1.0 PURPOSE OF ARTICLE

1.1 To provide Members with the annual report for the West Lancashire Conservation Areas Advisory Panel for 2011.

2.0 BACKGROUND

2.1 The historic environment plays an important role in our cultural heritage and contributes greatly to our sense of national, local and community identity. It has an aesthetic value and provides us with local distinctiveness and helps define our sense of place. Importantly it can also help us support the economic development and regeneration of our communities, particularly through leisure activities, tourism and recreation. 2.2 Planning has a central role to play in conserving and enhancing the historic environment through policy and plan-making at all levels and through the determination of planning applications for development. Conservation Area Advisory Panels are promoted to assist in the proper management of conservation areas including providing a source of independent advice on planning and other development related matters which could affect the historic environment.

2.3 The West Lancashire Conservation Areas Advisory Panel (CAAP) was originally set up to support the Council’s planning function in 1975 and is one of the longest standing ‘Conservation Panels’ in the region. It plays an important role in providing ‘heritage’ advice to the Council, on

- 277 - planning applications which affect the historic environment, including applications for listed building consent, development affecting conservation areas and conservation area consent. The Panel also liaise with the authority on the preparation of conservation policy, conservation area appraisals and the production of guidance material relating to the preservation of the Borough’s heritage.

2.4 The Panel is made up of representatives from local groups and professional organisations which are involved, or have an interest in planning and the local environment. This includes the West Lancashire Civic Trust, Ormskirk Community Council, Ormskirk Historical Society, West Lancashire Archaeological Society, CPRE and West Lancashire Parish Councils together with the Royal Institute of British Architects (RIBA), Royal Institute of Chartered Surveyors (RICS) and Royal Town Planning Institute (RTPI). The Panel is ‘Chaired’ by one of the representatives and is provided secretarial support (preparing the agenda, presenting the agenda items and taking minutes) from the Council’s Heritage and Environment Manager. Meetings are held every month and follow the Planning Committee cycle.

2.5 Comments on planning applications made by CAAP are passed through to the Planning Service to assist in the determination of planning applications. Because members of the Panel bring together views from a wide range of skill sets they provide a different and valuable perspective of development proposals which brings ‘added value’ to the planning process.

3.0 CURRENT POSITION

3.1 Publishing an annual report is a requirement of the terms of reference of the Conservation Areas Advisory Panel. A copy of the Chairman’s report for 2011 is appended for information purposes.

3.2 The report shows that the Panel assessed a total of 67 applications during its 10 meetings in 2011. A breakdown of the type of application shows that around 48% (32) related to development proposals which affected the character of listed buildings.

3.3 Panel raised no objections to nearly half the number of applications (32 in total) which is similar to last years figure. The number of applications recommended refusal has dropped from 40% last year to 24% (16 cases) this year. CAAP made requests for alterations and changes to be made to schemes on about a quarter of all applications.

3.4 The report highlights that whilst the comments made on applications are relatively brief, the Panel members carefully evaluate and debate the impacts of every proposal. It should be noted that the Chairman has again extended an open invite to Members of the Planning Committee to attend a panel meeting to observe a meeting taking place and how the recommendations are reached.

- 278 - 3.5 The report highlights that the standard of planning submissions remains, in the view of the CAAP, very poor and are often lacking sufficient detail to assess correctly. Any move to improve the quality of applications would be welcomed by the Panel.

3.6 The report also highlights that the number of Buildings at Risk remains a concern with little progress being made in 2011.

3.7 The current membership of CAAP has over the last 12 months remained constant although it remains 3 members down with positions vacant for representatives for the National Trust, Royal Institute of British Architects (RIBA) and a post previously filled by an Ex. Officio.

4.0 CONCLUSIONS

4.1 That the work of the Conservation Panel is acknowledged and the content of the Chairman’s annual report be noted.

5.0 SUSTAINABILITY IMPLICATIONS/COMMUNITY STRATEGY

5.1 There are no significant sustainability impacts associated with this article and, in particular, no significant impact on crime and disorder. The article has no significant links with the Sustainable Community Strategy.

6.0 FINANCIAL AND RESOURCE IMPLICATIONS

6.1 There are no significant financial or resource implications arising from this article.

The purpose of this report is to set out details of the activities of the West Lancashire Conservation Areas Advisory Panel during the period January to December, 2011, inclusive.

Background

The West Lancashire Conservation Areas Advisory Panel was set up in 1975. The Panel advises the Council on planning applications in Conservation Areas, and in respect of Listed Buildings.

The Panel generally meets once a month, in the week immediately following the meeting of the West Lancashire Borough Council's

Planning Committee. This is to enable the Panel's comments to be incorporated into a future Agenda for the Planning Committee.

The Council's Heritage & Environment Manager acts as Secretary, prepares the Agenda, presents the applications and takes the

Minutes.

He/she is not a member of the Panel, and has no vote on recommendations made by the Panel. The Panel is chaired by one of its representatives, as agreed on an annual basis.

