President’s Messasge: BYLAWS -- Revision of our bylaws has been completed and cleared by legal counsel. The revised version, showing deletions and insertions, is attached to this newsletter for your review. A vote on approval of the new bylaws will be taken at the full membership meeting on July 7th. The revised version reflects our name change to the Chuckanut Bay Community Association -- CBCA -- and our redefined objectives -- fire protection, law enforcement and emergency preparedness, plus a number of housekeeping details. Many thanks to Michael Gropp, Ann Richardson Jones and Karin Todd for all the work they did.

PODS -- Ken Kaliher has stepped forward to oversee the continuing organization of our overall community into the neighborhoods we’ve designated as “Pods”, each with its own captain, to interface with the larger Association and help coordinate functions in each neighborhood, such as communication, block watch, and so on. A number of pods and captains have been established, but there are still a number of voids on the map. We can look forward to continuing progress and refinement throught the remainder of the year.

COMMUNITY DIRECTORY -- Thanks to the efforts of Gale Gropp and Susan Brown, plus input on the neighborhood level from many others, the updated community directories are completed and in print. At the June meeting of the Executive Board, the current pod captains were in attendance and picked up copies to distribute in their neighborhoods. CONSTITUTION AND BYLAWS OF THE CHUCKANUT COMMUNITY AND FIREFIGHTERS ASSOCIATION CHUCKANUT BAY COMMUNITY ASSOCIATION

Whatcom County Fire Protection District Number 6 PART A ORGANIZATION AND OBJECTIVE

Article I Name The name of this organization shall be the Chuckanut Community and Firefighters Association Chuckanut Bay Community Association. It is hereafter referred to as the Association and will operate in accordance with this constitution and bylaws.

Article II Objective The Association shall be maintained by the members as an administrative, fund raising, information sharing and social organization devoted to the safety and welfare of the Chuckanut Bay Community, defined as the former Fire District #6 and legally described as follows: That portion of Township 37 North, Range 2 East, W.M., and Township 37 North, Range 3 East, W.M., Whatcom County, , the boundaries of which are as follows: Bounded on the North by the South line of the City of Bellingham, Washington; bounded on the South by the North line of Skagit County; bounded on the West by and other waters; bounded on the East by the North and South center lines of the West (W½) of Sections 18, 19, 30 and 31, Township 37 North, Range 3 East, W.M., except that portion of same that is a part of Larrabee State Park.

Section 1. It shall be charged with supporting the safety, health and welfare of the community Firefighters; providing a forum for community members to act as a liaison to public safety authorities, and Firefighters to discuss their expectations and grievances; to publicize to the community public safety issues. the Firefighters' activities and efforts, and cooperating with the Commissioners to advance fire prevention and suppression through education and support of appropriate legislation. and other matters of general interest.

Section 2. As needed, it may It shall raise funds to supplement the Fire District budget for purchasing equipment and supplies for, and maintaining and expanding, existing public safety facilities in the Chuckanut Bay Community, and other miscellaneous expenditures as approved by the Executive Board.

Section 3. It shall arrange for and conduct all social functions of the Association.

Section 4. It shall be non-partisan, non-sectional, and non-sectarian. It shall take no part in nor lend its influence to, the election or appointment of any candidate to any office outside of the Fire Service Association itself.

Section 5. This organization is exclusively for charitable purposes within the meaning of the section 501(c)

(3) of the Internal Revenue Code. Notwithstanding any other provision of these articles, the association shall not carry on any other activities not permitted to be carried on (a) by an association exempt from Federal Income Tax under section 501 (c) (3) of the Internal Revenue Code of 1986 (or the corresponding provisions of any future US Internal Revenue Law) or (b) by an association contributions to which are deductible under section 170 (c) (2) of the Internal Revenue Code of 1986 (or corresponding provision of any future United States Internal Revenue Law).

PART B MEMBERSHIP

Article I Members The Association shall consist of current and former Residents, Property Owners within the boundaries of the Fire District Chuckanut Bay Community, current Firefighters of the South Whatcom Fire Authority and retired Firefighters of Fire district No 6.

