Apenas os agentes e intermediários devidamente credenciados e que efetivamente tiveram uma particpação no leilão, examinando previamente os produtos ou licitando, farão juz a uma comissão de 5% (cinco por cento) a ser paga nas seguintes condições: a) quando do pagamento à vista - até 30 dias da data do leilão e sobre o valor líquido; b) quando do pagamento em 7 parcelas - até 70 dias da data do leilão e sobre o valor líquido. c) quando do pagamento em 15 parcelas - até 70 dias da data do leilão e sôbre o valor da arrematação. Parágrafo Único - A definição de participação efetiva através de exame dos animais, antes ou durante o leiláo ficará a critério dos vendedores e dos organizadores. 2. Os agentes e intermediários ficarão responsáveis, dentro do prazo regulamentar, pela regularização no escritório do leilão, das compras efetuadas por seus clientes e deverão assinar no ato da compra, a confirmação do lance. 3. Por se tratar de um serviço de assessoria, pressupõe-se por parte dos agentes e intermediários a revisão e o exame prévio dos animais (inclusive radiográficos e endoscópicos), não cabendo pois, junto aos vendedores ou organizadoras, qualquer tipo de reclamação ou pleito. 4. Os pagamentos das comissões serão feitas através da APPS, mas são de responsabilidade dos vendedores. NORMAS ESPECÍFICAS I - CONDIÇÕES GERAIS ART. 1º - O Leilão de Potros da Fazenda Mondesir, Haras Old Friends e Haras Anderson, será realizado no dia 31 de Julho de 2009, 6ª feira, às 12:00 horas, no Forte de Copacabana - Rio de Janeiro. ART. 2º - A arrematação far-se á pelo maior lance. ART. 3º - Ë facultado aos interessados fazer examinar por técnicos de sua confiança os produtos a serem licitados, antes do Leilão. Portanto serão INACEITÁVEIS quaisquer reclamações posteriores. ART. 4º - Os vendedores e a APPS (Agência Paulista de Puro Sangue) não se respon- sabilizam por quaisquer alterações ocorridas no estado dos animais, após a arrematação, tampouco acidente de transporte. Paragráfo 1º - Lembramos aos interessados que procedam com antecedênca a devida revisão dos animais, pois uma vez na pista, a distância impede muitas vezes a verificação de detalhes somente visíveis de perto, e reclamações desta natureza não serão aceitas. ART. 5º - Os animais, após o leilão, retornarão aos locais de origem na noite do leilão, e deverão ser retirados no prazo de 2 (dois) dias a contar da data da arrematação. ART. 6º - Os lances corresponderão ao valor da parcela mensal e seu valor será determinado pelo leiloeiro. ART. 7º - Foram dispensados os necessários cuidados para que o catálogo esteja correto, mas a APPS (Agência Paulista de Puro Sangue), os vendedores e o leiloeiro não respondem por erros ou omissões do mesmo. Eventuais correções feitas durante o leilão prevalecerão sobre o catálogo. II - DOS COMPRADORES ART. 8º - Os compradores poderão optar por uma das seguintes condições de paga- mento: - 15 parcelas sem juros e sem correção; - à vista com 10% (dez) por cento de desconto sobre o valor do arremate. - é facultado aos compradores que optaram por financiamento, liquidarem seu débito, a qualquer momento, gozando de um desconto estabelecido pelo vendedor. ART. 9º - Os interessados em obter financiamento deverão apresentar a APPS cadastro para apreciação até 10 dias antes do leilão. Parágrafo 1º - Os compradores que não estiverem cadastrados ou aque- les cujos cadastros não forem aprovados terão que efetuar o pagamento à vista, gozando do desconto estipulado. ART. 10º - Os compradores deverão pagar as seguintes taxas: a) 8% (oito por cento) sobre o valor do arremate, para qualquer opção de pagamento. b) Transferência de propriedade. - Até 30 dias após a realização do leilão - valor previsto na tabela. - Até 60 dias após a realização do leilão - valor da tabela, acrescido de 20%(vinte) por cento. - Após 60 dias da realização do leilão - valor previsto na tabela, acrescido de 100% (cem) por cento. c) Pagar no ato a importância de R$250,00 (duzentos e cinquenta reais) referente a inscrição compulsória na “Copa Leilões” instituida pelo Jockey Club Brasileiro. ART. 11º - Aos compradores compete ainda: a) Assinar no ato da compra nota promissória no valor correspondente ao preço da aquisição, mais as taxas devidas, com vencimento contra apresentação e que deverá ser paga ou substituida quando da regularização da compra. b) Assinar, no ato da arrematação, a transferência de propriedade. c) Assinar no ato da arrematação contrato de financiamento. d) Os acertos de compra deverão ser efetuados no escritório montado no próprio local do leilão, após a arrematação. ART. 12º - O ICM é de responsabilidade do vendedor na forma do decreto 34.448. Os produtos com idade inferior a 36 meses estão isentos de ICM, entretanto para as vendas interestaduais o imposto é devido a seu recolhimento será de responsabilidade do comprador. III - DOS VENDEDORES Compete aos vendedores: ART. 13º - Pagar as