CAAP Chairman's Report for 2011

The Panel met on 10 occasions during the year to discuss, evaluate and make recommendations and observations on a total of 67 referred applications. A full analysis of the applications is shown on page 6 of this Report. (There was no meeting held in July as the Heritage & Environment Manager was on leave and it was apparently not possible for any staff from the Planning Department to be made available to deputise).

Panel members' attendance at meetings during the year averaged 84% (based on representations from 8 organisations). The National Trust and RIBA were again not represented during the year. At the time of writing this report, neither organisation has for the second year running proposed new representatives. The lack of a representative from the Royal Institute of British Architects (RIBA) is particularly regretted. It should also be noted that not all organisations send a deputy if their normal representative is unable to attend. It is hoped this may change so that all organisations have a deputising arrangement. On average each meeting lasted about two hours. No representative of the building trade has been appointed since the resignation of Arthur Edwardson in September 2010.

Thanks are due to Ian Bond, Heritage & Environment Manager, for his preparatory work before meetings, presentation of applications at meetings, and reporting/minuting of proceedings.

There is a standing open invitation to all Councillors on the Planning Committee, and also to all Planning Officers to observe the Panel at work. Regrettably, once again no Councillor or Planning Officer attended during 2011.

The average amount of time spent by the Panel in considering each application is approximately 15 minutes – some take much longer to discuss, while others can be dealt with very quickly. The results of the evaluation of the application amount to perhaps only a few lines. This summation cannot truly reflect the time and detailed observations made by the Panel. A visit to the Panel by Councillors who are on the Planning Committee and by Planning Officers could be of mutual benefit when applications are being considered. It is disappointing that various recommendations made by the Panel on some applications are disregarded or not acted upon by the Borough planners.

The standard of planning applications in many cases remains very poor and lacking in detail. The quality of design is also below that expected by the Panel for many applications within Conservation Areas and for Listed Buildings. Any move by the Borough Council to improve this situation would be welcomed by the Panel.

Buildings at Risk remain a matter of concern to the Panel and again little progress appears to have been achieved during 2011.

Since the refurbishment and conversion of Committee Rooms 2/3 into the Cabinet and Committee Room, changes to the fluorescent lighting system has resulted in Panel meetings having to be conducted with the lights switched off to enable members to view the planning application details on the screen. Unfortunately the resultant darkness makes it impossible for members to write and take notes. It is hoped that a more controlled lighting scheme can be introduced for the benefit of all attendees.

Copies of the WLBC Heritage and Environment Newsletters containing informative issues are distributed to Panel members. These Newsletters are of a high quality and are much appreciated.

2011 was the year for the Council’s biennial Design Awards scheme and two members of the Panel assisted with the judging. (Judging is now rotated amongst Panel members).

In conclusion, I should like to extend thanks to all Panel members for their individual expertise and valued contributions to the work of the Panel over the past twelve months.

TERMS OF REFERENCE

1. To advise the Authority as a consultee, on applications for planning permission, listed building consent, conservation area consent and advertisement consent which would, in the Authority's opinion, affect the character or appearance of a Conservation Area or Listed Building.

2. To liaise with the Authority on conservation policy, the preparation of schemes of enhancement and the production of design guides for Conservation Areas.

3. To undertake a periodic review of all buildings of special architectural or historic interest in the District and to advise the Authority on any matters involving their use, alteration or demolition, which arise in the course of the discharge by the Authority of their statutory powers and duties.

Notes on The Terms of Reference

1. To protect the integrity of the Panel and the confidentiality of its discussions in relation to planning applications, the Panel should meet "in camera" and not meet either applicants or prospective applicants. Advice sought by or given to applicants or prospective applicants should at all times be transmitted via officers of the Planning Service.

2. Meetings will be held on average every four weeks and the quorum will be six members. Where quorum is not present then business should not be transacted.

3. Every opportunity for the Panel to comment on all applications which in the Authority's opinion would have a significant effect on Conservation Areas and Listed Buildings will be provided by officers of the Planning Service. Amended applications will be re- submitted to the Panel where considered appropriate by the Authority and where time permits.

4. The Panel will be attended at every meeting by an officer of the Planning Service and, on occasions, by an annually nominated spokesperson of the Development and Planning Committee

5. A copy of the Development and Planning Committee agenda will be distributed to the Chairman and Secretary of the Panel for information purposes. Agendas and Minutes of the Panel will be distributed to the three party spokesperson on the Council.

6. The Panel shall prepare an Annual Report for submission to the Development and Planning Committee and to the local press in January of every year.

7. The Chairman and Vice-Chairman of the Panel should be elected by the members of the Panel on an annual basis.

8. The Panel may be represented at Public Inquiries, if it wishes, but if it does not so wish, the Panel's case will be reported by the appropriate officers in the normal manner

9. Composition

The Panel shall be composed of a single representative (except where stated) from the following organisations:-

There shall also be the provision for two 'ex-officio' members to attend the Panel, provided that they have been given prior approval by the Chairman of the Panel and the Director of Development and Amenities
