1 ACCESS TO JUSTICE Introduction Chinese citizens continue to face substantial obstacles in seeking remedies to government actions that violate their legal rights and constitutionally protected freedoms. International human rights standards require effective remedies for official violations of citi- zens’ rights. Article 8 of the Universal Declaration of Human Rights provides that ‘‘Everyone has the right to an effective remedy by the competent national tribunals for acts violating the funda- mental rights granted him by the constitution or by law.’’ 1 Article 2 of the International Covenant on Civil and Political Rights (ICCPR), which China has signed but not yet ratified, requires that all parties to the ICCPR ensure that persons whose rights or free- doms are violated ‘‘have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity.’’ 2 The Third Plenum and Judicial Reform The November 2013 Chinese Communist Party Central Com- mittee Third Plenum Decision on Certain Major Issues Regarding Comprehensively Deepening Reforms (Third Plenum Decision) con- tained several items relating to judicial system reform.3 In June 2014, the office of the Party’s Central Leading Small Group for Comprehensively Deepening Reform announced that six provinces and municipalities—Shanghai, Guangdong, Jilin, Hubei, Hainan, and Qinghai—would serve as pilot sites for certain judicial reforms, including divesting local governments of their control over local court funding and appointments and centralizing -

Rights defense and new citizen’s movement Teng Biao 28.1 THE RISE OF THE RIGHTS DEFENSE MOVEMENT The ‘Rights Defense Movement’ (weiquan yundong) emerged in the early 2000s as a new focus of the Chinese democracy movement, succeeding the Xidan Democracy Wall movement of the late 1970s and the Tiananmen Democracy movement of 1989. It is a social movement ‘involving all social strata throughout the country and covering every aspect of human rights’ (Feng Chongyi 2009, p. 151), one in which Chinese citizens assert their constitutional and legal rights through lawful means and within the legal framework of the country. As Benney (2013, p. 12) notes, the term ‘weiquan’is used by different people to refer to different things in different contexts. Although Chinese rights defense lawyers have played a key role in defining and providing leadership to this emerging weiquan movement (Carnes 2006; Pils 2016), numerous non-lawyer activists and organizations are also involved in it. The discourse and activities of ‘rights defense’ (weiquan) originated in the 1990s, when some citizens began using the law to defend consumer rights. The 1990s also saw the early development of rural anti-tax movements, labor rights campaigns, women’s rights campaigns and an environmental movement. However, in a narrow sense as well as from a historical perspective, the term weiquan movement only refers to the rights campaigns that emerged after the Sun Zhigang incident in 2003 (Zhu Han 2016, pp. 55, 60). The Sun Zhigang incident not only marks the beginning of the rights defense movement; it also can be seen as one of its few successes. -

1 ACCESS TO JUSTICE Introduction Chinese citizens continued to turn to the legal system for help when they were harmed by environmental hazards,1 unsafe food,2 discrimination,3 and other causes.4 Chinese law allows citizens to use the legal system to dispute unlawful government acts.5 Inter- national human rights instruments, such as the Universal Declara- tion of Human Rights and the International Covenant on Civil and Political Rights, likewise call for the ability of citizens to obtain ef- fective legal remedies when their rights are violated.6 During the 2015 reporting year, however, the Commission observed a per- sistent gap between the Chinese government’s rhetoric regarding the importance of laws and the actual ability of citizens to use the legal system to protect their rights.7 Recent judicial reforms indi- cate recognition by the Chinese government that the current sys- tem is dysfunctional,8 and official media has touted that the re- vised PRC Administrative Litigation Law ‘‘will make it easier for citizens to take the government to court.’’ 9 It is too soon, however, to determine fully the impact of these developments. Teng Biao, a Chinese lawyer, explained that ‘‘[t]he major problem with rule of law in mainland China is not establishing legal provisions but rather implementing laws.’’ 10 The Fourth Plenum and Judicial Reforms In October 2014, the Chinese Communist Party’s leaders gath- ered for the Fourth Plenum of the 18th Party Congress Central Committee and issued the Decision on Several Major Issues in Comprehensively -

The Nationalist Party first defined the Incident as a rebellion by pro-Japanese forces and communist saboteurs. As the enemy of the Nationalist Party in China’s Civil War (1946-1949), the Chinese Communist Party initially interpreted the Incident as a Taiwanese fight for political autonomy in the party’s wartime propaganda, and then reinterpreted the event as an anti-Nationalist uprising under its own leadership. -

Insights Huining on the Liaison Office
The intriguing appointment of Luo Insights Huining on the Liaison Office In late December 2019, Luo Huining 骆惠宁 was set aside and taken down from his provincial position (Shanxi Party Secretary [2016-2019]) and instead sent, as several 65-year-old Cadres often do before their official retirement, to a commission led by the National People’s Congress (NPC). Luo, a provincial veteran (Anhui Standing Committee [1999-2003], Governor [2010-2013] and Party Secretary of Qinghai [2013-2016]), seemed then to follow in the footsteps of his Qinghai predecessor, Qiang Wei 强卫1. Replaced by Lou Yangsheng 楼阳生 – part of Xi’s Zhejiang “army”, Luo, despite being regarded as competent when it came to the anti-corruption campaign, has never shown any overt signs of siding with Xi. As such, the sudden removal of Wang Zhimin 王志民2 – now ex-director of the Hong Kong Liaison Office for the Central government, which, to be fair, was predictable3, became even more confusing when it became known that he would be replaced by Luo. Some are saying this “new” player could bring a breath of fresh air and bring new perspectives on the current state of affairs; some might see this move as either an ill-advised decision or the result of lengthy negotiations at the top – negotiations that might not have tilted in Xi’s favor. A fall from “grace” in the shadow of Zeng Qinghong Wang Zhimin’s removal, as previously stated, is almost a non-event, as Xi was (and still is) clearly dissatisfied with the way the Hong Kong - Macau affairs system 港澳系统 is dealing with the protests. -
