1. The petitioner Thiru S. Subramanian is present for today’s enquiry. The Public Authority is represented by Thiru John Rose, Asst. Commissioner of Police, and Tmt. K. Savithiri, Personal Asst (Estt), to Commissioner of Police, Chennai.

2. The petitioner has sent a petition under Section 6(1) of the R.T.I. Act, 2005, on 23-01-2013 to the Public Information Officer requesting information on 8 items. He has preferred a first appeal under Section 19 (1) of the Act on 01-02-2013. The petitioner/appellant’s second appeal dt.18-03- 2013 to this Commission is taken up for today’s enquiry.

4. During the enquiry, the Asst. Commissioner of Police of Cyber Crime Cell informed that the Cyber Crime Cell is not an independent identity and is not a recognized police station and therefore 2

the cell does not accept or register complaints from the public. He also informs that their cell assists the Commissioner of Police depending upon exigencies and as per the directions of the Commissioner if there is a technical issue. When the factual position is like this, it is not practically possible or feasible for the Public Information Officer of the Cyber Crime Cell from whom information have been sought for by the petitioner, to furnish information to the petitioner, more so, when the petitioner’s requests are all in the nature questions like ‘why the complaint registration of cyber crime cell is restricted from 10 a.m. to 1 p.m. and Saturday, Sunday also you have not received any complaint ?’ and so on. When the Cyber Crime Cell is not an independent identity, we cannot expect them to part with information for the queries which are not available in their domain. Hence, for the above reasons, this Commission is of the view that the petition itself is mis-conceived. Nothing further remains to be considered in this appeal and the same is therefore treated as closed.
