27th July 2018 Dear All,

Over the past month there have been seven high value bike thefts from camping and caravan sites across the Island including the South Wight area. The offenders have stolen these bikes either late at night or in the early hours of the morning and in most cases cutting through locked bike chains. Officers from Rural team have visited these sites and others to raise awareness of the issue and to advise staff about security measures for their residents.

Two crimes of note for our area a burglary to a commercial premises in Godshill where alcohol was taken and the other to an unoccupied property in the Wroxall area where a window was broken. It’s not believed the two incidents are linked.

Doorstep cold calling is often reported to the police but is a matter usually investigated by Trading Standards with police assistance. It’s not an offence for someone to call at the door to sell goods and services but the caller does commit doorstep offences if they do not leave when requested or enters under false pretences. In addition, if the goods and services are £42 and over they must offer a 14 day cooling off period when they agree the contract. If the caller fails to provide this written contract they are committing a criminal offence. If you have any concerns or know someone who may have been a victim of doorstep crime then please call Trading Standards on 01983 823371 or contact Police on 101. Any question please contact me or the team on our email addresses below.

Kind regards

People are trespassing on my land, what can I do?

Trespass to land is a civil wrong and as such the police have no jurisdiction. Under common law, the landowner has a right to re-entry on the land. However, the ejection of the trespasser is fraught with danger for the landowner. Initially, the landowner should ask the occupier to leave the land and if he/she does then all is well. However, the problems start if he/she refuses to leave the land.

The owner of the land could commit several criminal offences if he forcibly removes the trespasser and his/her property from the land. The best and safest course of action is to obtain a court order, which if breached may then turn into a criminal matter.

If the police do attend an incident such as this, they are merely there as observers for any possible criminal offences committed by either party. The police cannot assist in the removal of the trespassers or their property from the land in question. The police do have some powers against larger groups of occupiers if damage has been caused.

Trespass is very complex and guidance should be sought where appropriate.
