remain opened from 6.00 AM to 10.00 PM for early Cleaning and preparation of etable items on each working Day/Sunday and for start-up the Cafeteria Services for visiting Individual’s, the timings of Cafeteria is 7.00 AM to 9.00 PM and the timing specified above is required to be strictly followed by the Caterer Agency. Violating the specified timings, the penalty of Rs. 1000/- on each occasion shall be imposed and repeating similar mistake on three occasions, the Contract of Cafeteria shall “Terminated” without serving any further notice to the Caterer by the AIIMS Bhopal Hospital.

(c). The Caterer shall remain open his Cafeteria Services as per the timing specified as above preferably in all working days/Sundays for the convenience of Patients visiting/Staff working in the Hospital. For Opening/Closing Cafeteria Services on any Gazetted Holiday, the Caterer is needed to be given prior written intimation to Hospital Administration (i.e. Medical Superintendent, AIIMS Bhopal).

(d). The Caterer shall sold etable on approved item rate wise on self payment basis (i.e. food, meals, tea and snacks) to visiting OPD Patient’s, IPD Patient’s Attendants, Student’s, Faculty, Employees and other Guests of the Institute and such other persons as may be authorized by the Institute from time to time in such a manner as may be determined by the Institute and advised to the Caterer from time to time.

(e). The Caterer shall take prior permission of the Hospital Administration (i.e. from the Office of the Medical Superintendent) of the Institute for preparation and supply of lunch/dinner/snacks/tea and coffee etc. ordered by theDepartments for their special meetings or any special occasions etc. on their specified location beside the allotted Cafeteria Area, if Caterer is doing so, without intimation and permission, the penalty of Rs. 1000/- on each occasion shall be imposed and repeating similar mistake on three occasions, the Contract of Cafeteria shall “Terminated” without serving any further notice to the Caterer by the AIIMS Bhopal Hospital.

2. Quantity, Quality and Price basics of the items to be sold in Cafeteria (a) The quantity and/or weight of the item of eatables, tea/coffee/etc. to be supplied as hereunder by the Caterer shall be as mentioned in the Financial Bid format for Price quote for Etable Items

to be sold in AIIMS Bhopal Hospital Cafeteria at Annexure-VI(B) annexed hereto. In no case any Caterer allowed to charge beyond this rates in the Cafeteria running by him at AIIMS Bhopal Hospital on monthly rental basis. (b) The Bidder should quote their rates for items inclusive of applicable service Tax in Annexure-VI(B). (c) Any of Bidder, who will awarded the Patient Diet Kitchen contract will preferably also given the Cafeteria Service Contract and he will liable to match the L-1 Rates quoted by any of other participating bidder in above mentioned Price Bid format i.e. at Annexure-VI(B) for each of item listed above to be sold at AIIMS Bhopal Cafeteria on approved rate. (d) For packed items, the Caterer should allow to charge printed MRP Rates only at AIIMS Bhopal Cafeteria. (e) All materials required by the Caterer for preparation of Food, Meals, Tea, Beverages, and Snacks etc. will be purchased by the Caterer himself on his own cost. All items of Food, Raw Materials for food purchased will have to confirm to the standards, prescribed under the prevention of Food Adulteration Act, Food Safety and Standard Act 2006 and/or any other Act applicable and as far as possible shall have the standards/branded bearing the mark “egmark”, ISI as applicable. For any violation of the Food Adulteration Act, Food Safety & Standard Act 2006, it will be the sole responsibility of the Caterer and will nominate his concerned Official/Employee for coordination to the concerned Authorities under the Act before the first day of the commencement of the Services as per Cafeteria Contract Agreement.

(f) The Grains and Provisions, , Fruits, Milk, Meat, Fish and Poultry etc. will be purchased from reputed suppliers/sources. The Institute or its representatives will be at liberty to inspect the materials brought by the Caterer at any time and also to reject any sub- standard items of materials which will be at the cost of the Caterer.

(g) It will be the responsibility of the Caterer to store the stock of Materials purchased by him in a neat, tidy and hygienic manner. The containers should be airtight. The Caterer hereby agrees and undertakes not to use the articles purchased for any purpose other than to meet the requirements of the InstituteCafeteria Services. The Institute will not be responsible for any loss or damage done or caused to the Caterer’s Stock, Materials, etc., while they are Stored within the AIIMS Bhopal Hospital’s premises.

(h) In Case of packed items sale, the Caterer will ensure the items available for sale having the sufficient valid period of its safe use. Expiry date items are not permitted by the Institute to be sold by Caterer from allotted Cafeteria Area in any case to any Individual.

(i) The Caterer should arrange to fill up / provide safe Drinking Water in Jug’s available in the Cafeteria Tables for all visitors.

