Goods and Services Tax Information Sheet - GSTI 2009 / 01 Gst Remittance New Rate, New Forms And New Lodgement Date

GST RATE The GST rate will be 12% as at 1 July 2009. All goods and services (unless GST free as per the Regulations) are subject to this 12% as at 1 July 2009. When calculating the component of GST included in a price you multiply the total figure by 10.72% (instead of 8.26%).

GST REMITTANCE FORMS The GST Remittance Form has been revised and you must use these new forms for lodgement of your GST as from and including for the month of July 2009. Forms are available from the GST website – www. gst.gov.nf and from the GST Office. The GST Remittance Form now consists of 2 pages, and if you have claimed Input Tax Credits the second page must be completed. Please ensure that you read the form carefully before completing it. The person who completed the form must sign the form. The changes to the form are:

Section B – Revenue Details. This now has a sub-total at B6 after the Input Tax Credits to enable simplification of calculating Allowable Deductions at B7 for those commercial activities claiming duty drawback. It is only the Customs Duty Drawback figure that can be entered at B7.

Section B – B9. You are required to tick your accounting methodology i.e. whether you use the cash basis or the accrual basis. You use the cash basis of accounting if your revenue and expenditure are recorded in the period they are actually received or expended. If you receive only part payment for a sale in the taxable period you only account for the GST that relates to that part of the sale in the taxable period. If you pay only part of a creditable acquisition in the taxable period and have a tax invoice, you claim only the GST Input Tax Credit for that part of the payment of the cost in the taxable period. The accrual basis of accounting is wherein revenue and expenses are recorded in the period in which they are earned or incurred regardless of whether payment is received or disbursed in that period. You cannot mix the two types of accounting i.e. both your revenue and input tax credits are calculated using the accrual basis, or both your revenue and input tax credits are calculated using the cash basis.

INPUT TAX CREDITS If you are claiming Input Tax Credits you are now required to lodge the GST Remittance Form that includes a detailed list of Input Tax Credits, or the print out from MYOB (or similar computer accounting programme). The printout must be signed and dated by the NBN holder. The form or printout must include the suppliers NBN and / or name, the invoice amount, the GST amount claimed as an Input Tax Credit, and a brief description of the goods or services purchased. If the list of Input Tax Credits is not completed your Remittance Form will be sent back to you for completion. It is an offence to make a false declaration of Input Tax Credits, and offenders will be prosecuted.

LODGEMENT DATE OF GST REMITTANCE FORMS All completed GST Remittance Forms along with Input Tax Credit Forms and payment must be received by the 28th day (or where that day is a Saturday, Sunday or public holiday, the next working day) of each month for the preceding month i.e. forms and payment for June 2009 must be received no later than the 28th July 2009. You can lodge forms and payments prior to the 28th for the preceding month. Under Section 10 of the Goods and Services Tax Act 2007 a person who fails to lodge a monthly return and payment in accordance with subsection 2 commits an offence and a penalty will be issued. A monthly form must be lodged even if revenue is nil and / or no GST is to be paid. N.I.J.R.L. PROPERTY MATTERS This week’s topic: ‘Appointing a Real Estate Agent’ There is definite benefit and advantage in appointing an Agent who will professionally market a property and actively seek a buyer by using a variety of advertising initiatives and by utilizing their database of clients. Successful Agents maintain a detailed database of prospective purchasers both local and offshore, and maintain a log of enquiries from interested parties. A good Agent will have the depth of training, experience, and industry knowledge to achieve the best outcome for the seller and be able to offer appropriate advice at the right time. Based on their professional expertise and full-time activity in dealing with vendors and purchasers alike, Agents are ideally placed to act between the parties in an ‘arms length’ situation, and handle required negotiations. A good Agent will possess high level negotiation skills and respect the fact that they are always working for the vendor and not to undersell a property just to achieve another sale. Fair market value should be achieved and an agreed price for the sale of a property should be in tune with current market conditions. A good Agent will have a keen knowledge of the current market and display absolute personal commitment to actively promote a property with determination and persistence. Ethical behaviour in all property dealings is mandatory including the requirement to exercise discretion and confidentiality. In appointing an Agent, it is critical that the Agent demonstrates faith in the property entrusted to them for sale, just as vendors should have faith and confidence in the Agent to deliver the best outcome.

