The City of Portland ordains:

Section 1. The Council finds:

1. The Water Bureau has determined that modifications and improvements to the Elk, Skidmore, and Keller Fountains are needed to assure their safe and reliable operation.

2. The proposed improvements will include water conservation and energy conservation modifications to assure the efficient operation of these fountains in the future.

3. The Water Bureau requires professional engineering services to design the proposed Fountain Improvements.

4. The firm HB Engineers, Inc. was selected to provide engineering services to the Water Bureau.

5. That selection was made upon the recommendation of a selection committee acting in accordance with Chapter 5.68 of the City Code, Professional Services Contracts, and that selection was subsequently reviewed and approved by the Water Bureau Administrator and Commissioner of Public Utilities.

6. The cost of these services is not to exceed $132,868.

NOW, THEREFORE, The Council directs:

a. That the Commissioner of Public Utilities and Auditor are authorized to execute on behalf of the City an agreement with HB Engineers, Inc. to provide the above-stated engineering services as outlined in Exhibit 1, attached to this Ordinance, and by this reference made a part thereof.

b. The work herein shall be charged to the FY 93-94 and FY 94-95 Water Fund, Bureau of Water Works, Center Code 18089990, Project No. 3005, Account 5120.

c. The Purchasing Agent is instructed to issue a Purchase Order not to exceed $132,868 to be charged against the Water Fund for engineering services as referred to in item a. above.

d. The Mayor and Auditor are hereby authorized to draw and deliver warrants payable to HB Engineers, Inc. for engineering services rendered in accordance with the agreement referred herein when demand is presented and approved by proper authorities. D. MINORITY/FEMALE BUSINESS ENTERPRISE

Today, MNB is a 47 year old company which provides civil and structural engineering. The company began in 1945 doing structural'design for all types of structures, military installations and industrial buildings. At that time the principals were John Moffatt and Frank. Nichol. In 1962, Robert M. Bonney became general manager and president of the Oregon firm and he perfoons these same duties today. The other principals of the· fmn are: Robert A. Bonney, Executive Vice President; Donald G. McBee, Vice President of Civil Engineering and James R. McGrew, Vice PresidentofStroctural Engineering. Each ofthese Vice Presidents have at least 25 years ofengineering experience.

HB Engineers Incorporated was established in 1982 by the finn's present owner, R. Pat Hewitt, P.E., and John Buczynski, P.E. Having spent several years in industry, construc­ tion, and private consulting, the founders recognized the scarcity of quality electrical engineering consulting services based on solid, hands-on experience in construction, operations, and maintenance. HB Engineers Incorporated was formed to provide such services to federal and other pUblic agencies and private Industry. Further, energy efficiency calculations and water efficiency calculations along with recommendations for waterquality maintenance, and an opinion on the operating controls • ofthe mechanical and electrical systems will be required to be summarized in an evaluation and presented to the· Bureau of Water Works in a technical memo.·

The second part of the scoping study will require the identification of proposed improve­ ments in electrical, mechanical, and structural systems, induding the scope, budget schedule, cost, and priority assuming a two-fiscal-year period. The study will also require grouping and scheduling of the proposed improvements.

Aftert~e scoping study, the pre-design report orthe basis ofdesign will require the cost of consulting fees in addition to the construction cost.

Our fee proposal takes in all the services mentioned up to this point. The final design phases ofIra Kelle~ Fountain, induding updated scope of services, schedule, budget, and so forth for each project or group of projects would be proposed separately in accordance with item B ofthe scope ofservice document prepared bythe Bureau ofWater Works. An accurate fee proposal for each project for Ira Keller at this point would be nearly impossible since apparently it is not known exactly what needs to be done to bring this fountain into • conformance with the Bureau of Water Works' standards and requirements.

I. STAT~M'ENT OF UNDERSTANDING

There are three main work packages required for the Skidmore Fountain: the preliminary design phase, the final design phase, and construction support services after the award of the construction contract.

The preliminary design phase for Skidmore Fountain, will require absorption of all the existing records and field work to determine the existing conditions at the fountain and of the available utilities. During this phase our mechanical consultant will propose modifica­ tions tothefountain to recirculate the watertothree fourths ofthefountain while maintaining fresh water to the remaining one fourth of the fountain.

The information gathered during the research phase will be presented to the Bureau of Water Works in the form of sketches, construction specification outline, construction cost ...., estimate, and anticipated construction schedule togetherwith recommendations ofexactly L how to proceed in terms of selecting design options.

During .the construction document preparation phase of the project, drawings and specifications, with at least two meetings to review these, will be proposed. The Bureau of Water Works will provide a standard boiler plate for the specifications as well as the printing of the construction documents, and the City Bureau of Purchases and Stores will conduct the meetings with the contractors during the bidding process and award the construction contract.

The last phase of this project is the construction support services, which generally consist r­ of answering any questions from the contractor, which it" the documents are properly prepared, should be very few; attendance at a preconstruction conference with the 1;' contractor; review ofall shop drawings and submittals together with periodic site inspection L of the fountain during construction; and a final inspection with the Bureau of Water Works and approval ofconstruction. The last item on this project would be preparation ofas-built lIf drawings.

The next project, the Ira Keller Fountain, is similar in requirements except in addition to all I the· above a scoping study will be required of this installation.