Article II Dues Section 1. Annual dues are $12 for persons 18 years or older Family dues are $24 per year. Dues are payable January 1, the amount of which shall be established and updated from time-to-time by the Executive Board. Active and retired Firefighter households are exempt from dues.

Article III Voting Voting Members are dues paying members of voting age and Active or Retired Firefighters.

PART C DUTIES AND STRUCTURE OF THE ASSOCIATION

Article 1 Officers Section 1. Officers shall be the President, Vice-President Community, Vice-President-Firefighters, Secretary, and Treasurer. These officers shall hold office for a term of one year, and may be re-elected. The terms shall begin in October. These offices may be shared jointly.

Section 2. Other officers There shall be three Trustees, elected for rotating terms of three years. Their duties include auditing the books and serving as members of the Executive Board.

Article II Election of Officers Section 1. A Nominating Committee, composed of three Voting Members, shall give written notice to the Association members one month prior to the October General Meeting, of its nominations for Officers and Trustees. At this meeting nominations from the floor may also be made, providing the proposed candidate has agreed to accept such office.

Section 2. Election and installation of Officers and Trustees shall be held at the October General Meeting.

Article III The Executive Board Trustees. It shall meet monthly at least six times per year, including general meetings, or more often as needed, and act for the on behalf of the Association between General Membership meetings. Section 1. The Executive Board shall consist of the Officers Chairpersons of the Committees and the Section 2. All vacancies in the position on the Executive Board, whether caused by resignation, death or otherwise,

Bylaws Page 3 may be filled by the affirmative vote of a majority of the remaining Executive Board even though less than a quorum. A Trustee or Officer elected to fill any vacancy shall hold office for the unexpired term of his or her predecessor and until a successor is elected.

Section 3. Any member of the Executive Board may be removed at any time, with or without cause, by the affirmative vote of two-thirds (2/3) of the votes at a meeting of the Executive Board at which a quorum is present.

Article IV Committees Chairpersons of Committees shall be appointed by the President, with the approval of the Executive Board, for a term of one year. The Committees shall be reviewed by the incoming officers and changed as necessary. Chairpersons shall be encouraged but not required to attend Board meetings.

Article V Duties of the Officers Section 1. Duties of the President: The President shall preside at all meetings, appoint all committees and committee chairs at the direction of the Executive Board, as deemed necessary, for administrative activities of the Association and liaison coordinate activities between community members and Firefighters public safety authorities.

Section 2. Duties of the Vice Presidents: a. The Vice-President-Community Member shall assume responsibilities of either the President or the Vice-President-Firefighter in his or her absence, recommend appointment of chairpersons of committees and coordinate their activities. b. The Vice-President-Firefighters shall be a Firefighter, chosen by the Firefighters, and preside at any General Membership or Executive Board meetings in the absence of both the President and Vice-President Community. b. The duties of the Vice-President shall include responsibility for the programs for General Meetings. [from Standing Rules #6]

Section 3. Duties of the Secretary: The Secretary shall keep a record of all proceedings of the Association, preserve them and answer correspondence.

Section 4. Duties of the Treasurer: The Treasurer shall maintain financial records, collect dues, pay bills, and present an accounting at business meetings, complete annual filings as required by Local, State and Federal authorities, and prepare an annual budget for approval by the Executive Board.

Article VI Meetings Section 1. General Membership meetings shall be held on the first Wednesday of each quarter; October, January, April, and July.

Section 2. Special Meetings shall consider only those matters identified in the meeting notice: a. Executive Board may be called by request of any three members of the Executive Board with one week's notice.

b. General Membership may be called by the Executive Board or by request of one fourth of the Voting Members of the Association with one week's notice by email, mail, telephone or other public notice.

Section 3. Order: a. All meetings of the Association shall be governed by Robert's Rules of Order. b. Standing Rules may be adopted by majority approval of the Executive Board to facilitate efficient transaction of business or to define operational needs. Such rules at any time may be suspended, amended or repealed by a majority vote of the Executive Board. Standing rules may not modify, supersede or otherwise affect Bylaws. A record of standing rules shall be kept in written form by the Secretary.

Section 4. Transaction of Business: Business of the Association shall be transacted at either regular meetings or special meetings, provided a quorum of the membership is present.