3. Collection of revenue against Sale of Items in Cafeteria on approved Rates by the Caterer (a) The Institute is authorized to the Caterer to be charge approved L-1 Rates for items of food/meals as per unit basis as per the rate mentioned in the be as mentioned in the Financial Bid format for quoting prices for items to be sold at AIIMS Bhopal Hospital Cafeteria in the

Annexure-VI(B) for the approved Items sold in Cafeteria from the Purchaser directly preferably on Cash Payment basis. The Caterer is himself responsible for collection of revenue against services provided to any Individual/Department through AIIMS Bhopal Cafeteria. AIIMS Bhopal is not liable for making any outstanding payment/Loss occurred during Cafeteria services to Caterer for operating Cafeteria Services at AIIMS Bhopal.

(b) For the Sale of packed items by the Caterer in the AIIMS Bhopal Cafeteria, the Rates printed on the Packet are applicable and Caterer shall be charge the printed MRP Rates only. In no case any extra amount beyond printed MRP Rates is chargeable. However, on any packed Item available on discounted rates in comparison of MRP Rate as per the any marketing scheme of any manufacturer, the discounted Rate is needed to be passed to the Visitors on purchase of such items at AIIMS Bhopal Cafeteria by the Caterer.

(c) All costs of the items served to individuals shall be charged by the Caterer directly himself as per the approved L-1 Rates of Items as mentioned in the Annexure-VI(B) AIIMS Bhopal Hospital Cafeteria Items preferably on Cash Payment basis. Institute is not liable for make any outstanding payment against any Individual to the Caterer. The Caterer is advised to discourage the practices for making sale on “Credit” basis to any individual/department. If Caterer is adopting such practice, he may keep proper written records himself as a proof for carryout the recovery of such credited amount from particular individual/Department on at least one month credit period basis.

(d) The Authentic duly Signed Bill on bulk order/monthly Services provided by Caterer to any Department/Individual may provided on his Authentic Bill Book on demand and the duplicate copy should keep remain in the Bill Book of the Cafeteria and will shown as and when want for any cross verification by the Institute Authorities.

4. Right of Rejection/Transfer of Cafeteria Services (a) The AIIMS Bhopal shall have the right to reject such articles of prepared Tea, Food, Meals, Juices and Snacks etc. as in the opinion of the Institute are not of proper and standard quality. The Caterer will immediately make good any loss of materials rejected, which may arise on this account.

(b) That the caterer will not transfer or assign any part of his interest under this contract and that this contract shall also be liable to be terminated by the death or insolvency of the caterer before the expiry of the period of this contract.

5. Maintenance of Cleanness of allotted Cafeteria Area (a) The Caterer shall be responsible for maintaining and keeping the Cafeteria premises allotted and facilities used by him in neat and clean hygienic condition.

(b) The Institute shall have the right to inspect such premises and facilities and may call upon the Caterer to maintain the facilities in a neat and clean manner. In case of failure of the Caterer, the Institute has right to penalize the Caterer upto Rs.1,000/- per instance.

(c) The Institute has fulldiscretionary right to penalize the Caterer upto Rs.1,000/- in each case of default on his part in relation to Food Quality, Quantity, Cleanliness and Hygiene or default or lapse in following the instruction given to him by the concerned officer/s of the Institute. Repeating the same mistake in three occasion the “Contract is liable for termination” without any further notice.

6. Maintenance of Furniture & Kitchen Equipment provided by the Institute or brought by the Caterer for smooth functioning of Cafeteria Services at allotted Cafeteria Area.

(a) The Institute shall make available to the Caterer, Cafeteria Furniture and basic Light, Fan, Water fixtures, Water Cooler etc at present only. The Caterer is liable to bear the cost of provided items Normal repairs and replacement of the same on the event of any brakeage/damage/loss occurred during Cafeteria Services handling under written intimation to the Hospital Administration of AIIMS Bhopal (i.e. Medical Superintendent).

(b) Other required Kitchen Equipment to be used in the Cafeteria shall brought by the Caterer on his own cost for ensuring smooth functioning of Cafeteria Services in the allotted Cafeteria Area at AIIMS Bhopal premises. For this purpose the Caterer needs to be submit the list of Kitchen Equipment, Appliances, Utensils and other articles brought inside the AIIMS Bhopal Cafeteria premises in the Hospital Administration (i.e. in the Office of Medical Superintendent, AIIMS Bhopal Hospital) and keep its duly checked and verified duplicate copy signed by any assigned Official for counting of articles brought in the Cafeteria, so that after ending of the Contract, the same may be permitted to the Caterer to be taken back after cross verification.

(c) The Caterer shall ensure that the Furniture, Fixtures, Water Coolers, Insect Killer Lights, Taps, Serving Trolleys and Other Equipment provided to him are always kept in a working, clean and hygienic condition. In the event of any breakage or loss and/or damage to the same arising out of negligent handling by the Caterer or his employees, the Caterer shall compensate or pay for such replacements or repairs. The Caterer shall at all times provide tableware items of cutlery and crockery including cups, saucers, plates, spoons, serving trays, forks, steel/Acralic/Best quality Glass/Plastic jugs for water, Hot Tea/Coffee pots or any other items as required and the replacement thereof from time to time at his cost as may be required for the efficient service of food, snacks, tea etc., to the visitors of the Institute at the said Cafeteria premises.

