(Ordinance) The City of Portland ordains: Section 1. The Council finds: 1. The Water Bureau has determined that modifications and improvements to the Elk, Skidmore, and Keller Fountains are needed to assure their safe and reliable operation. 2. The proposed improvements will include water conservation and energy conservation modifications to assure the efficient operation of these fountains in the future. 3. The Water Bureau requires professional engineering services to design the proposed Fountain Improvements. 4. The firm HB Engineers, Inc. was selected to provide engineering services to the Water Bureau. 5. That selection was made upon the recommendation of a selection committee acting in accordance with Chapter 5.68 of the City Code, Professional Services Contracts, and that selection was subsequently reviewed and approved by the Water Bureau Administrator and Commissioner of Public Utilities. 6. The cost of these services is not to exceed $132,868. NOW, THEREFORE, The Council directs: a. That the Commissioner of Public Utilities and Auditor are authorized to execute on behalf of the City an agreement with HB Engineers, Inc. to provide the above-stated engineering services as outlined in Exhibit 1, attached to this Ordinance, and by this reference made a part thereof. b. The work herein shall be charged to the FY 93-94 and FY 94-95 Water Fund, Bureau of Water Works, Center Code 18089990, Project No. 3005, Account 5120. c. The Purchasing Agent is instructed to issue a Purchase Order not to exceed $132,868 to be charged against the Water Fund for engineering services as referred to in item a. above. d. The Mayor and Auditor are hereby authorized to draw and deliver warrants payable to HB Engineers, Inc. for engineering services rendered in accordance with the agreement referred herein when demand is presented and approved by proper authorities.
