LOT 4 — Land at Greenbank Farm (East)

Approximately 82.85 acres of primarily pasture. The land is accessed from Greenbank Lane, East Marton and provides useful grazing. There is also a gate connecting Lots 4 and 5.

LOT 5 — Land at Greenbank Farm (West)

Approximately 63.06 acres of meadow and permanent pasture with a substantial stone barn. The land is accessed from Ingthorpe Lane, providing a useful link to Lots 1-3. There is also a gate connecting Lots 4 and 5. Interested parties are advised not to enter the barn as the floor and roof are currently unsafe. Term The initial term will be for seven years from the 1st October 2015, with a break clause exercisable by either party on 1st October 2018.

Classification The land is classified as Grade 4.

Agreement The agents, Davis and Bowring will make a copy of the Farm Business Tenancy agreement(s) available to the successful applicant(s) in advance of the start date.

Basic Payment Scheme The Basic Payment Scheme entitlement will be transferred to the successful applicant(s) of Lots 4 and 5 at no extra cost. The successful applicant(s) will be required to surrender the entitlement to the Landlord or another person nominated by the Landlord at the end of the tenancy without charge.

There are no Basic Payment Scheme entitlements included in Lots 1-3, however, the outgoing Tenant has indicated that he may be willing to sell the entitlements to the incoming Tenant at market value by separate negotiation.

Rights and Easements The tenancy will be subject to all rights of way, easements and wayleaves.

Rent The rent will be paid monthly in advance in pounds sterling.

Repairs The Tenant will be responsible for all repairs.

Review The rent shall be reviewed in accordance with the Agricultural Tenancies Act 1995.

Use The use of the holding is strictly restricted to agricultural use only. No arable crops may be planted in the final year of the tenancy without written consent.

Assignment Assignment and subletting are strictly prohibited.

Boundaries The successful applicant(s) shall be responsible to put and keep all boundaries in a good condition. The responsibility of the maintenance of the boundaries is shown by "T" marks where known. Whilst believed to be correct, these are given without responsibility and do not override the legal responsibility of the tenant. The particulars should be used as a guide to the boundaries, as several areas of games crops are excluded from the letting, but have not yet been planted.

Reservations Sporting rights are reserved to and either exercised by the Landlord or Shoot Tenant.

Tenders Tenders are to be submitted on the attached form in a sealed envelope marked ‘Marton Scar Farm’ to be received at the office of Davis and Bowring by no later than 2pm on Friday 5th June 2015.

The application should be supported by the following information:

 Details of the applicant's age, family circumstances, farming and business experience and training to date.  Details of present farming and business operations if applicable.  A business plan showing the farming policy, stocking etc. for the first three years, including an estimate of costs, returns and profitability.  Details of the Tenant’s capital requirement including any additional stock, equipment, machinery, working capital. To include a clear statement of the capital resources available (cash/bank or other loan arrangement) with evidence that such finance is assured by the source involved.  Details of any capital expenditure for improvements to be sought from the Landlord and any improvements proposed by the Tenant.  Names and addresses for character and bank references or guarantors as appropriate.

Costs The applicants will bear their own costs in respect of their tender. The successful tenant will bear their own costs in respect of completing the tenancy documentation, which may include stamp duty land tax and a Land Registry fee.

Tender Process All tenders received will be reported to the Landlord but the Landlord is not obliged to accept the highest or any tender. A number of applicants will be short listed and arrangements made to interview and for references to be obtained. If applicable current farm business accounts will be requested and an inspection undertaken of current land and premises.

Unsuccessful applicants will be notified when a binding agreement for letting is in place.
