Purchases of pre-recorded videocassettes and DVDs do not change their obligations. The copyright owner’s right to publicly perform his work, or to license others to do so, is exclusive. Any willful infringement of this right “for purposes of commercial advantage or private financial gain” is a federal crime. The first offense is punishable by up to one year in jail or a $25,000 fine, or both; the second and each subsequent offense is punishable by up to two years in jail or a $50,000 fine, or both. In addition, even innocent or inadvertent infringements are subject to substantial civil penalties.