7. Arrangement of LPG Cooking Gas Cylinders& compliance of Fire Safety Rules. (a) The Caterer shall be required to make himself necessary arrangement for cooking and keep LPG Gas refills in sufficient quantity for cooking purposes on his own cost as per the prevailing Rules and Regulation of LPG Gas Agencies.

(b) The Caterer shall be responsible for any loss/theft of the LPG Gas Cylinders and other Equipment provided to him by the Institute.

(c) The Caterer is liable for compliance of norms of Gas Cylinder Rules, 2004 under Explosives Act 1884 (4 of 1884) for commercial activities. 8. Responsibility of the contractor on cessation/completion of contract (a) The Caterer shall be responsible for the items of Furniture and Equipment entrusted to his care from time to time and shall hand over the same in good order and condition (with normal wear and tear) to the Institute as and when required by the Institute or on termination of this agreement. The Caterer shall not remove any of the above articles or equipment outside the Institute’s premises.

(b) On completion of the contract period or on termination of this agreement, the Caterer will also ensure that all the persons engaged by him are removed/withdrawn from the premises, forthwith and will settle their accounts by paying all the legal dues as required under the provision of various applicable Labour laws. In case of any disputes arising out of on account of any matter related to his employees, it will be the responsibility of the Contractor to pay his employees all the legal dues. AIIMS Bhopal in any case not liable to pay any person/worker engaged by the Contractor for running his Cafeteria Services any remuneration.

9. Engagement of staff (a) The Caterer shall engage sufficient and competent staff to act as Dietician-cum- Manager, Stores/Accounts/Coupons Tally Clerks, Cooks, Asst. Cooks, Trolley Vendors, Snacks Makers, Sweet Makers, Tea Makers, Pantry Man, Waiters, Vendors, Attendants, Hamals, Helpers with having the relevent required qualifications in the handling of Patient Diet Kitchen Services or Cafeteria Services or Hotel Management Course in respective category etc., as may be reasonably required in the opinion of the Institute for the fulfilment of the Caterer's obligations under this Contract, and shall give their professional expert guidance and supervision for the running of Cafeteria Services at AIIMS Bhopal premises at his own cost and expenses. AIIMS Bhopal shall in any case not liable for payment of any remuneration to the any manpower engaged by the Caterer.

(b) The Caterer shall engage personnel who are in its opinion competent, possess suitable experience, and are honest and trustworthy. The Caterer will depute people of only good background to do the work at the Cafeteria. The Caterer shall of his own select,recruit and employ its workforce and the Institute shall in no manner be associated with this process. The contractor will maintain and show the Institute on demand, all employment documents (like appointment letter, bio-data, I-Card, Police Verification Reports of engaged workforce etc) in respect to his employees.

(c) All assigned personnel shall be persons employed by Caterer and shall ensure that, with respect to the personnel so compliance of all the provisions as applicable labour laws/regulations and any and all other applicable legislation and shall also maintain all records/registers/books as may be statutorily required there under and shall, as and when

required, provide such aforesaid records/registers/books for inspection by the authorized personnel of the Institute

(d) Licence under Contract Labour (Regulation & Abolition) Act, 1970: The Caterer will obtain requisite license from the licensing authority under Contract Labour (R&A) Act, 1970 according to the number of workers engaged by him and get and aforementioned license renewed from time to time as and when due from the appropriate authority and will keep valid and produce the same when called upon to do so.

(e) Maintaining Attendance Register: The Caterer will properly maintain muster roll/Attendance Register of the person employed/engaged in connection with the work at the premises of the Institute and shall be produce as and when needed to the Labour Inspector/AIIMS Bhopal Authorities for necessary cross verifications time to time.

(f) Employment totally on Temporary basis: The Caterer or the person(s) so engaged by him will have no claim or right whatsoever to be absorbed in the employment of the Institute at any time or under any circumstances or for any reason whatsoever. The Caterer shall be solely liable for the employment or non employment of his workforce. In case, any dispute is raised by their employee, the Caterer shall personally defend and indemnify the Institute in respect of any consequence thereof. The Caterer issue the periodical Entry passed to its employees deployed by it at premises of the Institute.

(g) Effective Management: The Caterer will have a competent Dietician-cum-Manager on the Cafeteria premises at all times who shall represent the Caterer in his absence. The Caterer will visit the establishment once a week for overall supervision and ensure the smooth functioning of Cafeteria including hygienic/neat conditions in Cafeteria.

