Washburn Parish Council Meeting Washburn Parish Council Meeting: Full Council Date: 3rd September 2018 Venue: Robinson Library, Timble Commenced: 7.45 pm Concluded: 9.06 pm Members Cllr C Ryder (Chair) Present Cllrs M Ainsley, A Campbell, J Davison, G Hebblethwaite, A Johnson, S Ryder, F Walkinshaw, K Wilson In Attendance: Dr J Knowles (Parish Clerk), Cllr V Oldham (Harrogate Borough Council), Mr J King (Parish Caretaker) Members of the Public Wishing to Speak in relation to Item 28 – the Definitive Map Modification Order (DMMO) Application regarding Billy Lane, Great Timble Mr Mark Shields, Timble resident, requested further detail on what a restricted byway would mean in practice and understand the conditions on mechanically propelled vehicles. It was considered that any restrictions would be a loss of facility and at a real detriment to the people who live here. Ms Elaine Davis, Timble resident, echoed these views and added that she would like to know who owns the road and who would be responsible for blocking any access. She also felt there is a public safety issue with the state of the road presently. Page 8 Signed Date Council Year 2018/19 Full Council 3rd September 2018 Mrs Stephanie Shields, Timble resident, wanted to know if the lane is blocked what is the alternatives for vehicular movement to access properties and farmland. Mr Rob Aspbury, Timble resident, sought clarification on what is proposed as it would appear to be blocking access to farms and dwellings. Mr Neil Dickinson, Timble resident, felt that any restriction on the road would not be for the benefit of the majority. 19. Apologies Received from: Cllr H Barker 20. Declarations of Interest No declarations of interest, of any nature, were received. 21. Minutes for approval: Resolved: the minutes of Full Council on 2nd July 2018 were approved for accuracy by Cllr J Davison and seconded by Cllr M Ainsley, agreed unanimously and signed by the Chair 22. General Matters arising from the Minutes No matters arising Page 9 Signed Date Council Year 2018/19 Full Council 3rd September 2018 23. A59 Kex Gill realignment No update to report. The Clerk was requested to make enquiries as to when the planned repairs are to take place at Kex Gill and the likely timescales involved. 24. Police Matters There were no Police in attendance. There were four reported crimes during June: 1 x theft in Blubberhouses of salt grit; 1 x criminal damage at Kex Gill; 1 x arson at Lindley Reservoir; and, 1 x Other offences at Stainburn Forest of fly tipping. 25. County and Borough Matters Cllr V Oldham outlined that it has been a quiet few months. The Harrogate Lottery commences next week. There are a number of Heritage Open Days coming up including Harrogate Civic Centre. The Sunday Bus Services have been very successful with plans to continue to offer the service in 2019. There are efforts to look for pockets of land to provide more social housing throughout the district. 26. Planning Application Decisions No planning decisions to report 28. Correspondence Received The following correspondence was received (26.06.18 – 26.08.18): 1. North Yorkshire County Council – Definitive Map Modification Order (DMMO) Application regarding Billy Lane, Great Timble The Clerk read the letter received from North Yorkshire County Council and informed the meeting of two communications received and forwarded to councillors Cllr A Campbell provided a synopsis of the background to the application and expressed disappointed that the BOAT application had missed the required timescales. Cllr Campbell wished to understand how the Parish Council would make representations to the Planning Inspector, identifying that the majority of residents are opposed to the restricted byway proposal. Cllr V Oldham commented whether the option for a Statutory Declaration would be possible. Cllr A Johnson asked whether the Parish Meeting Minutes of 2004/2005 could be used as evidence with regards to the request for the BOAT application. Page 11 Signed Date Council Year 2018/19 Full Council 3rd September 2018 Cllr J Davison reiterated that the majority of residents are opposed to the restricted byway proposal and requested that clarification be sought on what evidence is needed to build the case. In addition, clarification on what the restrictions would be on the byway and whether there is any flexibility that would allow vehicular access. Also, to explore who is the owner of the road as repairs are needed. Cllr A Johnson would also like clarification on the deadline for responses. In response to the letter received from North Yorkshire County Council the Clerk requested whether or not the Council wished to respond. Resolved: Washburn Parish Council wishes to maintain its objection to the current Order which will record a Restricted Byway on Billy Lane, Great Timble 2. Strimming and cutting back at Norwood, Fewston and Timble 2. Supply and fit of new water butt at Fewston Cemetery 3. Supply and painting of benches at Fewston Cemetery New issues requiring action: 1. Otley to Timble crossroads – obscured sign needs trimmed 2. Inspection and maintenance of assets 31. Grass Cutting The grass cut in the Parish has been undertaken by Hesseldens. They were requested to re-do North Lane. The Clerk is requested to get costs for grass cuts from contractors for next year. Resolved: (1) that any three from four authorised signatories can sign cheques on behalf of Washburn Parish Council (2) authorised signatories to be: Cllr C Ryder (Chair), Cllr J Davison, Cllr K Wilson and Dr J Knowles (Clerk) 33. Viewfinder The damage to the viewfinder is considerable but the Council agreed that they wish to see it repaired. Councillors agreed that Cllr F Walkinshaw would contact Sign Language with regards to exploring the costs of using different materials. 34. Commuted sums The Clerk confirmed that commuted sums had been secured for use at Fewston Cemetery. The Parish Caretaker has been working on the installation of a new water butt and the painting of the cemetery benches. 35. It is known as the Restricted Byway No 15.50/24 Billy Lane, Great Timble Modification Order 2010. • The Order is dated 2 February 2010. It proposes to modify the definitive map and statement for the area by adding a Restricted Byway linking Back Lane with Main Street as shown on the Order map and described in the Order schedule. • There were thirteen objections outstanding at the commencement of the Inquiry. There were also four representations in support of the Order outstanding at that time. Summary of Decision: The Order is confirmed. Background to the Order 1. The application was submitted by Washburn Parish Council on 18 August 2005 and initially sought the addition of the Order route as a byway open to all traffic (BOAT). The application was submitted after the deadline for such applications of 20 January 2005 established by the Natural Environment and Rural Communities Act 2006 (2006 Act). Accordingly, North Yorkshire County Council, as the Order-Making Authority (OMA), determined to record the Order route as a restricted byway. 2. The effect of section 67(1) of the 2006 Act is to extinguish public rights of way for mechanically propelled vehicles unless certain defined exceptions apply.
