1 PURPOSE OF REPORT AND EXECUTIVE SUMMARY 1.1. This report summarises the situation in relation to S.106 agreements for the 1st quarter 2009/10. 1.2. £511,107 has been committed to the council in monetary obligations for Quarter 1. A list of agreements signed during Quarter 1 can be found at Appendix B. 1.3. £65,722 was received in Quarter 1. A breakdown can be found at item 2.6. 1.4. £45,299 was spent from S.106 funds in Quarter 1. Please refer to Appendix C for breakdown. 1.5. £1,595,735 is unallocated and remains available from S.106 income. Please refer to Appendix D. 1.6. To approve the proposed use of S.106 funds towards the Wimbledon Station Access Scheme.

2 DETAILS 2.1. S.106 of the Town & Country Planning Act 1990 (as amended) permits Local Planning Authorities to enter into agreements with applicants for planning permission to regulate the use and development of land. This may involve the payment of a financial contribution for off site works.

27 2.2. Government guidance on the use of planning obligations is set out in ODPM Circular 05/2005 issued on 18th July 2005. The guidance requires that a planning obligation must be: i) Relevant to planning; ii) Necessary to make the proposed development acceptable in planning terms; iii) Directly related to the proposed development; iv) Fairly and reasonably related in scale and kind to the proposed development; v) Reasonable in all other respects. 2.3. Members requested an annual report detailing agreements signed, income received and expenditure funded by S.106 Agreements. At the Planning Applications Committee meeting of 18th August 2005, Members requested that this report be produced on a quarterly basis in future. The report is to be submitted to Cabinet.

2.4. In order to ensure that the Council remains competitive in securing benefits through the S.106 process, a revised format of the bi-monthly income/expenditure meetings has now been formalised so that meetings now involve all corporate officers involved in the S.106 process. The aim of the meeting is to be a forum through which departments can be aware of key issues at an early stage so that the benefits of S106 can be maximised. Agendas are flexible so that attendees feel they have an opportunity to express issues, however they roughly cover the following areas with respect to S.106:

• processes (including protocol preparations) • considerations for policy development • update on any developments in the field of S106 such as relevant Government/Mayoral proposals, policies and legislation • performance and reports • lessons learned • application & implementation issues – it is intended that detailed issues on specific cases can be discussed separately to help to retain a strategic focus in the meetings

• identifying opportunities to channel S.106 funding towards the council’s Capital programme both in terms of the negotiations with developers for prospective S.106 contributions and for the allocation of S.106 monies already received

2.5. This programme of meetings supplements the existing arrangements for bidding and notification which include:

28 • notification of officers, relevant ward councillors and the Cabinet member for Planning and Traffic Management with respect to newly signed S.106 agreements and the obligations contained therein • notification of officers and members as above with respect to newly received financial contributions paid in accordance with S.106 agreements • bids are to be prepared by officers responsible for implementing projects for which S.106 monies are sought and are to be authorised by their relevant head of service. • all bids are to be authorised by the Head of Public Protection and Development • all bids for S.106 monies of £30,000 and above are to be authorised by the Director of Environment and Regeneration • such bids upwards of £50,000 require the authorisation of Cabinet

• bids are to be within the bounds of the signed S.106 Agreement which vary from case to case. Consequently the level of detail required in support of a bid and subsequent level of scrutiny of a bid may vary in relation to the level of detail specified within the S.106 Agreement and the complexity of the measures towards which the funds would be applied.

• any queries with respect to S.106 contributions that have been received, (for example should a councillor wish to enquire whether a S.106 contribution could be applied to a specific project) will usually be directed to the service that would be responsible for bidding and spending the contribution. Such queries would generally be directed to officers that are involved in seeking funding for projects to be carried out within those sections.

• Environment and Regeneration is currently developing a “Project Bank”, a centralised database of potential projects. It is hoped that the Project Bank will be an effective way of identifying priorities for funding such as S.106 across the department and be used as a point of reference should members have any S.106 queries.

2.13. The following developments were designated parking permit / car free during Quarter 1: Date Address Description 1/5/09 Land at Former Thames If at any time the Council

Whilst these funds are currently allocated to a one-way system in the town centre (Ely’s), such a scheme is not feasible at this time and is unlikely to be in the foreseeable future without significant third party funding. As such it is proposed that reallocation to the forecourt project will deliver direct benefits to public

38 transport users, pedestrians and cyclists in the short to medium term.

