GEORGE MASON UNIVERSITY LAW POLICY

The primary collection development goal of the law library is to collect and maintain materials that support the unique curricular and research needs of the George Mason School of Law. Budget permitting, some non-law materials are acquired to support the interdisciplinary research interests of the law faculty. The law library also provides legal resources to the George Mason University community, alumni, the local legal community and the general public.

I. Background

George Mason University has become widely known for its cooperating network of academic programs and centers that deal with economics and market theory. The George Mason School of Law has been a pioneer in providing its students with three core competencies: the legal application of economic tools and methods, intensive development of legal writing skills, and specialized substantive preparation for practice. Students are offered the opportunity to focus their legal studies in a particular area of law through the following specialty track programs: Corporate and Securities Law, Intellectual Property Law, International Business Law, Litigation Law and Regulatory Law. Students may also specialize in Technology Law. The law school also offers LL.M. degrees in Law and Economics and Intellectual Property.

There are a number of clinical opportunities offered to students including the Clinic for Legal Assistance to Service members, the Domestic Relations Legal Clinic, the Law and Mental Illness Clinic, and the Immigration Legal Clinic. The law school sponsors four student-edited law reviews: the George Mason , the Federal Circuit Bar Journal (moving to another law school in 09/10), the Civil Rights Law Journal, and the Journal of Economics, Law and Policy. Two faculty edited journals are sponsored by the law school: The Green Bag and the Supreme Court Economic Review.

II. Selection Responsibility

The selection of materials is carried out by the law library’s collection development committee, which is comprised of the law library director, the collection development and all members of the law library professional staff.

III. Selection Tools

The law library utilizes various resources to keep abreast of newly published materials. These resources include Hein GreenSlips in electronic and print formats, Yankee Book Peddler (YBP)

1 notification slips (Gobi), publisher catalogs, email notifications, brochures, notices and book reviews from library and law journals. The collection development committee also reviews recommendations and requests from law faculty and students

IV. Selection Process a. General The collection development librarian reviews and sorts all incoming selections and presents a final list of recommended titles to the collection development committee for final approval at monthly meetings. b. Faculty & Student Requests Faculty recommendations of new and relevant titles are actively encouraged and solicited for purchase. Requests for book purchases by law faculty are submitted to and reviewed by the collection development committee only when the cost of the item is considered higher than most regular book purchases (the current ceiling is $200). The committee then makes a determination in consultation with the law library director as to the ability of the library to make the purchase, bearing in mind budget considerations. All approved purchases are processed as library copies and routed to the requesting faculty member. The law library also solicits book recommendations through its online book suggestion form. Occasionally, the law library receives book purchase requests from students. A final determination on these requests is made by using the existing subject coverage criteria, and cost factors.

V. Selection Criteria The following criteria are used in the evaluation and selection of new acquisitions:

1. Relevance and importance to the current Law School curriculum, current faculty scholarship and research.

2. Scholarly treatment of subject areas will be given preference over practitioner oriented treatments.

3. Reputation of the author or editor in the subject matter area will be given high credence.

4. Publications must emanate from reputable and established publishers.

5. Demand for prior editions will also be factored into the selection process.

6. Availability of the item at other GMU university , especially at the Arlington Campus Library.

2 7. Coverage of subject matter in existing titles in the collection.

8. Electronic availability of the title or subject matter.

9. Materials which tend to replicate or compile existing primary materials, for example bibliographies and deskbooks will not ordinarily be considered for acquisition. Reprints and collections of articles and essays also fall into this category.

10. Continuation costs.

11. Durability and longevity of format will be taken into consideration. Hard bound copies are generally preferred to paper back when available. Pamphlets and other non-durable formats will not be selected unless the subject treatment is considered important to the collection.

VI. Material Formats

1. Monographs Monographs that support the existing law School curriculum, faculty scholarship and research will be considered for selection. The current scope of coverage levels will also be taken into consideration in making final determinations. West Hornbooks and nutshells will be acquired on a standing order basis. Generally two copies of Hornbooks or other heavily used materials will be purchased. Casebooks will only be purchased when authored by current teaching faculty or requested by faculty for teaching purposes. The law library also maintains a complete, up-to-date set of Restatements of the Law in hardcopy and a historical set in microfiche that is current through 2000. Faculty donations of current casebooks or treatises are generally added to the collection.

The law library prefers to purchase hardbound copies of monographs over softbound whenever there is an option.

2. Looseleafs Looseleaf titles will be selected when the scope and currency of the material is deemed valuable to the law school curriculum and faculty scholarship, and/or when the material is unavailable electronically or the electronic cost is deemed prohibitive. Other factors to be considered are the upkeep costs (including time dedicated to filing). Looseleafs will be withdrawn from the collection within two years of the cancellation date.

