EXECUTIVE SUMMARY Although Ballot Measure 9 was defeated in November 1992, it caused consid- erable debate and divisiveness throughout Oregon. The ballot measure sought to prohibit state and local governments in Oregon from protecting homosexuals through civil rights laws, to force government agencies and schools to categorize homosexuality as "abnormal, wrong, unnatural, and perverse," and to teach that "these behaviors are to be discouraged and avoided." In the debate over the ballot measure there were many arguments and counter arguments. Because issues relating to the ballot measure and political activity concerning rights of homosexuals continues, the City Club initiated this study to research issues concerning homosexuality. The study objectives were: 1. To provide factual underpinnings to assist in sound public policy development. 2. To make recommendations that are factually grounded that would reduce divisiveness. 3. To provide information that can inform future discussions and debates. The committee investigated historical and scientific information concerning homosexuality, including its nature and role in society. The report focuses on three areas of concern regarding homosexuality: children and adolescents, the work environment, and the contentious issues surrounding the "equal rights vs. special rights" debate. Our key findings are: 1. There is a strong biological component in the origins of homosexuality. The weight of medical and psychological opinion is that homosexuality is not a neural or psychological disorder. Sexual orientation appears to be more like an immutable trait than a matter of personal choice. 2. In school and work environments, conduct-based standards have been an effective way to deal with value-related issues such as homosexuality. Conduct-based standards describe categories of inappropriate behavior including personal harassment, abuse of authority, displays of affection, and explicit discussions of sexual practices. 3. Some public schools, including the Portland Public School District, have developed protocols for handling questions about value-laden issues such as homosexuality under which teachers respond to factual questions raised by students and encourage students to discuss the underlying value issues with their parents, religious leaders, or other responsible adults. 4. Some youths identify themselves as homosexual or are uneasy or confused about their evolving sexual orientation. These youth are at high risk of drop- ping out of school, becoming homeless, drug dependent, or suicidal. 5. Problems due to workers' lack of acceptance of homosexual co-workers have not been widespread and are not identified among the leading concerns of workers. Group cohesion and productivity is increased when leadership sets the tone and consistently requires conduct-based standards. 6. Homosexuals currently have no general protection from discrimination under federal or Oregon state law. The cities of Portland, Ashland and Corvallis have ordinances prohibiting discrimination against homosexuals. 28 CITY CLUB OF PORTLAND BULLETIN 7. Many people fear that anti-discrimination laws protecting homosexuals may lead to affirmative action requirements or quotas. However, the Committee believes affirmative action or quotas for homosexuals would be extremely difficult, if not impossible, to enforce since it is not reliably known what percent of the general population or any particular organization is homosexual. The report recommends: 1. Oregon should pass a state constitutional amendment that prohibits intentional discrimination based on sexual orientation in employment, housing and public accommodations. The amendment should also provide that affirmative action programs, hiring quotas, and discrimination-based hiring preferences should not be afforded based on sexual orientation. 2. Oregon state school systems should implement a model like Portland School District's, which refers students to family, clergy and other trusted adults on sensitive issues such as homosexuality. The model should include its "Values Question Protocol" and "conduct-based" standards for acceptable conduct within school. Teachers and counselors should be provided increased training on effectively implementing the protocol related to human sexuality and sexual orientation. 3. State agencies that study and provide services for at-risk youth should acknowledge and adequately address the unique problems associated with homosexual youth. 4. Business leaders should recognize their role in promoting group cohesion within the workplace by developing "conduct-based" standards regarding homosexuality such as those recommended by the RAND study. These should be used in the workplace to maintain group cohesion and productivity when addressing issues concerning sexual orientation. These standards should focus on the job to be done and the kinds of professional interpersonal behaviors that are and are not acceptable. These standards should stress that people do not have to like each other to be able to work together effectively, but that they must accept the objectives of the group and the required conduct-based standards. II. INTRODUCTION A. Introduction to the Study In March of 1993, the Board of Governors of the City Club of Portland charged this committee with preparing a study presenting an unbiased, factual report on key public policy issues related to homosexuality in Oregon. This decision was made following the defeat of Oregon State Ballot Measure 9 in November of 1992. Measure 9 sought to prohibit sexual orientation from being included as a protected class under state law, to force government agencies and schools to categorize homosexuality as "abnormal, wrong, unnatural, and perverse," and to teach that "these behaviors are to be discouraged and avoided." This measure drew substantial political attention, both within and outside the state. The City Club issued a ballot measure study recommending against its passage. Homosexual rights is a divisive and controversial issue. Advocates of homosexual rights have been lobbying for legal protection in the Oregon legislature for many years. Opponents of homosexual rights have advocated against legal protection for homosexuals in cities and counties statewide, and a revised state CITY CLUB OF PORTLAND BULLETIN 19 ballot measure petition is currently being circulated. What becomes clear in these debates is the wide range of views on homosexuality, from those who believe it is a sin or morally wrong to those who believe it is just as moral and deserving of societal protection as heterosexuality. Still others are undecided. Both national and local debates on homosexuality are frequently clouded with disagreements of fact. In addition, there has been heated, inflammatory and mis- leading political rhetoric on both sides of the issue. This political material and rhetoric has portrayed the opposition in terms which apply, at most, only to a small minority of extremists. For example, proponents of Measure 9 and the more recent initiatives have been compared to Ku Klux Klan members and Nazis, while oppo- nents have been characterized as pedophiles and exhibitionists.     Courtesy of the Rural Organizing Project The Rise and Fall of “No Special Rights” WILLIAM SCHULTZ THE OREGONIAN, the largest newspaper in the state, delivered a bracing message to readers from its editorial page the morning of October 11, 1992: “Oregon faces a clear and present danger of becoming the first state since the Civil War to withdraw civil rights instead of adding to them.” The editorial warned that Oregon’s ballot would include a “ghastly gospel” promoted by “would-be ayatollahs.” The official name for this “ghastly gospel” was Mea- sure 9, and the “ayatollahs” were its sponsors, the Oregon Citizens Alliance (OCA).1 As it appeared on the Oregon ballot, Measure 9 asked voters: “Shall THE COLUMBIA COUNTY CITIZENS FOR HUMAN DIGNITY group of Oregon formed in [the state] Constitution be amended to require that all governments discourage 1992 in response to Oregon Measure 9, a campaign to amend the Oregon Constitution to require homosexuality, other listed ‘behaviors,’ and not facilitate or recognize them?” discrimination on the basis of sexual orientation.     SCOTT LIVELY 1 IS ONE OF AMERICA’S MOST NOTORIOUS EXPORTERS OF HATE. fter building a career as an anti-LGBT activist in Oregon and California, Scott Lively moved back to his birth state — Massachusetts — where he continues his anti-LGBT work. Lively describes being gay as a “personality disorder” and his struggle against equality as “a war” in which only one side can prevail, but perhaps his most offensive belief A is that gay men were the cause of the Holocaust and the Rwandan genocide. In the U.S., Lively is largely considered a fringe extremist, even by other anti-LGBT activists, but he has never been content to spread extremism and hate at home. He first traveled to Uganda in 2002 to warn about the LGBT menace to that country and he returned in 2009 to headline a conference on “the dangers of homosexuality.” Many Ugandan activists believe that he was one of the inspirations for the harsh anti-homosexuality bill that was enacted in 2014, which punishes same sex intimacy with penalties that can include life in prison. Lively has also been a frequent visitor to Eastern Europe, where he spent months in 2006-2007 on a 50-city tour of the former Soviet Union. Wherever he goes, Lively presents himself as a world renowned expert on LGBT issues and urges policymakers to pass laws that crack down on LGBT rights and the right of free expression. Lively takes personal credit for the passage of the Russian “gay propaganda” law, which he says he proposed back in 2007.

