AN ACT to amend the Workers' Compensation Act 1927 to make provision for additional diseases to be diseases for the purposes of that Act. [Royal Assent 26 ]

BE it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:-

Leptospirosis. Avascular necrosis. Serum hepatitis. Diseases resulting from exposure to, or inhalation of, asbestos fibres or asbestos dust, including, without prejudice to the generality of the foregoing words, asbestosis and mesothelioma.

()peratiOll of amendments. 4-( 1) Subject to this section, compensation is payable under the Principal Act, as amended by this Act, in respect of the dis­ ablement of a worker by a disease mentioned in section 3 of this Act, notwithstanding that the disease arose out of and in the course of the worker's employment before the commencement of this Act.

( 2) A worker whose name is specified in column 1 of Schedule 1 and who, before the commencement of this Act, suffered from a disease that is specified in column 2 of that Schedule in relation to that worker and that arose out of and in the course of his employ­ ment with the employer whose name is specified in column 3 of that Schedule in relation to that worker is entitled to be paid com­ pensation by that employer, being compensation- ( a) of the amount specified in column 4 of Schedule 1 in relation to that worker; and (b) in respect of the period or periods of disablement that is, or that are, specified in column 5 of Schedule 1 in relation to that worker.

( 3) Except as provided by subsection (2), a worker suffering from a disease mentioned in section 3 of this Act is not entitled to be paid compensation under the Principal Act, as amended by this Act, in respect of a period of disablement, or part of a period of disablement, due to that disease that occurred before the com­ mencement of this Act.