Section 5. Quorum: a. Executive Board: A quorum shall consist of a majority of the members. b. General Membership: A quorum shall consist of those attending a General Membership Meeting, provided a written notice of the meeting has been given at least two weeks in advance, to all Voting Members.

Section 6. Written Consent: Any action required or permitted to be taken at a meeting of the Executive Board or of a committee thereof, may be taken without a meeting by a written consent setting forth the action so to be taken, signed by all of the members of the Executive Board, or all of the members of the committee, as the case may be, before such action is taken. Such consent shall have the same effect as a unanimous vote. Any such action may also be ratified after it has been taken, either at a meeting of the Executive Board or by unanimous written consent.

Article VII Indemnification The corporation shall indemnify its officers, Trustees, employees and agents to the greatest extent permitted by law.

PART D FINANCES

Article I Sources of Income The association is a volunteer non-profit organization. Funds are for the benefit of the entire membership and no one member may claim any special preference for payment from these funds. Officers and Trustees shall serve without remuneration. Reasonable expenses incurred on behalf of the Association may be reimbursed by the Association.

Article II Depository All funds for the Association shall be deposited in an accredited financial institution until properly disbursed by the Treasurer at the direction of the Executive Board. All checks shall be signed by the President and the Treasurer

Article III Audit The books of the Association shall be audited annually by the Trustees. A special audit may be requested by the Executive Board or two-thirds of the membership.

Article IV Fiscal Year The Fiscal Year shall begin January 1, and end the following Decembers 31.

Article V Disbursement of Funds The Executive Board of Directors and not the general membership is charged with disbursing funds. Motions for expenditures made at General Meetings should be referred to the Executive Board. Such motions should be considered by the Executive Board, but are not binding on it. Article VI Annual Budget Annual budget is to be prepared by the Treasurer with input of committee chairs and officers, and fire fighters to the CCFA Treasurer prior to the end of the Fiscal Year November Board meeting and is to be approved voted on by the December Board meeting. PART E DISSOLUTION

The Association may be dissolved by a 2/3s vote at a General or Special membership meeting. Upon dissolution of this association, assets shall be distributed for one or more exempt purposes within the meaning of section 501 (c) (3) of the Internal Revenue Code (or corresponding section of any future tax code), or shall be distributed to the federal government, or to a state or local government, for a public purpose. Any such assets not so disposed of shall be disposed by the Court of Common Pleas of the county in which the principal purposes of the organization are conducted, or to such organization or organizations as said Court shall determine, which are organized and operated exclusively for such exempt purposes.

PART F REVISIONS

Articles and sections of this Constitution and these Bylaws may be changed by additions to or revisions of various sections and articles. Changes are listed by the approval date. If amendments are added, they shall be listed consecutively by Roman numeral under REVISIONS, which is set aside for this purpose. Revisions are to be approved by a quorum vote of the Membership of the Association during General Meetings provided that at least one month prior written notice has been given to all Voting Members. For preview and approval purposes, additions are shown in italics and deletions are shown with the strike out characters. and deletions must be clearly shown.

March 6, 1991 CCFA Constitution and By-laws were accepted. This document incorporated all constitutions, bylaws, rules and regulations of the Ladies Auxiliary of Chuckanut Fire District No.6, and the Chuckanut Firefighters Association of Whatcom County Fire Protection District No.6.

I. January 15, 1992 Revision of Trustees' responsibilities, and directions for auditing the organization's books.

II. October?, 1992 Added Part A, article II, Section 5, and Part E, Dissolution in accordance with IRS requirement for tax exempt status.

III. July 5, 2000 Removed the three year re-election term limit for officers, redefined standing committees and generally updated the official document to reflect the development of the organization over the last nine years.

