FOREWORD

More has been said about the writing of lawyers and judges than of any other group, except, of course, poets and novelists. The difference is that while the latter has usually been admired for their writing, the public has almost always damned lawyers and judges for theirs. If this state of affairs has changed in recent times, it is only in that many lawyers and judges have now joined the rest of the world is complaining about the quality of legal prose.

My best wishes to all these student contributors, for their future endeavors. My best wishes and assurance to the readers that this will add a lot to the knowledge after reading this Judiciary notes. It’s not just for the legal fraternity but for anyone who has an interest in the field of law.

Anti-Romeo squads in Bengal if BJP is voted to power Chhuti Mistry | Haldia | 17 April 2021

Senior BJP leader Yogi Adityanath on 08/04/2021 said that anti-Romeo squads will be formed in Bengal if the party is voted to power in West Bengal. Bengal is not a safe place for women under TMC government addressing three poll rallies in Hooghly and Howrah. He said if BJP is voted to power it will stress on women and education. “Why is Bengal not a safe place for women? … Education and transport will be made free for girls in Bengal. Anti-Romeo squads will be formed in Bengal to deal with those who loiter around girl’s schools,” he said. PM addresses ten rallies in three days

Chhuti Mistry | Haldia | 17 April 2021

Setting a new pace in this season, Modi had addressed 10 rallies from 1st – 3rd April, 2021 in the four poll bound states including Tamil Nadu, West Bengal, and . On the day one, he addressed rallies at Kokrajhar, Jaynagar, Uluberia in West Bengal followed by darshan at Meenakshi temple in Madurai. On the second day, he addressed rallies at Madurai, Kanyakumari, Patanamthitta, Thiruvananthapuram. His rally at Thiruvananthapuram, witnessing huge gathering is considered as a game-changer as party is expecting better results in Kerala this edition. The three days of back-to-back rallies came a couple of days after a whirled two-day Bangladesh tour which was equally hectic. FIR against Mamata Banerjee in Cooch Behar Chhuti Mistry | Haldia | 17 April 2021 An FIR has been lodged against West Bengal Chief Minister Mamata Banerjee at a police station here, alleging that she instigated voters to gherao central forces and that, in turn, led to the incident of firing in Sitalkuchi and the subsequent death of four persons.

Siddique Ali Mia, the zilla president of BJP’s minority cell in Cooch Behar, cited the TMC supremo’s comments during a rally in Banerswar area as he filed a complaint on Wednesday claiming that her address provoked people to attack CISF personnel during the fourth phase of state elections. He attached a video clip of Banerjee’s speech in his complaint at Mathabhanga police station. Villagers, after being provoked by such provocative statements of Mamata Banerjee, tried to snatch fire arms of the deployed paramilitary forces, Mia said. “The said villagers including women launched attack upon the paramilitary forces with the intention of

11

causing bodily injury, knowing it to be likely to cause death of the deployed paramilitary forces,” he wrote in the FIR, a copy of which is with the PTI.

The BJP leader, when contacted, said he would launch a massive protest demanding the chief minister’s arrest, if the police “sit idle” on the FIR in the next few days. “She is solely responsible for the death of those four people. She is answerable to all the voters of our district,” Mia stated.

At least four persons died outside a polling booth in Sitalkuchi assembly constituency on April 10 when CISF personnel opened fire in “self defence” allegedly after coming under attack from locals. The Election Commission had suspended the voting exercise at the booth following the incident. In its statement, the EC said, “The joint report of the two special observers has been received … wherein they interalia stated that recourse to open fire by the CISF personnel became absolutely necessary in order to save the lives of the voters lined up at the polling booth, those of other polling personnel and their own lives as the mob had attempted snatching their weapons.”

The poll panel had also banned political leaders from entering the district for three days. Banerjee met the family members of those killed in the firing on Wednesday.

Chhuti Mistry | Haldia | 17 April 2021

Speaking at a public rally in poll-bound West Bengal’s Asansol, Owaisi said, “There is no difference between Mamata Banerjee and Narendra Modi. They are two sides of the same coin.”

Taking a jibe at both Mamata and PM Modi, the AIMIM chief said, “They are brother and sister who are making fool of people through their statements.”

1. US expels Russian diplomats, imposes sanctions for hacking federal agencies

The Biden administration announced Thursday the U.S. is expelling 10 Russian diplomats and imposing sanctions against dozens of companies and people, holding the Kremlin accountable for interference in last year's presidential election and the hacking of federal agencies.

The sweeping measures are meant to punish Russia for actions that U.S. officials say cut to the core of American democracy and to deter future acts by imposing economic costs on Moscow, including by targeting its ability to borrow money.

The sanctions are certain to exacerbate tensions with Russia, which promised a response, even as some experts said the measures appeared tailored to avoid an out-of-control escalation of retaliatory acts between the two countries.