(h) Regularity of employees: Any absence of the staff mentioned for more than a day will have to be suitably replaced by the Caterer and make alternative arrangement for ensuring the smooth functioning of Cafeteria Services.

(i) Supervision of Employees: The Supervisors appointed by the Caterer will supervise the work of his employees. If in the opinion of the Institute any Supervisor is found unsuitable, the Caterer shall be liable to change the Supervisor.

(j) Employer-employees relationship: The employees employed by the Caterer shall be the employers of the Caterer only, and not of the Institute and the Caterer shall be solely responsible for all acts of commission or omission of his workers. Under no circumstances, the facilities which arebeing provided to the employees of the Institute shall be extended to the employees/staff of the Caterer. Subsequent to the expiry/termination of the contract, no claim from either the Caterer or from his employees/staff shall be entertained for continuance of their services and under no circumstances the employees/staff who are being recruited by the Caterer can claim employment in the Institute.

(k) Fitness of employees: All workers employed by the Caterer shall be medically fit for handling food and certified for fitness before employment and every Three months thereafter to be examined by a registered medical practitioner of the Institute(if required). The decision of the Institute’s Medical Practitioner’sin this regard to the fitness of the Caterer's employee will be final.

(l) No employee having the age below of 18 years for Cafeteria Service at AIIMS Bhopal premises shall be engaged/deployed by the Caterer. If any such minor person deployed by the Caterer, the sole responsibility to be bear all legal expenditure/ penalty imposed by any Statutory Labour Authority is on the part of Caterer.

(m) Identification of Caterer’s employees: All Caterer’s personnel working in the premises the AIIMS Bhopal Cafeteria shall be properly identified by their uniforms and badges (different colour than those worn by the Institute employees), which must be worn by them at all times while on Institute’s premises. The Caterer and his employees shall observe and abide by all fire, safety and security regulations of the Institute. The Caterer will ensure that his employees do not remain on the premises beyond their normal working hours without specific approval of Cafeteria Services In-charge/Medical Superintendent or any other authorised Officer of Hospital Administration. Any un-authorised presence on the premises beyond normal working hours will not be acceptable and the Caterer upon receipt of complaint will have to withdraw such employees from working in the Institute’s premises.

10. Exclusive for AIIMS Bhopal Hospital

The space provided by the Institute to the Caterer for the purpose of operating the Cafeteria Services in the premises of the Institute shall be used by the Caterer only for the purpose of operating Cafeteria and for no other purpose whatsoever. For the removal of any doubt, it is expressly provided that the Institute's premises shall not be used by the Caterer/Contractor for any purpose other than to sale of Food Articles to the OPD Patient’s/IPD Patient’s Attendants, Students, Faculty, Staff and visitors of AIIMS Bhopal on under this Contract.

11. Uniform to employees of the Caterer

The Caterer shall provide at his own Cost Two Sets of neat and clean uniforms to his employees working in the Institute's premises and shall ensure that such uniforms are always worn by the employees while on duty. Uniform will include pair of canvass shoes for the Waiters/Attendants. In addition, Cook/Asst. Cook will also be provided with aprons and caps. The Institute shall be within right to disallow any of the employees of the Caterer who will not be wearing the uniform or that it will not be neat and clean.

12. Quantum and timely payment of wages The Caterer shall, in all respects, comply with all requirements of Minimum Wages Act as applicable to eating establishments, the Contract Labour (Regulation & Abolition) Act, the Employees’ State Insurance Act, Employees’ Provident Funds & Misc. Provisions Act, Payment of Bonus Act, the Payment of Gratuity Act and any other law in force and shall keep the Institute indemnified against all liabilities and responsibilities under the said Acts and Schemes there under and under any other laws affecting employer/employee relations. The Caterer shall pay the wages to his workmen in the presence of the competent persons engaged by the Institute and his records can be verified by the Institute as required under the law and shall furnish details/records to the Institute by the tenth day of the following month that he has paid wages(not less than the minimum wages as fixed or revised) to his workers and complied with other statutory requirements pertaining to the Employees’ Provident Funds and Misc. Provisions Act and also Employees’ State Insurance Act (if applicable), etc. on monthly basis.

13. Payment and deposition of Taxes to applicable Statutory Authority The Caterer shall be wholly responsible for Payment/Deposit of any and all Statutory taxes including but not limited to Sales Tax/Service Tax, Duties/Cess under the existing or Future Laws, Acts, Rules, Orders, Notifications etc, issued by the Central or State Governments or any local authority, or Body in respect in time to time or in connection with supplies and that the Corporation shall not be liable to pay such taxes, rates, duties etc., whether existing or which may accrue in future

14. Indemnification by Caterer

The Caterer shall at all times keep the Institution effectively indemnified against all actions, Suits, Proceedings, Leases, Rent, Costs, Damages, Charges, Claims and Demands in any way arising out of reason of anything done or omitted to be done by the Caterer.

