Hon'ble Sir-Your applicant is too much aggrieved with the conduct of C.D.O. Mirzapur as he stated in his letter that your applicant is misleading and deceiving higher authorities . Under point- 6 words misleading and cheating were used for your applicant which was sheer irrelevant without any ground. Same derogatory remarks were made under point- 7 It is submitted before the Hon'ble Sir that your applicant is law abiding citizen and always oppose the malpractices going on in the system and allegation of C.D.O. is baseless and itself misleading and deceiving to higher authorities which is against the basic frame work of constitution . The act of C.D.O. only indicating the lawlessness in the Government system. No development is taking place at the ground level which ipso- facto obvious from the enquiry report of central team but no action was taken by state Government still on the enquiry report. This humble request to Hon'ble Sir to appoint high level committee in order to check the authenticity of allegation made by C.D.O. Mirzapur against your applicant so that if allegation levelled against your applicant found true , then your applicant may be prosecuted under court of law otherwise C.D.O. may be prosecuted under appropriate law of land. Mirzapur is against the principle of natural justice. Whether a Government servant itself can enquire into allegations made against him. Whether this is in accordance with the the rule of law. 3-It is submitted before the Hon'ble Sir that C.D.O. Mirzapur made available the enquiry report under seven points in which under point -1 ,it was stated that Yogi M. P. Singh stated correctly. 4-It is submitted before the Hon'ble Sir that C.D.O. Mirzapur under point-2 also stated that yogi M. P. Singh is Right but bungling of fund was tried to cover under carpet like it was human error/mistake on the part of Gram Panchayat Adhikari . This mistake was rectified by Gram Panchayat Adhikari on 8.9.2011. 5-It is submitted before the Hon'ble Sir that C.D.O./D.D.O. wrote dozen of letters to B.D.O. Chhanbey to tell the name of erring staff so that action may be taken but B.D.O. Chhanbey never revealed the name of aforesaid staff.Whether the public records are rectified after five years. 6-It is submitted before the Hon'ble Sir that under point- 3 ,enquiry officer stated that Yogi M. P. Singh stated correctly. 7-It is submitted before the Hon'ble Sir that under point- 4 ,B.D.O. again tried to justify the illegal, unjustified ,unlawful arbitrary act of his department in which three entries were made illegally by some one

P. Singh have been made available so nothing is left to be said. Under point- 6 words misleading and cheating were used for your applicant which was sheer irrelevant without any ground. He said that complaint filed by your applicant in UPSIC Lucknow is under process more than one year is false as it is more than three years old in which Rs.25000.00 has been imposed on D.D.O. Mirzapur .On 26- Dec-2012 ,Hon'ble Commissioner Maurya ji was ordering recovery but B.D.O. Chhanbey took time once more and naxt date of hearing is 19- june-2013. 9-It is submitted before the Hon'ble Sir that B.D.O. Chhanbey and A.D.O. Panchayat both had gone to attend the proceeding of U.P.S.I.C. as directed by D.D.O. Mirzapur in aforesaid complaint ie S-11-173/C/2010 mzp on 11-April-2012 and in compliance to direction of Hon'ble commissioner G.P. Maurya ji ,your applicant gave the copy of RTI communique dated 28-7-2010 as requested by Duo with assurance that they will return after photo copy but they

Since Duo were apprised with the fact that at that time in the commission your applicant couldn't made available letter dated 11.8.2011 as evidence that my communique dated 28-7-2010 has been transferred by D.D.O. Mirzapur to B.D.O. Chhanbey as they said they have not received the RTI Communique dated 28.7.2010 so they understood that letter dated 11.8.2011 only proof to RTI Communique dated 28.7.2010 is missing and now if they will take this alone copy of RTI Communique dated 28.7.2010 ,then their stand can be easily proved that they have not got the RTI communique so how they will provide the information consequently they will avoid to provide information once . But now they are two more steps ahead that they are using derogatory remarks against me like your applicant is misleading and deceiving higher authorities. Hon'ble Sir when on 26- December-2012 ,your applicant was giving RTI Communique seeking information concerned with the beneficiaries of Indira avas then Hon'ble commissioner itself said that Yogi ji ,you may go along with Dileep Sonkar ji otherwise previous story may repeat. Hon'ble Sir Dileep Sonker requested too much before commission ,then Hon'ble commissioner gave last chance otherwise he was going to pass recovery order for imposed penalty. Hon'ble commission

Hon'ble commission passed the order that B.D.O. neither return the the RTI communique nor made available the sought information as well as did not attend the previous hearing dated 1-Aug-2012 therefore final opportunity to be heard is given on 19- june-2013 if sought information not made available then process of recovery will be initiated. 10- It is submitted before the Hon'ble Sir that letter dated 11.8.2011 only proof to RTI Communique dated 28.7.2010 is not missing and they shouldn't made derogatory remarks against your applicant. Chhanbey sent communication dated 4.7.2011 addressed to C.D.O. Mirzapur letter no.271/sthan./RTI/2011-12 containing photo copy two work completion certificate as enclosures. Copies of aforesaid letter and concerned annexures were served to your applicant in order to comply the direction of PMO regarding your applicant's letter dated 20.2.2011 addressed to Hon'ble Prime Minister of India. 2-It is submitted before the Hon'ble Sir that in one of the work completion certificates, date of ending of work is 16.9.2006. In this certificate, 5 entries have been made. First entry on 13.9.2006. Second entry on 16.9.2006. Third entry on 15.10.2006 (just after on month of completion of work). Fourt entry on 4.11.2007(after one year).
