The development shall be carried out in accordance with the phasing details approved under this condition unless otherwise agreed in writing by the Local Planning Authority.

The phasing of the development shall be in accordance with the locations shown of Drawing No KN/LRIP/10016, as follows:

a) Laver Flood Storage Site (Birkby Nab)(Drg No 10017) b) Borrage Lane (Drg Nos 10018 & 10019) c) Alma Weir (Drg No 10020) d) Fisher Green (Drg No 10021) e) North Bridge (Drg No 10022) 4 No development shall take place within the application site until the applicant has secured the implementation of a programme of archaeological works in accordance with a written scheme of investigation submitted by the applicant and approved by the Local Planning Authority. 5 A detailed scheme for landscaping for each phase of the development, including the planting of trees and/or shrubs and the use of surface materials shall be submitted to the Local Planning Authority and no development shall take place on that phase until the Local Planning Authority have approved a landscaping scheme; such scheme shall specify materials, species, tree and plant sizes, numbers and planting densities, and the timing of implementation of the scheme, including any earthworks required. 6 CL01X RETAINED TREES AS PART OF RESRVD MATTERS … 5 7 No works or development shall take place on each phase until full details of all proposed tree planting, and the proposed times of planting, have been approved in writing by the local planning authority, and all tree planting shall be carried out in accordance with those details and at those times.

8 (a) No retained tree shall be cut down, uprooted or destroyed, nor shall any retained tree be topped or lopped other than in accordance with the approved plans and particulars, without the written approval of the local planning authority. Any topping or lopping approved shall be carried out in accordance with British Standard 3998 (Tree Work).

(b) If any retained tree is removed, uprooted or destroyed or dies, another tree shall be planted at the same place and that tree shall be of such size and species, and shall be planted at such time, as may be specified in writing by the local planning authority.

In this condition "retained tree" means an existing tree which is to be retained in accordance with the approved plans and particulars; and paragraphs (a) and (b) above shall have effect until the expiration of two years from the completion of the development. 9 CL04 REPLANTING IF ANY TREES/SHRUBS DIE 10 CL11 FENCE TO PROTECT TREES/SHRUBS DURING DEV 11 Surveys shall be carried out to establish the condition of the carriageways at Galphay Lane/River View Road/Fisher Green before and after the carrying out of development. The applicant shall undertake any repairs/remedial works identified as being a consequence of the extra traffic associated with the development. (Birkby Nab, Fisher Green and North Bridge sites only). 12 Prior to construction of the proposed embankment the access of Galphay Lane shall be laid out to the dimensions for a farm/industrial access (see attached Drawing E2). The construction of the access could be of a temporary nature to be maintained in safe condition at all times. On completion of the construction work the verge shall be reinstated to the satisfaction of the local planning authority in consolation with the Highway Authority. 13 The permanent access required for the future maintenance of the Birkby Nab site shall be laid out and constructed as a field access (see attached Drawing E1). 14 Prior to the commencement of the development hereby permitted visibility splays providing clear visibility of 2.4m x 120m measured down the centre line of the access road and the nearside channel line of the major road shall be provided at the junction of the access road with Galphay Lane. Once created, these visibility areas shall be maintained clear of any obstruction and retained for their intended purpose at all times. (Birkby Nab site only). 15 Details of the precautions to be taken to prevent the deposit of mud on public highways by vehicles travelling from each phase shall be submitted to and approved in writing by the Local Planning Authority. These facilities shall include the provision of wheel washing facilities where considered necessary by the Local Planning Authority. These precautions shall be made available before the development commences on each phase and be kept available and in full working order until such time as the Local Planning Authority agrees in writing to their withdrawal.

16 Prior to the commencement of the development at Birkby Nab details of the passing places and localised widening required on Galphay Lane shall be submitted to and approved by the Local Planning Authority in consultation with the Local Highway Authority. The approved passing places shall be provided and made available for use prior to the development at Birkby Nab being commenced and once created shall be maintained clear of any obstruction and retained for their purpose at all times. 17 Prior to the commencement of the development the passing places approved under the terms of Condition 16 shall be constructed in accordance with the approved details approved by the Local Planning Authority 18 The existing Public Rights of Way shall be protected and kept clear of any obstruction until such time as any alternative route has been provided and confirmed under an Order made under the Town and Country Planning Act 1990. 19 Prior to the commencement of the development a detailed method statement and traffic management scheme relating to the programme of building works shall be submitted to and approved in writing by the local planning authority. These shall include arrangements for bringing materials to the site, off-site and on-site storage, detailed requirements for on-street parking for loading and unloading in relation to the development's construction and the means of securing the safety of highway users. The approved details shall be implemented for the full duration of all works. (Fisher Green, Alma Weir and North Bridge sites only). 20 No other part of the development shall be commenced until the temporary crossing of the highway verge and/or footpath has been constructed in accordance with the approved details and the Specification of the Local Highway Authority. Before the development is brought into use the highway verge/footway shall be fully reinstated in accordance with the approved details and the Specification of the Local Highway Authority. (Borrage Lane, Alma Weir and North Bridge only).