With a population of almost 600,000 people, Portland is Oregon's largest city. The Portland metropolitan area is the country's 23rd most populous metropolitan area, with more than 2.2 million people. Known for its green spaces and its environmentally-friendly ethos, Portland is also renowned for its lively art and music scenes and its embrace of quirkiness and individuality. The city is home to a thriving and increasingly visible queer community that has provided leadership for Oregon glbtq activism since the late 1960s. Despite concerted efforts by a determined anti-gay movement that has attempted to suppress gay rights in Oregon, the Portland queer community has become a vital element in the state's complex politics and in the city's rich diversity. According to Gary Gates's analysis of the 2006 American Community Survey, the City of Portland ranks seventh in the country in terms of glbtq population, with 8.8% of adult residents identifying as lesbian, gay, or bisexual; the Portland metropolitan area ranks fourth among metropolitan areas, with 6.1% of the population identifying as lesbian, gay, or bisexual.

These two organizations—CAUSA and the Rural Organizing Project (ROP)—have logged significant successes in stopping national, state, and local efforts to limit the rights of Latino immigrants, gay and lesbian citizens, and those who are working for economic and social justice. The challenges the two organizations face in their collaborations based on the social, cultural, and economic differences of their constituents and the way they frame and conceptualize each other’s struggles are an important focus. Specifically, the difficulties of Latino and Anglo collaboration at the local level are examined in two case studies in Medford and Forest Grove. The report then focuses on values and political strategies shared by the leaders of ROP and CAUSA . Shared underlying social values and political strategies are crucial elements in how and why ROP and CAUSA have been able to learn how to be effective allies for one another. To illustrate how this has worked, two specific cases of successful collaboration are looked at in depth. The first involved the defeat of a national piece of legislation to introduce a guestworker program know by activists as “The New Bracero program” in 1997 and 1998. The second was a state-wide initiative in 2000 to prohibit public school teachers and employees from teaching about, promoting or recognizing homosexuality in public schools.

Drawing from multi-disciplinary literature that documents the central role played by issue framing and discourse construction in political conflicts, I use the case ofthe 1994 campaign in which key crime initiatives were passed by Oregon voters. The thesis argues that policy decisions and election outcomes are closely related to long-standing perceptions of"insiders" and "outsiders" as a way to view societal problems.

LIPIN n AND WILLIAM LUNCH h i s t o r i c a Moralistic Direct l q Democracy u a r t Political Insurgents, Religion, and the State e r l in Twentieth-Century Oregon y OREGOn’s REPUTATION FOR political innovation dates back to the implementation of the system of “direct democracy” embodied by the initiative and referendum systems that were established early in the twentieth century, transforming a constitution that in its original writing reflected s t less originality than commitment to older, eighteenth-century ideals. No a state has utilized these tools more than Oregon, and no other state was t e earlier in its usage.2 Among the states that have had the initiative available, h more have appeared on the Oregon ballot, 39, than in any other since the o o system began in the early twentieth century; only California is close with d 33.3 Yet, the patterns have not been consistent, as usage of the tools of direct democracy have waxed and waned over the century since their adoption. s e More precisely, there have been two significant waves of heavy usage, at the s beginning and end of the twentieth century. Political scientist Richard Ellis q u points out that more measures appeared on the Oregon ballot between 906 i and 914 than for the entire period between 920 and 969 and that during the c e 980s and 990s, more measures passed than in the previous six decades.
