DEBTOR’S OBJECTION TO COMMITTEE’S 2004 MOTION USA Gymnastics, as debtor and debtor in possession in the above-captioned chapter 11 case (the “Debtor” or “USAG”), objects to The Additional Tort Claimants Committee Of Sexual Abuse Survivors’ Motion For An Order Pursuant To Bankruptcy Rule 2004 Directing Production Of Documents And Materials From USA Gymnastics [Dkt. 519] (the “Rule 2004 Motion”). INTRODUCTION On April 24, and May 8, 2019, the Sexual Abuse Survivors Committee (“Committee”) served the Debtor with two overly-broad document demands seeking a wide-range of documents without any time limits whatsoever. In total, the Committee sought over 102 categories of documents. As the Committee concedes in its Rule 2004 Motion, in slightly over a month, in three separate productions, USAG has produced documents or provided information in response to most of the categories of documents that the Committee sought. (Rule 2004 Motion ¶¶ 16, 22-23.) Of 2 the 102 different demands, only 14 remain unanswered. 1 The last four digits of the Debtor’s federal tax identification number are 7871. The location of the Debtor’s principal office is 130 E. Washington Street, Suite 700, Indianapolis, Indiana 46204. 2 In Exhibit A to its Motion, the Committee lists 16 demands it contends are unsatisfied, but one of those demands is new, as the Committee admits, and as explained below, USAG has in fact responded to one of the demands already. -

More specifically, the State Roster lists the membership of active boards and commissions established by state law, executive order of the Governor, or Iowa Court Rule. The State Roster also lists advisory councils whose members are appointed by the Governor or General Assembly, and may include other boards and commissions of interest to the public. The information included herein is furnished in part by state agencies, the Office of the Governor, the General Assembly, and the Supreme Court and reflects appointments reported prior to November 20, 2007. FOR IMMEDIATE RELEASE CONTACT: LAWRENCE ROBERT January 9, 2018 323-236-9992 TOP COLLEGIATE GYMNAST SAYS SHE IS AN ALLEGED VICTIM IN LARRY NASSAR SEX ABUSE SCANDAL MINNEAPOLIS, MINNESOTA - Oklahoma University sophomore Maggie Nichols called “The best collegiate gymnast in the country” by ESPN, revealed today that she is an alleged victim of former USA Gymnastics and MSU doctor Larry Nassar. In a statement released today Ms. Nichols said, “Three of my friends and former National Team members who medaled at the 2012 Olympics recently stepped forward to proclaim they were sexually assaulted by former USA Gymnastics, US Olympic Team and Michigan State University Dr. Larry Nassar. Today I join them.” She went on to charge the US Olympic Committee and USA Gymnastics with failing to provide a safe environment for her and her teammates. “USA Gymnastics and the USOC did not provide a safe environment for me and my teammates to train. We were subjected to Dr. Nassar at every National Team Camp which occurred monthly at the Karolyi Ranch. His job was to care for our health and treat our injuries. Instead, he violated our innocence,” she said. Nichols had been at the top of the U.S. national team leading up to the Olympics, with a silver medal in the all-around at the 2015 U.S. nationals. She won a gold and bronze medal at the World Championships that same year, and another silver medal all-around finish at the 2016 American Cup in March of the Olympic year.
