I. Project Background

1. The Asian Development Bank’s (ADB) approved the Technical and Vocational Education and Training Sector Development Project (TVETSDP) on 26 September 2014, in the amount of Special Drawing Rights (SDR) 19,428,000 (USD 30 million equivalent), and comprised of a policy-based loan (USD 7 million equivalent) and a project loan (USD 23 million equivalent). The current project became effective on 9 January 2015.

2. On 17 June 2015, the AFD Board of Directors approved additional co-financing to the current project through a loan of USD 15 million equivalent to the Royal Government of Cambodia (RGC), to be administered by ADB. Building on the existing program design, the additional co-financing scaled up activities under the investment part of the current program (the policy-based component of the current program will be unchanged; the original policy matrix and disbursement triggers will be maintained). It focusses on upgrading learning environments and the capacity of TVET instructors, and providing stipends to disadvantaged students.

3. TVETSDP will support the Royal Government of Cambodia (RGC) to address equity and quality issues facing the technical vocational education and training (TVET) system through:  Increased access to TVET programs, particularly for women, the poor and indigenous people  Improved quality and relevance of the TVET system;  Increased involvement of employers in technical and vocational education and training delivery; and  Strengthened governance and management of TVET delivery.

4. The Project supports RGC’s commitment to the development of high-quality, skilled and capable human resources in order to meet the immediate and long-term needs of economic growth and socio-economic development.

Impact

5. The impact of the Project has been increased employability of TVET certified workers. The outcome of the Project will be an accessible, demand-driven TVET system responsive to continuing and emerging labour market demands.

6. The project has been delivered four outputs: (i) increased access to TVET programs, particularly for women and the poor; (ii) improved quality and relevance of the TVET system; (iii) increased involvement of employers in TVET delivery; and (iv) strengthened governance and management of the TVET system. While the Project’s impact and outcome statements will remain unaffected, the additional co-financing will benefit additional number of youth, including more vulnerable youth and females in Cambodia.

II. Project civil work descriptions

7. The TVETSDP and TVETSDP-AF projects have been made a provision to the following components: (i) construction of three women dormitories with water and sanitation packages in the Provincial Training Centers (PTCs) of Koh Kong, Polytechnic Institute of Banteay Meanchey, and NPIA in Siem Reap under TVETSDP, and three dormitories with water and sanitation packages in Kratie PTC, NVIB and Kandal PTC under TVETSDP-AF ; (ii) construction of nine workshops with specialized equipment packages at Polytechnic Institute (PI) of Banteay TVETSDP 4

Meanchey, Kampong Cham PI, Kampong Speu, Kampong Thom PI, Kandal, Koh Kong, PIP/Pursat, Siem Reap and Sihanoukville under TVETSDP; and other nine workshop at PTCs of , Tboung Khmum, Kratie, Kep, JVC in , Kampong Chhnang, NVIB, Pailin, and Oudar Meanchey under TVETSDP-AF; (iii) construction of additional building including workshops and classrooms at the Battambang Institute of Technology under TVETSDP, and at Tboung Khmum, NIEI in Phnom Penh, and NPIA/Siem Reap under TVETSDP-AF; and (iv) multi-storey building for new DGTVET Head Quarter (20x40=800 sq.m per floor). 8. The workshop building, classroom and an upgrading buildings have been built and upgrading in Public TVET Institutions. The buildings are constructed on the existing campuses and no land acquisition is expected. There is no involuntary resettlement. Thorough assessment also indicated that no indigenous people are residing within Public TVET Institutions campuses and their vicinity. By using ADB's Classification System, the public TVET Institutions are classified under category C. Therefore, under Category C do not require Resettlement Action Plan but just prepared this Due Diligence Report.

III. Project Locations

9. The location of Directorate General of Technical Vocational Education and Training (DGTVET) is located along Russian Blvd/ No.09, Sangkat Toek Laak I, Khan Toul Kouk, Phnom Penh. The master plan of GDTVET has fencing enclosure and it is state-own land of the Ministry of Labour and Vocational Training and the total area is 27,912m². a multi-storey building for new DGTVET Head Quarter (20x40=800 m² per floor) will be built and the existing DGTVET building will be demolished (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