despesas do Leilão, além da importância de R$250,00 (duzentos e cinquenta reais), referente a inscrição compulsória na Copa Leilões, instítuida pelo Jockey Club Brasileiro. ART. 14º - No caso de não apresentação do animal inscrito, seu responsável também deverá pagar a importância mencionada acima. ART. 15º - Apresentar o animal inscrito, no dia e local designados, devidamente encabrestados, acompanhado de seu respectivo cavalariço, carteira de identidade e exame negativo de AIE, dentro do prazo de validade do mesmo, exigido pelo serviço de Veterinária do Jockey Club. Os animais deverão estar no Forte de Copacabana até as 10:00 horas do dia do leilão. IV - CONDIÇÕES FINAIS ART. 16º - O animal arrematado retornará ao Jockey Club Brasileiro e será entregue pelo vendedor mediante autorização por escrito da APPS (Agência Paulista de Puro Sangue), a qual será dada imediatamente após a regularização da compra, correspondendo ao vendedor a responsabilidade de manutenção do animal até no máximo 2 (dois) dias úteis subsequentes à arrematação. A partir do 3º dia útil, as despesas de manutenção ficarão por conta do comprador, pagas as diretamente ao vendedor, no dia da retirada do animal no valor de R$ 30,00 (trinta reais) a diária. Parágrafo Único - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador. ART. 17º - A palavra do leiloeiro, no decorrer do leilão está credenciada a alterar ou com- plementar estas normas, bem como as informações no catálogo. O leiloeiro reserva-se o direito de não aceitar lances de pessoas que a seu critério julgar não responsáveis sendo seu julgamento soberano. ART. 18º - Fica estabelecido o foro da capital do Rio de Janeiro, para a eventualidade de qualquer pendência judicial. ART. 19º - Após o prazo de 2 (dois) dias úteis, caso não tenha ocorrido o acerto por parte do comprador, o vendedor poderá aceitar, ou não, com a anuência da agência organizadora, a substituição do comprador. ART. 20º - No caso de acerto direto entre as partes, as taxas deverão ser pagas a agência. ART. 21º - As taxas do leilão são irrestituíveis, mesmo para os casos de anulação. ART. 22º - Os casos omissos serão julgados pelos vendedores e pela APPS (Agência Paulista de Puro Sangue), a seu exclusivo critério, sendo finais e definitivas as suas decisões, não podendo ser encaminhado nenhum tipo de reclamação, sem primeiro ocorrer o acerto inicial. ART. 22º - É facultado ao vendedor a exigência de avalista. No caso de não aprovação do avalista indicado, o comprador ficará sujeito a pagamento à vista. ART. 23º - O não pagamento de uma das notas promissórias implica no vencimento automático de todas as demais ainda para vencer. ART. 24º - Após o prazo de 7 (sete) dias úteis, caso não tenha ocorrido o acerto por parte do comprador, o vendedor poderá cancelar a venda. ART. 25º - O Compromissário Comprador, depois de notificado por via postal, com prazo de CINCO DIAS, outorga desde já poderes especiais e irrevogáveis ao Jockey Club, para debitar em conta corrente do PROPRIETÁRIO E/OU CRIADOR, todas as parcelas devidas e referentes ao presente compromisso de compra vencidas e não pagas nas épocas convencionadas, inclusive juros de mora e/ou multa contratual dando como bons e corretos os débitos eventualmente feitos, sem direito a qualquer reclamação ou contestação. Os valores debitados em conta corrente do Compromissário Comprador serão levados à crédito em conta corrente do Promitente Vendedor, caso não haja contranotificação fundamentada. Para todos os fins de direito o endereçamento da notificação postal será o constante no contrato firmado pelo Compromissário Comprador, cabendo a ele no caso de mudança comunicar por escrito ao Promitente Vendedor. ART. 26º - A APPS não poderá ser responsabilizada por eventuais problemas nas aqui- sições feitas através do sistema telefônico implantado no leilão. ART 40° - The sales representatives and APPS (Agencia Paulista do Puro Sangue Ltda) will not be responsible for whichever alterations that occurred in the condition of the animals after the end of the bidding, or any accidents involving transportation. It will be observed that some of the Mares which appeared in the last Supplement (whereof this is a republication and continua- tion) stand as they did there, i. e. without any additions to their produce since 1813 or 1814. — It has been ascertained that several of them were about that time sold by public auction, and as all attempts to trace them have failed, the probability is that they have either been converted to some other use, or been sent abroad. If any proof were wanting of the superiority of the English breed of horses over that of every other country, it might be found in the avidity with which they are sought by Foreigners. The exportation of them to Russia, France, Germany, etc. for the last five years has been so considerable, as to render it an object of some importance in a commercial point of view.