I think of myself as a person who has been given tremendous opportunities during my life. Just 2 weeks ago I returned from Canada and Alaska on the trip of a lifetime. This overseas trip was given to me as a gift by some people who have known me much of my life. They didn’t just give me money or pay my fare, but they gave me the gift of a wonderful experience. They didn’t buy me something that will wear out, get lost or that I can throw away. The magic of the Canadian Rocky Mountains, the frozen lakes glistening in the sun, gondola rides to overlook beautiful cities like Banff and snow falling so gently and silently. Sailing along the inside coast of Alaska and steadily coming closer to towering glaciers with large ice falls into the sea. I found myself on the upper deck of the ship at 5 a.m. in freezing temperatures surrounded by the glory of the God of all nature. What an awesome gift we have been given and yet we continue to mistreat this earth and often waste its resources. I believe that God has appointed us the custodians of all creation – we are caregivers of what God has created. Sadly, we have often misunderstood what it means to be in charge of this awesome gift. I once had the opportunity to climb part way up Mt Rainier in north west USA. My legs ached as I pushed on higher and higher. My lungs were working overtime as we reached 8000feet. We were on a towering snow clad peak with steep glaciers falling from many sides. There were wildflowers trying to push through melting snow and squirrels darting along the track. Deer were hiding among the pine trees. Tread lightly on this earth and you will experience God in creation. 27 June 2009 “YORLYE ELL GARET WELAUT” .

Anger is one of our core emotions. It is the result of perceived injustice. While it can be very helpful and correcting,[ e.g. helping a child or frail elderly person who had been bullied or robbed] it can also be very destructive, if not acknowledged and appropriately dealt with. Anger, held on to, like guilt and resentment, is a very hard taskmaster .

Anger not only cause changes in us emotionally, socially and relationally. It also causes chemical and physical changes in our bodies. These changes can cause an infinite variety of serious medical conditions. As one teenage girl in South America discovered.

This girl was on her way home from school when she was dragged behind some bushes and raped. She went home and told no one. Her attacker followed her home, noted the address. In time he befriended her father and eventually got his permission to marry the girl. She became outraged. The rage inside her grew so big that not long into their marriage, her mind snapped, her face contorted and she ended up in a mental hospital for 17 yrs, regularly seeing a Psychiatrist. Because she was harmless towards others, she was eventually released, and one day a kind friend persuaded her to seek help with a counsellor/minister friend.

He helped her to acknowledge her inner rage (a natural response to the brutal behaviour) and then express it in words, in a non-destructive way. Then came the next essential step for her (often the most difficult part); the area of forgiveness. [ We will look at this in a future article]. During the third session, she chose to forgive her rapist and thus erase the anger and hurt from her mind and emotions. As she did, her mind and face and speech became normal again – just like before the trauma. She was now free.

We make choices every day. Some of us choose to hide our anger … we just keep swallowing it’ and that little jar of anger inside, just keeps filling up. So we push the lid down to hold it in. When the jar can finally take no more, poof !; the lid flies off and we ‘lose it’. Have you ever been around a person who seems fine and suddenly explodes over seemingly nothing? It’s not ‘nothing’. The lid has finally come off the jar. So just like any other emotion in our life, anger needs to be faced up to and dealt with appropriately. (Not by ranting and raving and hitting out).

If we keep suppressing our anger, eventually we turn it inward on ourselves and ‘anger repressed is depression expressed’ That’s the insidious thing about depression … sometimes it can come from stored anger. (but that’s a topic for another article). Good hard physical exercise is a great antidote for anger. We can get plenty of that here on Norfolk. Another one is learning to be assertive; to communicate effectively and to express anger in a non-violent way. Blow up a balloon, and instead of tying it off, let it go. It flies around the room making a huge noise and eventually fizzles out and drops to the floor…. wasted air…a bit like our anger when we express it inappropriately. But if you blow up that balloon, tie it off and pretend that the balloon is the object of your anger, you can hit it, and punch it and eventually it explodes, the minute your hear the explosion, it has a cathartic effect on your brain and your brain switches off anger to either laughter or tears. . We can choose to let anger control us and have our relationships ‘bussup’ or we can learn to say to ourselves ‘domain’ (never mind) and walk away. It’s all about choices.

PLANNING ACT 2002 VARIATION OF THE NORFOLK ISLAND PLAN 2002 I, Stephanie Victoria Jack, Minister for the Environment, Education and Social Welfare give notice under subregulation 10(3) of the Planning Regulations 2004, that in accordance with the resolution of the Legislative Assembly on 17 June 2009, the draft plan laid before the Legislative Assembly, being a variation to the Norfolk Island Plan 2002 (VAR 04.08 for a tourist facility located at the banyan tree in the Airport zone), has been rejected.

For the purposes of subregulation 10(3) of the Planning Regulations 2004, the reasons for this decision to reject the draft plan are as follows:

(a) there is currently no Development Control Plan to guide and control future development currently classified as Prohibited within the Airport Zone, and (b) public safety concerns in relation to the proximity of the Avgas storage facility to the banyan tree.