2.18. It is proposed to allocate the funds included in Table 1 toward a station access scheme in and around Wimbledon Station. The key aspects of the scheme are The creation of a shared space in the station forecourt to facilitate pedestrian movement The enhancement of pedestrian crossing across Wimbledon Bridge through the repositioning of the existing crossing The creation of a number of ‘public realm’ enhancements such as improved street furniture Enhanced signage New drop off and loading facility on Wimbledon Bridge Pavement widening at specific locations Reorganisation of taxi rank and disabled parking facilities Upgraded secure cycle parking facilities Public art

The proposed station access scheme would provide benefits for residents, employees and visitors associated with all of the developments included in Table 1 by improving conditions for pedestrians, cyclists and public transport users, thereby encouraging sustainable travel behaviour. It is considered that the proposed scheme satisfies the S106 parameters for each contribution. 2.19. The Station Access scheme is a jointly funded project that takes place on both public highway and Network Rail land. The development of a joint approach to create an ‘area based treatment’ recognises the role of Wimbledon Station as both a transport hub but also a key part of the wider town centre infrastructure in terms of pedestrian amenity 2.20. Given the range of issues associated with delivering a successful scheme on this site, the different land uses and ownership, and the strong focus on quality, based on budget availability there is an imperative to work collectively and to pool funding. 2.21. An outline scheme concept has been developed and a Project Group established. The scheme has secured development funding of £40k from Transport for London to take it through to detailed design and formal consultation using the STEP programme. 2.22. The scheme has benefits related to the 2012 Olympics (Wimbledon being a venue for tennis) and this has enhanced the overall support and momentum for the scheme. However in terms of overall delivery this means that the project needs to be completed by Summer 2011.

39 2.23. The overall funding requirement for the project is estimated at £1 million. It is also noted that £5k of the S.106 funding must be ring fenced to cycle improvements in accordance with the terms under S.106 reference 145/6 in Table 1. 2.26. Consultation and timescales To date a number of informal consultations have taken place related to the outline concept – for example Wimbledon Civic Forum received a presentation on the proposal in July 2009. The Wimbledon Business Round Table has also been engaged at a recent breakfast meeting in Spring 2009. So far these contacts have been relatively general. However the full scheme project programme includes a detailed consultation and communication plan both for informal stakeholder and public consultation and also formal consultation related to the technical works This is detailed below:

3 ALTERNATIVE OPTIONS 3.1. This report in relation to the update of S.106 Agreements for the 1st quarter 2009/10 is for information. 3.2. Cabinet could decide not to approve the allocation of the £S.106 funds towards Wimbledon Station Access Scheme, however this would result in a lost opportunity to spend the S.106 funds in accordance with the S.106 agreement from which it was secured and the council may miss out on realising the substantial community benefits offered by the proposal. In addition the opportunity to lever in significant third party funding from Network Rail and Transport for London would be significantly impaired or removed altogether.

4 CONSULTATION UNDERTAKEN OR PROPOSED 4.1. This report in relation to the update of S.106 Agreements for the 1st quarter 2009/10 is for information. 4.2. Regarding the Wimbledon Access Scheme, consultation undertaken or proposed is discussed at 2.26 above.

5 TIMETABLE 5.1. The figures shown relate to activity between 1st April and 30th June 2009. 5.2. The Wimbledon Station Access project will be constructed by Summer 2011.

43 6.1. The S.106 funds referred to in this report have been received by and are available to be spent in the manner agreed by Cabinet, subject to any restrictions contained in the agreements.

7 LEGAL AND STATUTORY IMPLICATIONS 7.1. As stated in the body of the report.

8 HUMAN RIGHTS, EQUALITIES AND COMMUNITY COHESION IMPLICATIONS 8.1. The planning applications were considered in the light of the Human Rights Act. S.106 contributions are secured and allocated towards community benefits such as school improvement projects, open spaces, sustainable transport and community safety. As a consequence, equalities and community cohesion implications are taken into account. 8.2. An Equalities Impact Assessment will be conducted as part of the project development process. At the initial stage, a key consideration will be the need to balance the accessibility requirements of different user groups. It is intended to conduct a ‘Focus Group’ on accessibility to ensure that the these issues are built into the project at an early stage. In addition officers will work closely with Transport for London to ensure that surface treatments and gradients do not present barriers to mobility impaired persons.

9 CRIME AND DISORDER IMPLICATIONS 9.1. This report is for information. Specific schemes may have relevant implications. The Wimbledon Station Access Scheme design will undergo a crime impacts audit and the general objective will be to make the area safer.

10 RISK MANAGEMENT AND HEALTH AND SAFETY IMPLICATIONS 10.1. For a minority of contributions there are deadlines for which they have to be spent. The risk is minimised by undertaking the monitoring of these contributions. 10.2. An initial risk analysis has been undertaken as part of the Wimbledon Access Scheme and this will be reviewed as the project is developed. Safety implications are being considered as part of the development of the scheme and at this stage the scheme is neutral in this respect.