10. The location of National Polytechnic Institute of Angkor (NPIA) is located in Prey Kuy village, Ampil commune, , in . The Master plan of NPIA is enclosure fencing with land title certificate from Provincial Department of Land Management Urban Planning and Construction. Its premise area is 20,070m². The buildings have been constructed are workshop with an area of 350m², new building with total area of 1,000m² to 1,200m², the woman dormitory building with total area of 1,000m² to 1,200m², COE building with area of 340m² and upgrading/amenities of building and premise. all new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

11. The location of National Vocational Institute of Battambang (NVIB)/Prey Konkla is located in Angdoung Pring village, Sangkat Ou Mal, and . The Master plan of NVIB/Prey Konkla has an area of 56,924m², with fencing and land titling. The workshop building will be constructed with an area of 350m². The women’s dormitory with an area of 1,000m² to 1,200m² and upgrading of building/amenities and premise. All new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

12. The location of Kandal PTC is located in Prek Samroang village, Sangkat Takhmao, Ta- khmao municipality and . The Master plan of Kandal PTC has an area of 36,000 m² with fencing. The workshop building has constructed with an area of 350m² and the women’s TVETSDP 6

dormitory will be built with an area of 1,000m² to 1,200m² and the upgrading buildings. all new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

13. The location of Kratie PTC is located in Ou Ruessey Pir (II) village, Sangkat Ou Ruessey, Kracheh municipality and Kratie province. The Master plan of Kratie PTC has an area of 4,669.06 m², with fencing. The workshop will be constructed with an area of 350m² and the women’s dormitory with an area of 1,000m² to 1,200m² and upgrading of building/amenities and premise. all new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

14. The location of Pailin PTC is located in Ou Tatouk Kroam village, Sangkat Toul Lvea and Pailin municipality. The Master plan of Pailin PTC has fencing and land title is under proceeding. The premise area is 3,000m². The workshop building will be built with an area of 350 m² and upgrading of building/amenities and premise. all new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

15. The location of Kampong Chhnang PTC is located in Toul Kralanh village, Sangkat Kampong Chhnang and Kampong Chhnang municipality. The premise of Kampong Chhnang PTC has fencing enclosed. The master plan area is 10,718.5m². The workshop building will be built with area of 350 m² and upgrading of building/amenities and premise. All new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

16. The location of Tboung Khmum PTC is located in Nikum Leu village, Srolop commune, Tboung Khmum district and province. The campus of Tboung Khmum PTC has an area of 17,084.77m², with fencing. The new building will be constructed with an area of 1,000m² to 1,200m². Workshop building will be built with an area of 350m² and upgrading of building/amenities and premise. 17. The location of Koh Kong PTC is located in Phum Mouy (1) village, Sangkat Smach Mean Chey, Khemarak Phumin municipality and . The Master plan of Koh Kong PTC with area of 4,238.32m². It has fencing enclosure. The building will be built are workshop with area of 350m², dormitory with area of 1,000m² to 1,200m² and upgrading of building/amenities and premise. 18. The location of Prey Veng PTC is located in Phum Mouy village, Sangkat Kampong Leav and Prey Veng municipality. The Master plan of Prey Veng PTC has fencing and land title is under proceeding. The master plan area is approximate 4,085m². The workshop building will be built with an area of 350 m² and upgrading of building/amenities and premise. 19. The location of Otdar Mean Chey PTC is located in Borey Rathabal village, Sangkat Sam Roang and Samroang municipality. The Master plan of Ouddar Mean Chey PTC has fencing and land title is under proceeding. The master plan area is approximate 3,000m². The workshop building will be built with an area of 350 m² and upgrading of building/amenities and premise. 20. The location of Kep PTC is located in Phum Thmei village, Sangkat Prey Thum, Krong Kep in . The Master plan of Kep PTC has fencing with an area of 5,680m². The workshop building will be built with an area of 350 m² and upgrading of building/amenities and premise. 21. The location of Japan Vocational Center (JVC) campus is located in Sangkat and Khan Chroy Changva. Phnom Penh, along National Road 6A. The Master plan of JVC has fencing enclosure with an area of 15,000m² and land title certificate. The workshop building will be built with an area of 350 m² and upgrading of building/amenities and premise. 22. The location of Kampong Cham Polytechnic Institute is located in Boeng Kok Pir (II) village, Sangkat Boeng Kok, Kampong Cham municipality and . The Master plan of Kampong Cham second PTC campus with area of 7,000m², It has fencing enclosure. The building was built is the workshop building with 350m² and upgrading of building/amenities and premise. 23. The location of Kampong Thom Polytechnic Institute is located in Acha Leak village, Sangkat Acha Leak, Stoeng Sen municipality and . The master plan of Kampong Thom PTC with area of 20,640m². The building was built is the workshop building with area of 350m² and upgrading of building/amenities and premise. All new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