15. Amendment Any amendment to this Agreement shall not be valid and binding on the Parties unless it is made in writing and signed by the authorized personnel of both Parties.

16. Communication All Notices, Certificates, Acknowledgements, Letters and other reports hereunder shall be in writing and shall be deemed properly delivered when duly mailed by registered letter to the other Party at its address as given below or to such other address as either Party may, by written’ notice designate to the other.

17. Language of the Contract Agreement, Documents and Communication

All documents to be furnished or communications to be given or made under this Agreement shall be in English language or, if in any other language, shall be accompanied by a translation into English certified by representative of the Party furnishing such document or communication, which translation shall be the government version between the parties.

18. Injury/accident to Caterer’s employee

On the occurrence of any injury to Caterer's employees, the Caterer shall comply with the statutory requirements in notifying the authorities within the time stipulated therein and shall also inform the Institution for the incident (i.e. in the Office of Medical Superintendent, AIIMS Bhopal Hospital). The Caterer will at all times keep the Institute effectively indemnified against any liabilities under the Workmen's Compensation Act 1923, ESI Act (if applicable) or any other enactments/statutory provisions of laws applicable or made applicable and amendments thereof. The Caterer is responsible and liable for all acts, deeds, misdeeds and conduct of his employees, servants, agents, supervisors and other staff whether stationed at the Institute's premises or otherwise and the Caterer agrees to fully indemnify the Institute from any loss, damage or consequence arising out of the act, deed, misdeed or conduct of such employees, servants, agents and supervisors and other staff.

19. Status of Caterer Nothing contained herein shall be construed to create a monthly tenancy or create any interest in favour of the Caterer in respect of the Cafeteria and other premises used by the Caterer in connection with the purpose of this Agreement. The status of the Caterer will be only license and not the lessee or the tenant.

20. Deposition of Rent for allotted Cafeteria Area, its Electricity and Water Charges by the Caterer to AIIMS Bhopal (a) The Caterer should pay Rs.10/- per Sq.Ft. rent of Cafeteria Area, which he is utilizing for running Cafeteria Services for his commercial purpose to AIIMS Bhopal on monthly payment Basis. The Cafeteria Commercial Area is presently approximately 750 Sq. Ft and the rent shall be Rs. 7,500/- (Seven Thousand Five Hundred Only) per month. The First month rent needs to be deposit by the Caterer in Advance to AIIMS Bhopal before commissioned his services and he will liable to deposit the Rent before 10th day of each of successive month at AIIMS Bhopal Hospital Administration and obtain and keep Receipt with him for necessary records.

(b) The contractor to pay Electricity Bill to Institute on the basis of actual units consumed. For this purpose AIIMS Bhopal Engineering Unit will fix an Electricity Meter in Cafeteria Area for

calculation of Electricity consumed and on the basis of the same monthly Electricity Bill to the Caterer shall be provided and Caterer should be deposit within 10 Days time in that particular Month to the AIIMS Bhopal Administration and keep the Receipt with him for necessary records.

(c) The Caterer to pay Water charges on Fixed Rate basis and shall be paid Rs. 1000/- (One Thousand ) per month basis before 10th day of each of successive month at AIIMS Bhopal Hospital Administration and obtain and keep Receipt with him for necessary records.

21. Obligation of Caterer on cessation of contract

On the cessation of Contract Agreement for Cafeteria Services, the Caterer shall discontinue to use and hand over peacefully, possession to the Institute of the said Cafeteria and any other premises, together with fixtures and articles therein as per inventory, in good condition and also shall give up his right in favour of Institution all licenses and permits in force, and give all assistance towards getting the said licenses transferred to the Institution or its nominees.

22. Termination of contract

In the event of the Caterer committing a breach of any of the terms and conditions of this Agreement, the Institute shall be entitled, subject to other rights available to it under this Agreement, to terminate this agreement immediately without notice without assigning any reasons. On termination of this agreement in terms of this clause, the other terms and conditions relating to termination to this agreement shall apply. The Institute can also terminate the Agreement immediately on the occurrence of any event which, in the exclusive opinion of the Institute, necessitates the termination of this Agreement forthwith. The Institute shall have a right to terminate the contract bygiving one month’s notice in writing to the other party without assigning any reason during the period of this agreement.

23. Arbitration Clause 1. All disputes and differences of whatsoever nature, whether existing or which shall at any time arise between the parties hereto touching or concerning the agreement, meaning, operation or effect thereof or to the rights and liabilities of the parties or arising out of or in relation thereto whether during or after completion of the contract or whether before after determination, foreclosure, termination or breach of the agreement (other than those in respect of which the decision of any person is, by the contract, expressed to be final and binding) shall, after written notice by either party to the agreement to the other of them and to the Appointing Authority hereinafter mentioned, be referred for adjudication to the Sole Arbitrator to be appointed as hereinafter provided.