Sanctions against six Russian companies that support the country's cyber efforts represent the first retaliatory measures against the Kremlin for the hack familiarly known as the SolarWinds breach, with the U.S. explicitly linking the intrusion to the SVR, a Russian intelligence agency.

Though such intelligence-gathering missions are not uncommon, officials said they were determined to act because of the operation's broad scope and the high cost of the intrusion on private companies.

The U.S. also announced sanctions on 32 individuals and entities accused of attempting to interfere in last year's presidential election, including by spreading disinformation.

U.S. intelligence officials alleged in a declassified report last month that Russian President Vladimir Putin authorized influence operations to help Donald Trump in his unsuccessful bid for re-election as president, though there's no evidence Russia or anyone else changed votes or manipulated the outcome.

2. Japan's PM Suga arrives in US for talks with Biden, China top agenda

13

Japanese Prime Minister Yoshihide Suga arrived in Washington on Thursday for talks with U.S. President Joe Biden meant to show the strength of the two nations' security alliance at a time when both are concerned with China's growing economic and military clout.

Friday's talks will be Biden's first face-to-face meeting with a foreign leader since he took office, and they follow four years of uncertainty for the Japan-U.S. alliance under former President Donald Trump's administration.

Japan's Foreign Ministry said Suga hopes to reaffirm the alliance's strong bond and discuss a multinational effort to defend democratic values and counter China's growing global influence and disputed territorial claims.

I hope to develop a relationship of trust with President Biden and further strengthen the Japan- U.S. alliance bound by the universal values of freedom, democracy, human rights and rule of law, Suga told reporters Thursday before heading to Tokyo's Haneda International Airport.

Suga said he and Biden will "compare and adjust our policies, and we will demonstrate to the rest of the world the leadership of Japan and the United States toward achieving a free and open Indo-Pacific region.

Japanese officials said Biden and Suga are expected to discuss how to manage the peace and stability of regional seas, including the Taiwan Strait, where tensions are rising.

The two leaders are also expected to discuss the human rights situation in Hong Kong and China's north-western Xinjiang region.

Japan has taken a milder approach to allegations of Chinese human rights violations and has not joined the United States and European nations in imposing sanctions.

3. US imposes sanctions on Russia over cyberattacks and poll meddling

The Biden administration imposed a series of new sanctions on Russia, including restrictions on buying new sovereign debt, in retaliation for alleged misconduct related to the SolarWinds hack and efforts to disrupt the US election.

14

The new measures sanction 32 entities and individuals, including government and intelligence officials, six companies will be subject to sanctions, and the US will expel ten personnel from the Russian diplomatic mission in Washington, DC.

The Biden administration also is barring US financial institutions from participating in the primary market for new debt issued by the Russian central bank, Finance Ministry and sovereign wealth fund. Those limits would take effect from June 14.

Russian bonds fell and the rubble dropped the most since December on the news.

“What President Biden is going to announce today, we believe, are proportionate measures to defend American interests in response to harmful Russian actions, including cyber intrusions and election interference,” National Security Advisor Jake Sullivan told CNN early Thursday. “His goal is to provide a significant and credible response but not to escalate the situation.”

The sanctions reflect an attempt by the US to balance the desire to punish the Kremlin for past misdeeds but also to limit the further worsening of the relationship, especially as tensions grow over a Russian military build-up near Ukraine.

The latest moves come just two days after President Joe Biden warned Vladimir Putin the US would defend its interests but also offered the possibility of a summit meeting in the coming months, drawing a cautiously positive response from Moscow.

Restrictions blocking US investors from buying rubble-denominated Russian government debt have long been seen as the “nuclear option” in financial markets, where the bonds, known as OFZs, have been a popular investment. Foreigners now hold about a fifth of that debt, worth roughly $37 billion.

4. China's official in Hong Kong warns of retaliation against foreign meddling

Beijing's top official in Hong Kong on Thursday warned foreign forces not to interfere with the bottom line of national security in the city, threatening retaliation amid tensions between China and Western powers.

15

The US, Britain and their allies have condemned China's tightening control over Hong Kong's freedoms, including the sweeping national security law and electoral reforms that have all but silenced the once-vibrant opposition in the semi-autonomous territory.

When it is time, actions must be taken in relation to any external or foreign forces that may interfere Hong Kong affairs or attempts to use Hong Kong as a pawn, said Luo Ruining, director of the central government's liaison office in Hong Kong.

We will propose strong objections and teach them a lesson," he said at the opening ceremony for Hong Kong's National Security Education Day.

Authorities marked the event with a police college open house, where police personnel demonstrated the Chinese military's goose step march, replacing British-style foot drills from the time Hong Kong was ruled by the U.K. until the 1997 handover to China.