3. Law Reviews and Periodicals The law library selectively acquires scholarly journals indexed in the Index to Legal Periodicals and Books, Current Law Index and LegalTrac. Selection of journals hinges on the scope of coverage criteria levels, faculty scholarship, and electronic availability. The library also maintains a subscription to HeinOnline for digitized back issues of law journals and law related periodicals. Social science and interdisciplinary journals available electronically (and in PDF format) through services such as JSTOR, Kluwer, and ScienceDirect (Elsevier) and others will generally not be maintained in print.

The law library retains one copy (in ) of the print edition of Index to Legal Periodical which was cancelled in January 2006. The library subscribes to the online Index to Legal Periodicals and Books and has purchased Legal Periodicals Retrospective, 1908-1981. The law library also has an up-to-date print copy of Index to Foreign Legal Periodicals. The university library subscribes to InfoTrac OneFile which is available to the law school and includes titles from LegalTrac.

4. Microforms The law library maintains an extensive microforms collection which includes titles such as the following:

Microform materials are added to the collection as a space saving measure and also in instances where the materials may be infrequently used, are rare, and or unavailable in electronic format. The law library currently has two microfiche reader/printers which are able to produce digitized copies.

5. Audio-Visual The law library maintains on permanent reserve two donated series of audio tapes and CDs for law student use: the Law School Legends Audio Series (Gilbert Law Summaries) and Sum & Substance Audio Series. CDs included with print titles are catalogued and kept in the reserve

4 collection for faculty and student use only. DVDs are occasionally purchased, often at the recommendation of faculty. All audiovisual materials are kept in the reserve collection. The law library will only update those CDs and audiotapes which fall within its core scope of coverage. The law library keeps CD, DVD and video players on reserve for checkout by students and faculty.

6. Electronic The Law Library subscribes to the following electronic services:

The law library also has a site license to SSRN’s Legal Scholarship, Financial Economics and Economic Research networks. In addition the law library has access through the University Libraries to the Global Jurist Series and Journals of Legal Scholarship from Berkeley Electronic Press (Bepress).

With the emergence and growing popularity of digitized collections, the law library has a commitment to the acquisition of titles which fall within the library’s scope of coverage, thereby generating wider use and space savings. The law library, due to budget constraints, has sought to jointly acquire and split the cost of digital titles with the University Libraries; see Appendix F. CD-ROMs are not collected unless the material in question is unavailable in any other electronic format.

7. Newspapers and Magazines The law library maintains a small newspaper collection which includes current copies of The Washington Post, The Wall Street Journal, and The Times. Legal newspapers, such as American , Legal Times, National Law Journal, and Virginia Weekly are kept behind the Circulation Desk. Prior issues of state bar journals and some legal newspapers such as the National Law Journal and American Lawyer are also retained in microform format. Current issues of news magazines such as the Economist, Time, Newsweek and U.S. News and World Report are retained in the current awareness collection. Upon request, newspapers and magazines are routed to faculty.

VII. Jurisdictional Materials

A. Federal

1. and Codes The law library maintains one copy of the Code Annotated, and the official edition of the . The United States Code Service was cancelled in May 2008 and will be retained in the collection for approximately one year. Superseded volumes of USC and USCA are retained in the archival collection for historical research purposes. The library also has a copy of USCA on microfiche which is current through 2003.

2. Session Laws The law library has complete sets of the Statutes at Large and U.S.C.C.A.N.

3. Legislative History

Electronic Resources Legislative history materials are collected extensively. The law library has the following finding aids: LexisNexis Congressional (online), CIS Index (1970- ), U.S. Serial Set Index, U.S. Congressional Hearings Index, and U.S. Congressional Committee Prints Index. Full-text materials include LexisNexis US Serial Set Digital Collection and LexisNexis Congressional Research Digital Collection (CRS Reports, 1916 to date and Committee Prints, 1830 to date), HeinOnline congressional documents which include Congressional Record (bound and daily) and Congressional Globe.

4. Administrative Materials The most recent two years of print copies of the and the Code of Federal are maintained in the collection. Prior years from inception to date are maintained in microfiche: Federal Register (1936-date) – also available on HeinOnLine from vol. 1 – date, CFR 1938-date (moving wall which is usually a year behind)

5. Court Reports The law library maintains the official U.S. Reports as well as West’s Supreme Court Reporter. The United States Supreme Court Reports, Lawyers' Edition was cancelled in May 2008 and retained in the collection.. Other federal reporters are also collected comprehensively and include complete sets of the Federal Reporter, Federal Supplement, Federal Appendix, Federal Rules Decisions, Bankruptcy Reporter, U.S. Tax Court Reports, U.S. Court of International Trade Reports, and Military Justice Reporter.