2. The appointing authority shall either himself act as the Sole Arbitrator or nominate some officer of AIIMS Bhopal (referred to as Owner/Client/Institute) to adjudicate the disputes and differences between the parties. The contractor/vendor shall not be entitled to raise any

objection to the appointment of such person as the Sole Arbitrator on the ground that the said person is/was an officer that he/she has to deal or had dealt with the matter to which the contract relates or that in the course of his/her duties, he/she has/had expressed views on all or any of the matters in dispute or difference.

3. In the event of the Arbitrator to whom the matter is referred to, does not accept the appointment, or is unable or unwilling to act or resigns or vacates his office for any reasons whatsoever, the Appointing Authority aforesaid, shall nominate another person as aforesaid, to act as the Sole Arbitrator.

4. Such another person nominated as the Sole Arbitrator shall be entitled to proceed with the arbitration from the stage at which it was left by his predecessor. It is expressly agreed between the parties that no person other than the Appointing Authority or a person nominated by the Appointing Authority as aforesaid, shall act as an Arbitrator. The failure on the part of the Appointing Authority to make an appointment on time shall only give rise to a right to a Contractor to get such an appointment made and not to have any other person appointed as the Sole Arbitrator.

5. The Award of the Sole Arbitrator shall be final and binding on the parties to the Agreement.

6. The work under the Contract shall, however, continue during the Arbitration proceedings and no payment due or payable to the concerned party shall be withheld(except to the extent disputed) on account of initiation, commencement or pendency of such proceedings.

7. The Arbitrator may give a composite or separate Award(s) in respect of each dispute or difference referred to him and may also make interim award(s) if necessary.

8. The fees of the Arbitrator and expenses of arbitration, if any, shall be borne equally by the parties unless the Sole Arbitrator otherwise directs in his award with reasons. The Award of the Sole Arbitrator shall be final and binding on both the parties.

9. Subject to the aforesaid, the provisions of the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof and the rules made there under, shall apply to the Arbitration proceedings under this Clause.

10. The Contract shall be governed by and constructed according to the laws in force in India. The parties hereby submit to the exclusive jurisdiction of the Courts situated at Bhopal for all purposes. The Arbitration shall be held at Bhopal and conducted in English language.

11. The Appointing Authority is the Director, AIIMS Bhopal. The Caterer shall not transfer or assign or share benefit of this agreement without the consent in writing of the Institute to any other party.

No bidder/or his representative shall bring or attempt to bring any political or other outside influence to bear upon any superior authority or hospital functionaries to further this business interest. In doing so, e-Tender of the concerned bidder will be rejected without assigning any reason.

DETAILED SCOPE OF WORK OF PATIENT DIET KITCHEN & CAFETERIA SERVICES AT AIIMS BHOPAL is as under:-

The AIIMS Bhopal is one of the Six new AIIMS established under PMSSY, M/o of Health &

Family Welfare, Government of India to abolish regional imbalances in the tertiary care in the Country. The AIIMS Bhopal is fast upcoming public health care institution catering to the Madhya Pradesh and surrounding states. Presently OPD, IPD, OT and ICU services are being provided. These services will be upgrading in phased manner from currently 150 to 500 beds, round the clock emergency and trauma services by end of this year.

1. Vendor’s responsibilities:

The successful bidder shall provide and render the entire kitchen & cafeteria

services through fully equipped kitchen and stores comprising off procurement,

preparation and serving of all Meals, Breakfast, Lunch, Dinner, Tea and Snacks

etc, for patients, doctors, executives, staff, guests and Attendants conforming

to the specifications and the best quality standards on all days of the week

round the clock for and in accordance with the requirement of the Institute, and

to run and manage the Cafeterias, Pantry and banqueting services at the

Institute as may require from time to time by the Management as per laid down

quality standards.

1.1 Agency should engage Qualified Staffs like Waitors, Cooks, Dietetian should

possesses the applicable Certificate/Diploma/Degree etc., provide Kitchen

utensils, equipment, furniture, fixtures, food carrying trollies and miscellaneous

items required to Provide efficient and uninterrupted dietary services.

1.2 Prepare and provide food to patients as per the instructions of the dietician

and/or authorized person.

1.3 Clean and maintain proper sanitation and cleanliness in food preparation,

service and Service areas and use fresh food and raw materials in preparation of

foods.

1.4 Remove all trash and garbage to waste receptacles inside the premises of the

hospital.

1.5 Successful bidder/Contractor shall provide list of all its’ personnel scheduled to

work in the premises of the hospital.

1.6 Contractor shall be responsible for all its staff uniforms and its laundry services

– a minimum of 2 sets of uniforms to all its employees is to be provided with a

pair of shoes.

1.7 All procurement in terms of raw material, , grocery, dairy, bakery

products, cleaning agents and any other items etc to run the kitchen & cafeteria

services, including cooking fuel (LPG), would be arranged and paid directly by

Contractor.