21 The development shall not be commenced until full details of facilities for the access, parking, turning, manoeuvring, loading and unloading of all vehicles using the site have been submitted to and been approved in writing by the Local Planning Authority in consultation with the Local Highway Authority. Such arrangements shall provide satisfactory accommodation for the vehicles of staff and visitors. These facilities shall be provided, laid out, hard surfaced and drained in accordance with the details so approved before the development is first brought into use unless otherwise approved by the Local Planning Authority. Once created these areas shall be maintained clear of any obstruction and retained for their intended purpose at all times. (Alma Weir only). 22 CB05A BUNDING OF TANKS 23 Prior to the commencement of the development at Fisher Green details of the road hump and garden access improvements on Priest Lane shall be submitted to and approved by the Local Planning Authority in consultation with the Local Highway Authority. The approved scheme shall be retained throughout the construction period for that phase. 27 Prior to commencement of the Laver Flood Storage site details of a proposed planting and management scheme covering 1ha of Field 'H', identified on Drawing No KN/LR1P/10603A rev 3, shall be submitted to and approved in writing by the local planning authority in consultation with Natural . The planting scheme shall be carried out in accordance with the approved details during the first planting season after the completion of the embankment, and the site shall thereafter be managed in accordance with the approved scheme of management. 28 Prior to development commencing a generic method statement relating to the protection of trees during construction shall be submitted for the written approval of the Local Planning Authority and once approved shall thereafter be adhered to unless a site specific difference has been agreed in writing with the Local Planning Authority. 29 Notwithstanding Condition 28 above, site specific method statements shall be prepared for the Birkby Nab and Fisher Green areas of the scheme in order to protect the trees during construction works. Such schemes shall be prepared by an arboricultural specialist in consultation with the site engineers in order to ensure that the tree protection measures are practical and achievable. The scheme shall be submitted for the written approval of the local planning authority prior to work commencing at either of the sites to which the particular statement relates and, once approved, shall be strictly adhered to unless the prior written agreement of the local planning authority has been obtained to any variation.

30 No works hereby approved shall be commenced within 28 days from the date of this permission.

1. The excavation of the borrow pits at Birkby Nab will require a separate planning permission from County Council. 2. A public right of way crosses the site to which the permission relates. The grant of planning permission does not entitle the developers to obstruct the public right of way. Development should not be started, and the right of way should be kept open for public use, until the necessary order under Section 247 or 257 of the Town & Country Planning Act 1990, for the diversion of the right of way has come into effect. 3. Trees on the site to which this permission relates are subject to a Tree Preservation Order and may not be lopped, topped or felled without the prior written consent of the Borough Council, unless the tree work has already been approved under cover of a planning permission which is being implemented. Any person undertaking work to protected trees without written consent is liable to prosecution. Application forms are available from the Councils Department of Development Services. 4. Trees on the site to which this permission relates are within a Conservation Area and may not be lopped, topped or felled without 6 weeks prior written Notice having been served on the Borough Council, unless the tree work has already been approved under cover of a planning permission which is being implemented. Any person undertaking work to trees in a Conservation Area without Notice or planning approval is liable to prosecution. JUSTIFICATION FOR GRANTING CONSENT

The proposal includes a large-scale development on the fringe of the Nidderdale AONB which will have a major adverse impact on the landscape. The development also has the potential to harm the ecology of the river and surrounding land, including a SSSI and SINC. The development will result in the loss of over 200 trees, including those covered by Tree Preservation Orders and within the Ripon Conservation Area. Notwithstanding the proposed measures of mitigation, the proposed development would be contrary to the provisions of the development plan. However, the proposed development would bring major significant social and economic benefits to the area, including the protection of domestic and commercial properties, and the long-term protection of the historic environment of Ripon. Considerable weight needs to be attached to these benefits, which are a material planning consideration and in this instance warrant setting aside local planning policies.

i) noise break out from the premises which would be likely to disturb occupants of the nearest residential properties; ii) the transmission of noise to adjoining/adjacent commercial premises likely to cause nuisance to neighbouring business operators.

Any such scheme of works that may be approved shall be implemented in full before the use hereby approved for the relevant phase commences and shall thereafter be maintained at all times and in the case of any recommended measures complied with at all times. 20 Prior to the commencement of the development hereby permitted, the following drawings and details shall be submitted to, and shall have been approved in writing by the Local Planning Authority in consultation with the Local Highway Authority:-

(i) Detailed plans to a scale of not less than 1:500 showing the proposed highway layout, including dimensions of carriageway, footway, verge widths and visibility splays, the proposed buildings and site layout, the proposed floor levels, driveways and the drainage and sewerage system;

(ii) Longitudinal sections to a scale of not less than 1:500 horizontal and not less than 1:50 vertical along the centre line and channel lines of each proposed road showing the existing ground level and proposed road level, and full details of surface water drainage proposals;

(iii) A typical highway cross-section to a scale of not less than 1:50 showing a specification for the types of construction proposed for carriageways and footways/footpaths and when requested cross-sections along the proposed roads showing the existing and proposed ground levels;

(iv) Details of the method and means of surface water disposal;

(v) Details of all proposed street lighting;

(vi) Drawings for the proposed new roads and footways/footpaths giving all relevant dimensions for their setting out including reference dimensions to existing features.

No road works shall commence on site prior to the written approval of these details by the Local Planning Authority.

The development shall thereafter not be carried out otherwise than in full compliance with the approved drawings and details.

N.B In imposing the above condition it is recommended that before a detailed planning submission is made a draft layout be produced and be the subject of a discussion between the applicant, the Local Planning Authority and the Local Highway Authority, in order to avoid abortive work. The agreed drawings must finally be approved by the Local Planning Authority for the purpose of this condition. 21 Notwithstanding the submitted details the development shall provide for the following facilities to the satisfaction of the local planning authority in consultation with the Highway Authority:-
