The Governing Body (G.B) will review the performance of Access to Justice Development Fund (AJDF). The meeting will be attended by Mr. Justice Mian Shakirullah Jan, former Judge, Supreme Court of Pakistan/Member Law and Justice Commission of Pakistan, Mr. Justice M. The Access to Justice Development Fund is a statutory Endowment established by the Government of Pakistan to address issue of chronic budgetary constraints being faced by the judicial and legal sectors in Pakistan. The meeting of the Governing Body Access to Justice Development Fund (AJDF) will be followed by a meeting of the National Judicial (Policy Making) Committee (NJPMC) which will be attended by the Hon’ble Chief Justices of the Superior Judiciary.     ROLE OF JUDICIARY AND JURISPRUDENCE IN DOMESTIC AND INTERNATIONAL ARBITRATION* by Justice Jawad Hassan** Introduction Today I will discuss an aspect of arbitration and its impact in Pakistan. Courts in different national systems throughout the world vary with respect to how interventionist they are in the arbitral process. In recent decades, ever since Pakistan has entered the new world of international trade, the role of judiciary in the matter of arbitration has gradually been the subject of much debate, as a result of a number of various decisions given by the courts. Is the role that has been played by the judiciary justified? I must confess that my perspective and vision being a counsel in number of international arbitrations (pre, during and post arbitration) has totally changed since my elevation to the Bench. There is a very interesting observation in paragraph 7.01 of Redfern and Hunter on International Arbitration: Sixth Edition: Oxford University Press. The observation is as follows:- “The relationship between national courts and arbitral tribunals swings between forced cohabitation and true partnership.” We shall now look into various arbitration decisions passed by the Pakistani Courts, then venture into the challenges faced by the legal fraternity of Pakistan in arbitration, followed by the need for judicial training and other ancillary matters before concluding this paper. Role of Pakistan and the International Arbitration since 2005 After ratifying the New York Convention, Pakistan first brought the Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Ordinance, 2005 (“2005 Ordinance”) which was eventually promulgated as an Act in 2011 called the Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Act, 2011 (the “2011 Act”).

Resultantly, the Task Force gave eight point recommendations specifying clear priorities, roles, responsibilities and timeline for action. The Hon’ble Supreme Court endorsed the recommendations and directed that the same be placed before the Council of Common Interest (CCI) and the CCI was pleased to approve all the recommendations in its meeting dated 19-11-2018. The case is formally titled District Bar Rawalpindi v. Federation of Pakistan but is referred to in this paper as the ‘Amendments case’. The Amendments case directly addressed the question: is there such a thing as an unconstitutional constitutional amendment in Pakistani law? The opinions of the different Justices on this question were highly divided. This paper analyses and critiques the opinions of three of the Justices to ascertain the position of Pakistani constitutional law on the subject of unconstitutional constitutional amendments.