6. Records and Briefs The law library has the following titles in microfiche: U.S. Supreme Court Records and Briefs, 1952 to present, U.S. Federal Circuit Records and Briefs, 1963 to present, and Fourth Circuit Records and Briefs, 1983 to present. The law library also has a complete set of Landmark Briefs and Arguments of the Supreme Court of the United States: Constitutional Law. Also available to library patrons is Gale’s Making of Modern Law: United States Supreme Court Records and Briefs, 1832-1978.

7. Digests The law library subscribes to West’s Eleventh Decennial Digest. Other digests include West’s Federal Practice Digest and West’s United States Supreme Court Digest. The Digest of the

7 United States Supreme Court Report, Lawyers Edition was cancelled in 2007.

8. Federal Citators All print Federal Shepard’s were cancelled in 2002. The law library relies solely on Lexis Shepard’s and West’s KeyCite for updating purposes. There are also two KeyCite/Shepard’s workstations available for use by all patrons including members of the public.

9. Court Rules The law library collects federal court rules and selected state court rules. The library retains sets such as West’s Federal Practice and Procedure by Wright and Miller, Federal Local Court Rules, Federal Rules of Evidence Service and Moore’s Federal Practice.

10. Attorneys General’s Reports & Opinions Attorneys General’s Reports and Opinions have been collected at a comprehensive level in both print and microform through 2002.

11. Legal Encyclopedias & Forms The law library’s collection of legal encyclopedias includes American Jurisprudence 2d, CJS, Causes of Action 2d, and ALR, 1st-6th, Federal. Comprehensive collections of formbooks are located on the first and third floors and include American Jurisprudence Legal Forms, West’s Legal Forms and American Jurisprudence Pleading and Practice Forms.

12. Government Documents The George Mason University Law Library is a selective depository for federal government documents and many of the documents are integrated in the library's larger research collection. The law library was designated a Federal Depository Library in 1981. Its collection is based on Government Printing Office's (GPO) recommended core collection for law libraries, and the needs of the curriculum of the Law School.

VIII. State Materials A. Virginia Both primary and secondary material for Virginia are maintained and selected extensively and comprehensively. These include the Code of Virginia, the Virginia Administrative Code and the Virginia Register, Virginia Reports, Supreme Court Records and Briefs, the Acts of Assembly, and House and Senate Documents. Where necessary and in order to meet high use or demand, multiple copies of primary works and treatises are retained in the collection. The law library maintains a current subscription to two copies of the official Code of Virginia and one copy of West’s Annotated Code of Virginia. Two copies each of Virginia Forms, Michie’s Jurisprudence of Virginia and West Virginia, and West’s Virginia and West Virginia Digest are maintained in the collection.

A duplicate set of Virginia core materials is maintained on the first floor for easy access and ready reference purposes. Virginia CLE materials are also collected and housed in the Virginia section (current 5 years, with the exception of symposium issues which are retained indefinitely). The law library is a member of a consortium of Virginia law school libraries, including the Virginia State Library involved in a digitization project of Virginia Supreme Court briefs now available on HeinOnline. Coverage presently is from Volumes 201 (1959) to 205 (1964) and vol. 267 (2004). Superseded editions of most Virginia primary material including the Code of Virginia and Virginia treatises are retained in archives for historical research. The Code of Virginia is also retained in microfiche format from 1849 to present. Virginia state session laws are available in microfiche from 1776-2001.

B. Core States The law library has identified the following states as important to research and instruction and has a selection of primary and practice materials:

The library cancelled extensively in the states collection in 2007 (cancelled codes will be retained two years after the last updated pocket part is received). 1. Statutes and Codes The law library collects current annotated codes, advance legislative services and interim code annotation services for selected states; see Appendix A. Superseded codes are maintained in microfiche through 2001. Print superseded codes for Virginia, Maryland and D.C. are retained in archives.

2. Administrative Materials Administrative codes for Virginia, Maryland and Washington, D.C. are maintained in the collection.

3. Court Reports The law library maintains one current subscription to the reporters covered by West’s as well as a select number of official reporters. Some intermediate level court reports are also maintained for select states; see Appendix A

4. Digests Current digests are collected for selected states; see Appendix A. The law library does not maintain a current subscription to the regional digests and recently cancelled the Atlantic, South Eastern, and Pacific Digests (in 2005).

5. State & Regional Shepard’s The law library no longer maintains current print volumes of Shepard’s for any states. Current citators are available through Shepard’s on Lexis and Westlaw’s KeyCite and through the two public Keycite/Shepard’s workstations.

6. Legal Encyclopedias Legal encyclopedias are collected and maintained for Virginia and West Virginia, Maryland. legal encyclopedias were cancelled in 2007 and will be retained for two years after the last updated pocket part.