1.8 All transportation and vehicle costs required for Contractor’s operation and all

applicable taxes and insurance costs incurred by Contractor etc.

1.9 Contractor shall maintain a daily awareness of the health of individuals and in

specific areas paying particular attention to the signs and symptoms of

communicable diseases that can be transmitted by food products. If an

employee is suffering from gastrointestinal illness, boils, infected wounds etc,

shall be temporarily removed of his duties till cured.

1.10 Contractor shall issue photo identity cards to all its employees bearing their

individual photograph within 7 days from the date of this agreement coming in

operation. The identity card shall bear the name of the employing organization,

deployment establishment and shall bear the period of contract and date of

issue and the Proprietor/authorized representative of the Contractor shall sign

expiry. Any new employee shall be issued a new identity card within 10 days of

the deployment.

1.11 Contractor shall ensure that all employees and workers of the Contractor have

undergone police verification process.

1.12 Contractor will ensure that the raw material being used in the preparation of

food for patients and the Cafeteria meet the quality specifications and

guidelines. The contractor will be allowed only serve vegetarian diets and

products in kitchen and cafeteria. All the items to be procured shall be food

grade & or Agmark.

4. The electricity, water and space rent in case of Cafeteria services shall be beared by

contractor and will be charged as per approved rates.

5. Annual medical checkup of all staff do be done by Tenderer at its own cost including

the following tests a) Chest X RAY b) CBC (Hb, TLC, DLC) c) Routine Urine Test d) Routine Stool Test

6. The police verification report in respect of staff to be deployed by the Agency for

handling Patient Diet Kitchen and Cafeteria Services in AIIMS Bhopal Hospital needed

to be provided the same within 15 days time from the deployment of any of his Staff

member at AIIMS Bhopal premises and all deployed manpower will wear the

approved color dress and ID Card during discharging duties at AIIMS Bhpal Hospital.

7. Up gradation, Preparation and submission of standard operating procedure (SOP):

Related to kitchen and cafeteria services and its approval by Client. The

suggestion of the client shall be incorporated in the SOP by the agency.

1.17 Firefighting: The kitchen & Cafeteria personnel’s should be adequately trained to

perform firefighting operations and operate related equipment.

2. LIABILITIES OF INSTITUTE

2.1 The Hospital will provide space, water connection, electricity connection and

cafeteria furniture. The agency will liable to deposit the agreeable Rent, Water &

Electricity Charges for allotted Area of Cafeteria to AIIMS Bhopal on each month

basis.

2.2 SUPERVISION & QUALITY CONTROL AIIMS Bhopal Authority will have unfettered

right to inspect the kitchen premises, process of cooking and catering, at any time

and the agency will cooperate with the client. Client will have overriding

supervising power to give instructions and it must be complied with.

3. LIABILITIES OF SERVICE PROVIDER

1. All required Raw Material, Utencils, Appliances needed to be arranged by the Agency and deploy the required number of Man power for handling AIIMS Bhopal Hospital Patient Diet Kitchen Services and Cafeteria Services by Agency. It is adviced to the Agency to engage trained, young, smart and well-mannered adult manpower with compliance of all applicable Labour Laws with wearing proper approved colour uniform, ID Cards during discharging their services at AIIMS Bhopal 2. Will issue I-card with signature of authorized AIIMS Bhopal Hospital official.

3. The service provider shall make available CV of the employees in hard copy

and/or soft copy giving out the details of all the employees deployed in AIIMS

Bhopal.

4. The shift of the staff would be rotated periodically and a roaster would be

maintained.

5. The staff would be changed with proper handing & taking over of kitchen

equipment every month / week as per roster to avoid possible contacts/collusion

for better security arrangement from operational point of view.

6. The agency shall pay its employees salary in to their respective bank account

through ECS (mandatory requirement). The ECS statement of monthly salary

payment duly verified by bank official would have to be submitted with bill for

payment.

7. All liabilities such as wages, ESIC, EPF, Bonus and other statutory requirements of

staff will be borne by Contractor. Contractor will submit the proof of PF & ESIC

payments with ECS statement for salary payment with the monthly bill.

8. The Agency will liable to arrange all required Equipment/Utensils/Required Raw

9. The Agency will maintain highest level of hygiene during service delivery at AIIMS

Bhopal as per prevailing norms of Bhopal Municipal Corporation/Pollution

Control Board/Any other Statutory Organization like NGT etc. and make sure the

availability of all required Equipments/Garbage Disposal Bins/Insect killing

Machines should be provided by him and for this purpose AIIMS Bhopal will not

pay any extra amount to any Agency. It means that all above required items cost

is also included in the quoted rates of the Agency.

8. The agency shall be responsible to provide trained manpower in kitchen &

cafeteria services.

9. Weekly, fortnightly and monthly training of all the personnel deployed must be

organized as per training program and intimated to AIIMS Bhopal.

