Official Contest Rules – Winnin with Finnin Giveaway The Official Contest Rules – Winnin With Finnin Giveaway The Company (Rainbow Oil Company) and its promotional partners (Mike Finnin Kia, Radio Dubuque and its stations: KDTH, WVRE, KAT-FM and KGRR) reserve the right to conduct contests in various forms which include, but is not limited to, in store, online, email, text, via the Company’s kiosks, or via social networking accounts (e.g., Facebook, Twitter). Each participant must agree to the following rules to participate in the Winnin with Finnin Giveaway. 1. By participating in this contest, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that he or she may sustain as a result of his or her participation in the contest and/or the use of any prize, and any damages or losses arising from the implementation or for carrying out of the contest or any participant’s failure to win the contest or receive the prize, and to release Kwik Stop, Dairy Queen, Fazolis, and the promotional partners identified herein and their parent companies, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability arising out of or connected in any way with his, her or its participation in the contest, even though that liability may arise out of an intentional act, omission, negligence or carelessness on the part of the persons or entities mentioned above. 2. No purchase is necessary to win. 3. Only one (1) winner per household for the duration of each individual contest. 4. Rainbo Oil Company reserves the right to limit the number of times an individual may enter a contest or drawing. 5. Employees of Rainbo Oil Company, their immediate families and all promotional partners and their immediate families are not eligible to participate. *The term “immediate family members” includes, but is not limited to, spouses, parents, in-law’s, siblings, grandparents, children, step children, grandchildren and significant others. The term “significant others” includes anyone residing in the same household as the employees identified herein. 6. Unless otherwise specified, only legal U.S. residents who are 18 years of age or older with a valid Social Security number at the time of entry are eligible to participate in Company contests. 7. As a condition to receiving the prize, proper identification as approved by Company must be presented by any winner to claim prize. 8. All winners must complete and sign a waiver if requested, releasing the Company and promotional partners from all liability in connection with the winner’s participation in the contest and acceptance, use, or non-use of the prize. 9. All entrants and winners agree that the Company and promotional partners shall have no liability for any and all injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest. 10. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued at $600.00 or more in a given calendar year will be issued a 1099 IRS Form to report their winnings. 11. The contest rules are established at the sole discretion of Company and its promotional partners. The process for choosing Semi-Finalists has been established at the sole discretion of the Company and its promotional partners and is not recited herein. Upon completion of the selection of the Semi-Finalists, Semi-Finalists may be required to attend or send a designated approved proxy to a “Grand Prize” event at 7 p.m. on October 3, 2019, at Finnin Kia, located at 4355 Dodge Street, Dubuque, Iowa, where the final drawing will take place. At this event one finalist will win a New Kia Forte (approximate value $17,400); second place will win Gas for a Year ($40 Kwik Stop gas card per week for 52 weeks), third place will win a driveaway vacation and $100 gas card from Kwik Stop; all other finalists will win $50 Kwik Stop Gas Card. A failure to attend or send a designated approved proxy may result in disqualification of the finalist. 12. The Company and its promotional partners reserve the right to publicize the winners’ names and or likeness’ and/or his/her/their voice in promotional materials. 13. Unless otherwise stated, the odds of winning a Company contest depend on a number of factors including, but not limited to, the number of eligible entries received and the number of listeners participating at any given time. 14. All prizes are subject to availability. There are no substitutions and prizes awarded may not be redeemed for cash. 15. The Company shall not be responsible for a failure of promotional partners to deliver the prizes or any part thereof. A promotional partner shall not be responsible for another promotional partners’ failure to deliver the prizes or any part thereof. 16. All entry information, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Company to be used, disposed of or destroyed in its sole discretion. 17. Potential contest winners will be selected by and at the Company’s and promotional partners’ sole discretion. If it is determined by the Company and its promotional partners that a candidate is not eligible to receive a prize, another candidate may be selected for eligibility and this process will continue until such time as an eligible candidate is found. 18. Individuals who deliberately circumvent, disrupt or damage the ordinary and normal operation of a station contest, telephone systems or websites, or undermine the legitimate operation of a Company contest are in violation of criminal and civil laws. Should such an attempt be made the Company and promotional partners reserve the right to seek damages to the fullest extent permitted by law. 19. In the instance where entry forms are used by promotional partners, only original entry forms are eligible, no copies or facsimiles will be accepted. 20. All decisions of the Company and its promotional partners are final. 21. A complete copy of these Standard Contest Rules can be obtained at the offices of Rainbo Oil Company, 2255 Kerper Blvd. Dubuque, IA 52002, during normal business hours Monday through Friday or by sending a self- addressed, stamped envelope to the above address. .