IX. Foreign Law Materials The law library has an extensive archival collection of print Canadian and British primary material through 2001; see Appendices B and C. For access to current material the library uses Lexis and Westlaw. The library also has the following compilations of treaties: League of

10 Nations Treaty Series, United States Treaties and Other International Agreements, Treaties and Other International Acts Series, United Nations Treaty Series, and the Consolidated Treaty Series. Selected documents from the International Court of Justice and the United Nations are also available. See Appendix D for a complete listing. The library also subscribes to HeinOnline’s Foreign and Resources database.

X. Standing Orders The law library purchases most West Hornbooks and nutshells on a standing order basis. Other titles, when deemed appropriate by the collection development committee are also purchased on standing order.

XI. Personal Faculty Copies The law library orders personal copies of books for faculty when requested. The law library is reimbursed in full from the faculty’s law school research account.

XII. /De-selection Certain items in the collection such as advance sheets and slip opinions are routinely weeded from the collection. Other materials in the collection are regularly reviewed to determine if the content is obsolete and of no historical value. Faculty are consulted before any major title is cancelled. Cancelled looseleaf titles are withdrawn from the collection after the expiration of a two year period. Damaged or deteriorating materials are also evaluated for possible removal from the collection and replacement if judged necessary. Only professional may deselect material and each librarian is assigned a section of the library to regularly monitor and review. An annual shelf-reading review of the collection is also conducted during summer intersession.

XIII. Missing Materials The law library conducts an extensive three month search process for missing materials. In situations where the materials are needed urgently, for example as part of the required reading for an LRWA research project, the replacement process is expedited. All other replacement requests are reviewed after the three month process and titles will be replaced if deemed important to the collection. If a title has been superseded by subsequent editions or will be superseded by a forthcoming edition, a determination will be made by the collection development librarian to replace if the missing title has historical value.

11 XIV. Archives The law library maintains an archival collection, in the original building of the Arlington Campus across the parking lot. The collection consists mostly of superseded primary material (codes and reporters), discontinued legal journals, and British, Canadian and other foreign materials. Select superseded treatises and rare books are also housed in archives.

XV. Rare Book Collection Due to space constraints the law library does not currently have a separate area to house rare books and manuscripts, and is forced to use a very limited area in the staff conference room for this purpose as well as an overflow area in technical services. Donations and offers of rare and special titles are refused by the library because of lack of space.

XVI. Gift Policy Book donations that fall within the existing selection guidelines will be accepted by the library. All incoming donations are reviewed by the collection development librarian. The law library does not appraise the value of donations and will only issue a letter to the donor acknowledging the donation. The law library retains the right to use or dispose of donated material in any manner that it deems appropriate.

XVIII. Five Year Goals The law library’s collection development policy is reviewed each year and revised as necessary. Major acquisitions in the past five years include digital collections such as BNA-ALL, LexisNexis Congressional Research Digital Collection, Making of Modern Law, HeinOnline, and Law Library Microform Collection (LLMC). The law library is currently revising its existing collection development policy and is in the process of formulating a series of goals for 2006 - 2011.

13 XIX. Scope of Coverage

The law library has adopted the following Research Libraries Group collection intensity indicators:

0 - Out of Scope: The law library does not collect in this area.

1- Minimal Level: A subject in which few selections are made beyond basic works

2- Basic Information Level: A collection or service capability of up-to-date general materials which will aid readers’ immediate understanding of the subject and will serve to introduce readers to the subject and to other sources of available information. Such a collection might include a dictionary, encyclopedia, handbook or texts, or a combination of these, in the minimum number which will serve the purpose. A basic information collection is not sufficiently intensive to support instruction in any course in the subject area involved.

3- Instructional Support Level: A collection or service capability which is adequate to support instruction in law and research at the J.D. level. It usually consists of a selection of reference tools, an extensive collection of primary legal materials and documents, the most important monographs, and a selection of the outstanding journals in the field. The reference tools and fundamental bibliographic apparatus of are included. One or more indexing and abstracting services may be included. Historical material need not be retained. The emphasis is on building current and representative collections adequate to maintain knowledge of a subject for limited or generalized purposes but less than scholarly research. Furthermore, such a collection will support the daily research needs of most practicing attorneys.

4- Research Level: A collection or service capability which includes all materials and information required for faculty and graduate law student research and instruction, including dissertations, graduate papers, and independent research. It allows for the expansion of the faculty and advanced student research programs in any way these may develop in the future. It includes the major published source materials required for independent research, all basic reference works, and a wide selection of monographs, as well as indexing and abstracting services in the field. Older material is retained for historical research.

5- Comprehensive level: A collection which in a library endeavors, so far as is reasonably possible, to include all significant works of recorded knowledge (publications, manuscripts, other forms), in all applicable languages, for a necessarily defined and limited field. This level of collection intensity is one that maintains a “special collection”; the aim, if not the achievement, is exhaustiveness. Older materials are retained for historical research.