10. Working hours of deployed staff would normally be eight (8) hours. All quotes on

eight hour duty roaster.

11. During winter duty staff will be equipped with woolen over coats, boots, gloves,

and sweaters as per need.

12. During duty Hours all the Patient Kitchen and Cafeteria staff wear the Cap, Mask

and Gloves to maintain utmost hygine standars.

13. The service provider shall also provide female staff as per need of the services.

The Bidder shall bear all costs associated with the preparation and submission of

bid and AIIMS Bhopal will in no case be held responsible or liable for these costs,

regardless of the conduct or outcome of the bidding process.

14. The bidder must read the prescribed terms & conditions and accept the same to

proceed further to submit the bids.

15. After downloading / getting the e-Tender schedules, the Bidder should go

through them carefully and then submit the documents as asked, otherwise, the

bid will be rejected.

16. Bidder must unconditionally accept all terms and conditions stipulated in the

original/downloaded e-Tender document and submit/upload the entire signed

and stamped document.

17. The bidder has to submit the e-Tender document online well in advance before

the prescribed time to avoid any delay or problem during the submission

process.

18. All documents submitted should be self-attested with seal of the bidder.

19. In case the date of opening of e-Tenders is declared a holiday for unexpected

reasons, the e-Tenders shall be opened same time on the next working day.

20. All pages of the bid including all enclosures should be numbered (except printed

leaflets/catalogue) and must be duly filled in, signed and stamped by the bidder

2. Soft Diet: This diet is intermediate between a full liquid and light diet. It should be served to patients who are convalescing from surgery, gastro-intestinal disturbances and acute infections. This diet can be nutritionally adequate when planned on the basis of a normal diet. The food should be soft in texture and consistency, easy to chew and contain low roughage. The diet would be made of simple, easily digestible foods and should contain no harsh fibre and no rich or highly flavoured foods. It should be a high calorie-high protein diet. 4. I/We should deposit One time Performance security of 10% of the annual estimated value of contract ( i.e. Rs. 2.50 Lakh) for providing Patient Diet Kitchen Services at AIIMS Bhopal in the form of FDR/Bank Guarantee/DD in the name of The Director, All India Institute of Medical Sciences, Bhopal (India) in the format at Annexure-IX attached herewith on award of the contract and shall remain in the custody of the Director till the validity of the Tender Contract plus three month (i.e. for 33 months).

5. I/We should provide all the assigned Patient Diet Kitchen Services and if any service being found of inferior quality, it shall be immediately improved by me/us free of cost in time to prevent inconvenience.

6. I/We hereby undertake to provide all the assigned services as per General Terms and Condition of this Tender Enquiry during the validity of tender as per directions given in the Notification of Award/Work Order/Contract Agreement within validity/any extension of time of this Contract period positively.

7. If I/We fail to provide the desired assigned services in stipulated period the AIIMS Bhopal hospital has full power to compound or forfeit the Bid Security/security deposit.

8. I/We declare that no legal/financial irregularities are pending against our firm.

9. I/We undertake that the rates quoted by me for providing patient diets as and when approved and selected by the Director, AIIMS Bhopal will be valid for Two years from the date of approval of the rate contract in the format given in Annexure-X or till extended as mutually agreed upon. I/we undertake to commence the Patient diet services within 15 days time to AIIMS Bhopal on receipt of Work Commencement Letter. I/we undertake to commence and provide the contracted services within stipulated period and if fail to commence the services within stipulated period, the necessary action can be taken by the Director, AIIMS Bhopal, India and the same shall be accepted to me.

10. I/We undertake that if the patient Diet Rates are lowered due to any reason, I will charge the lower rates.

11. I/We undertake that the Patient Diet being prepared and provided to AIIMS Bhopal, I will arrange the Demonstratio (if any asked by AIIMS Bhopal) and all cost for the same shall be borne by me.

12. I/We undertake that the quoted rates for Patient Diets are not higher than that approved in any other Govt. institutions in India for the similar nature Patient Diets during the current Financial Year.

13. Affidavit regarding No CBI Inquiry/FEMA/ Criminal proceeding/Black listing is pending or going on against the manufacturer/bidder firm is also enclosed. I undertake that I will not submit any irrelevant documents with the tender and in doing so I will not have any objection if my tender is rejected on that ground.

I/we do hereby confirm that the prices/rates quoted are fixed for entire validity period of this Rate Contract and its any subsequent extension and are at par with the prices quoted by me/us to any other Govt. of India/Govt. 16. I/we undertake, If as a result of post payment audit any over payment is deducted in respect of any extra payment for Patient Diet Kitchen Services /work done by our Agency or alleged to have been done by our Agency under this tender, it shall be recovered by the AIIMS Bhopal from our Agency.

17. I/we undertake, If any under payment is discovered, the amount shall be duly paid to our Agency by the AIIMS Bhopal.