24. The location of Banteay Mean Chey Polytechnic Institute is located in Keap village, Sangkat Toek Thla, Sereisaophoan municipality and Banteay Mean Chey province. The Master plan of Banteay Mean Chey PTC with area of 7,408m² and it has fencing enclosure. The workshop with area of 350m² and dormitory with area of 1,000m² to 1,200m² have been built and upgrading of building/amenities and premise. All new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

25. The location of Polytechnic Institute of Pursat Province/PIPP is located in Chamcar Chek Khang Tboung village, Sangkat Phteah Prey, and Pursat province. The Master plan of Pursat PTC has fencing enclosure. The master plan area is 9,000m². The workshop building was built with area of 350m² and upgrading of building/amenities and premise. All new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

26. The Polytechnic Institute of Preah Sihanouk Province campus is located in Dompram (15) village, Sangkat Bei (3) and Krong Preah Sihanouk in Preah Sihanouk province. The master plan area is 7,352m². The workshop building was built with area of 350m² and upgrading of building/amenities and premise. All new buildings are constructed in the designated vacant land of Institute (see in master plan, with detailed designs and approved by Project Director, His Excellency Secretary of State).

27. The Kampong Speu PTC campus is located in Tumpung village, Kahaeng commune, Samroang Tung district in . The master plan area is 14, 375m². IV. Objectives of due diligence report

28. The objectives of DDR is to provide a detailed involuntary resettlement (IR) Categorization for upgrading works No.2 and a proposed multi-storey building for new DGTVET Head Quarter in Phnom Penh.

29. This due diligence process for IR categorization on upgrading woks No.2 and the proposed multi-storey building for new DGTVET Head Quarter covers the following: (i) determine whether the project will have any involuntary resettlement (IR) impacts; (ii) identify any relevant actions needed to ensure the impacts are properly documented; (iii) define mitigation measures; and (iv) ensure required safeguards documents are prepared in accordance with the ADB’s Safeguard Policy Statement (SPS 2009) and laws of the Royal Government of Cambodia (RGC).

V. Methodology

30. The methodologies used for this DDR are the following:

1. Data reviews:

 Desk reviewed were carried out in GDTVET i.e. Safeguard Policy Statement of ADB 2009, IPP Oct 2015, and  Review of technical detailed designs/drawings, master plans, and location plans and other related documents to Project of buildings constructions. 2. Meetings and consultations

 Primary stakeholder meetings and conducting screening checklists with all public TVET Institutions’ directors, deputy directors and other involved staff.

VI. Findings from field visits consultations and disclosure 31. Project Engineers, site engineers together with procurement officers of TVETSDP, often, conducted field visits to Public TVET Institutions in relation to social and environmental issues, to assess and updating the status of the locations of new building constructions, upgrading works and the proposed DGTVET Head Quarter Office/multi-storey building. The site visits and investigations are delineated as following:

VII. Grievance redress mechanism

32. A well-defined grievance redress and resolution mechanism has been established to address Likely Affected Households (LAH) or Persons grievances and complaints regarding civil work implementation. This mechanism covers environmental as well as other types of grievances associated with the project. The procedures for grievance redress are set out below: Stage 1: Likely Affected Household (LAH)/person will submit a letter of complaints/requests to the PTC community relations grievance committee and the PTC will be obliged to provide immediate written confirmation of receiving the complaint. If after 7 days the aggrieved AH does not hear from PTC community relations, or if the AH is not satisfied with the decision taken by in the first stage, the complaint may be brought to the Department of TVET Management in DGTVET. Stage 2: The Department of TVET Management in DGTVET has 15 days within which to resolve the complaint to the satisfaction of all concerned. If the complaints cannot be solved in this stage, the Department of TVET Management in DGTVET will bring the case to the PCU. Stage 3: The PCU meets with the aggrieved party and tries to resolve the complaint. Within 30 days of the submission of the grievance, the PCU shall implement the decision.

VIII. Legal Framework and Policies

8.1. Government’s Legal Framework

33. The 1993 Constitution of Cambodia sets two basic principles for land acquisition. The first is Article 44 which states that the “right to confiscate properties from any person shall be exercised only in the public interest as provided by law and shall require fair and just compensation in advance” (Article 44). The second principle is Article 20, which stipulates that “nobody shall be forced to transfer his or her ownership, if forcing is not necessary in the public interest and (if) no proper and just indemnity has been paid to the owner”. These two principles are also adhered to in almost all countries.

34. Meanwhile, Articles 73 and 74 of the Constitution provide for special consideration and support to vulnerable people including mothers and children, the disabled and families of combatants who sacrificed their lives for the nation. Indigenous minorities however are not explicitly included in these two articles but included in the Land Law.

8.2. Land Law in 2001

35. The 2001 Land Law governs land and property rights in Cambodia. Based on the provisions of the 1993 Constitution, it defines the regime of ownership of immovable properties, such as land, trees and fixed structures.

36. The rights and responsibilities of the Government with respect to eminent domain are specified in the Land Law. The Government can acquire private land for public purposes but has to pay a fair and just compensation in advance of the land acquisition. The Land Law, Article 5, states that “No person may be deprived of his ownership, unless it is in the public interest. An

ownership deprivation shall be carried out in accordance with the forms and procedures provided by law and regulations and after the payment of fair and just compensation in advance.” 8.3. Resettlement Policy in Cambodia:

37. Sub-Decree No.19 March 2003, for instance, provides the condition within which landless families displaced by public development projects may acquire land on which to shift (Article3). There is, however; no formally established national policy for resettlement in Cambodia, and a policy to that effect was reviewed or monitored by the Inter-Ministerial Resettlement Committee (IRC) chaired by the Ministry of Economy and Finance (MEF). A consultative report setting out the proposed policy on Involuntary Resettlement has the following main provisions being reviewed:

1) Displacement will be reduced or avoided as much as possible by sensitive design of the civil engineering works; 2) The area to be cleared will be limited to the width required for the construction itself and for the construction to proceed; 3) Land replacement for land is the preferred option and any replacement will be based on present market value plus a margin for losing of future earnings; 4) Affected persons and host communities shall be encouraged to participate in the design and implementation of the resettlement plan; 5) Compensation for affected persons will not be reduced to reflect depreciation.

8.4. ADB’s Policies

38. The following summarizes the key ADB policies relevant to the preparation of Resettlement Plan for the project. The resettlement categorization report has been prepared based on ABD’s Policy on Involuntary Resettlement. The main purpose of this policy are to (1) avoid land acquisition and involuntary resettlement wherever feasible; (2) minimize it where it is unavoidable and insure that AHs or AP receive assistance, so that they would be at least as well off as they would have been in the absence of the project.

IX. IMPLEMENTATION ARRANGEMENTS 39. Ministry of Labour and Vocational Training (MLVT) is the Executing Agency (EA) and DGTVET is the implementing agencies (IA). DGTVET is responsible for overall supervision, monitoring, and timely reporting on all program activities and ensure that the program is implemented in accordance with the loan agreement. The IA is responsible for the day-to-day coordination and supervision of program and project activities at the national and subnational levels. The IA and relevant technical departments is responsible for implementation of policies and investment activities under the project/program.

X. IMPLEMENTATION SCHEDULE 40. The proposed implementation of the construction of civil works includes multi-storey upgrading buildings/amenities and proposed DGTVET multi-storey building are on 2019 to 2021

XI. CONCLUSIONS

41. The civil works under the project/program includes new DGTVET building/multi- storey building, and upgrading works/activities for 18 Public TVET Institutions..

42. The locations of the construction activities are on existing location of DGTVET building and they are government-owned land and access to the project sites are through existing public roads, hence, land acquisition and encroachment on private property could not occur.

43. Legal land tenure status of TVET institutions are in the form of land title certificates from the Land Management Urban Planning, Construction and Cadastre of each provincial/capital city of Phnom Penh as attached in this document. However, fewer institutions like PTCs in Pailin, Kep and Koh Kong are in the process to obtaining land title certificates.

44. The additional scope on the construction of new DGTVET building and upgrading works/activities of 18 TVET institutions are not involved in any form of land acquisition and involuntary resettlement where all the works are strictly within the existing Public TVET Institutions and DGTVET/MLVT, nor restricts access to land use, legally designated parks, protected areas, wetlands, cultural/archaeological/worship places.