IV. July 11, 2001 Added to Article VI, Section 3, Definition of Standing Rules, purpose, and methods for changing.

CCFA Standing Rules - July 2001 (To Accompany the By Laws) 1. The Board and not the general membership is charged with disbursing funds. Motions for expenditures made at General Meetings should be referred to the Board. Such motions should be considered by the Board, but are not binding on it. 2. Requests by the fire fighters for non-budgeted CCFA funds should include notification of commissioners of Fire District Six prior to action by the CCFA Board 3. Upon incorporation by the Secretary of State of Washington, Alfred Dale was appointed "Agent of the Corporation." He has remained so since that time; and will remain until the Secretary of State is notified by the organization that he has been replaced. (A post office box number is not sufficient for an address for this purpose.) 4. Application for Continuation of the Incorporation is to be filed annually with the Secretary of State. This occurs in December or in January and includes payment of a filing charge. 5. Annual budget is to be prepared by input of committee chairs, executive officers, and fire fighters to the CCFA Treasurer prior to the November Board meeting and is to be voted on by the December Board meeting. 6. The duties of the Vice President will include responsibility for the programs for General Meetings. 7. Minutes of meetings of the Board will be forwarded to the Fire Commissioners of District Six and to the Fire Chief. [Standing Rules have been incorporated into the body of the By Laws.]

Celebrating and Helping Preserve this Beautiful Area

INFORMATION ON THE RURAL ELEMENT UPDATE

The Cascades to Chuckanuts represent a unique ‘mountains to the bay’ corridor that is one of Western Washington’s most intact lowland forest ecosystems. The Cascades to Chuckanut corridor provides connectivity and diverse habitat linkages from the North Cascades west to the Chuckanut Mountains and the marine coast south of Bellingham. This contiguous forested land is a rare occurrence and makes this area all the more important. In addition we have Larrabee State Park covering much of the forested hills above Chuckanut Drive, which is designated a Scenic By-ways.

We, as residents, are blessed to live in such a wonderful and unique area. We also have an opportunity to make sure this area maintains its value as part of this larger system. The County has been working on bringing our current Rural zoning into compliance with the Washington State Growth Management Act (GMA) of 1990. Whatcom County has been out of compliance for 20 years, and the Growth Management Hearings Board in 2005 reaffirmed that the rural areas of Whatcom County are zoned at too high a density to adequately protect rural areas.

Chuckanut is one such area, with RR2, RR3, and R2A zoning, which by State law are not densities compatible with rural zoning. The County has undertaken a many year process of Public involvement, Public hearings, Planning Commission recommendations, and now Planning and Development staff have come up with plans to bring our Rural lands in line with the goals of GMA.

For those of us lucky enough to live in the Chuckanut area we also know the risks posed by steep slopes, landslides, frequent power outages, road closures, no secondary access to services or emergency vehicles, Railroad crossing closures, limited services, no public transportation, and limited new water availability. It would be hard to argue this is a good area for increasing density. With increased traffic, including the million visitors per year to Larrabee State Park, the road will not become safer for current residents with more residential development.

Take this opportunity to send comments to the County Council members at [email protected] on the desirability of bringing the Chuckanut area into compliance with the law. This area would be well served and the current residents better protected by supporting the Planning Department’s compromise recommendation of RR5A (one house per 5 acres) for the Chuckanut area. PAGE 9 Chuckanut Community & Firefighters Association July 2010 Larrabee State Park SPRING/SUMMER UPDATE Larrabee State Park isn’t just another state park. It is your neighbor and happens to be Washington State’s first state park. Come by and enjoy Larrabee this spring and summer. Enjoy a picnic at Clayton Beach were you might see a sand dollar. Remember if you see a sand dollar that is all black it is still alive so leave it there. Larrabee is also known for crabbing. The beach naturalist would like to remind you if you are crabbing in any area of Puget Sound to use line that biodegrades in the water in case your pot gets lost at sea. There are over 12,000 pots lost each year in the Puget Sound which kill hundreds of crab unnecessarily. You can pick up more information on crabbing and the rules and regulations at the park entrance booth. Hiking? You may notice all the trail upgrades and improvements around Fragrance Lake and Lost Lake. Washington Trails Association has logged over 550 hours from the fall of 2009 to the spring of 2010 on the trails at Larrabee. During that time, they worked on a new foot bridge at Fragrance Lake and the main beach, improved drainage, installed new turnpikes, cleared brush, cleared downed trees and improved trail tread at Lost Lake. Please say “Thank You” to these volunteers if you see them working this fall through next year. Ivy? Larrabee has several hot spots of invasive English Ivy that needs to be pulled each year. This spring a new volunteer group North Sound Conservatory arrived at Larrabee in honor of Earth Day and pulled over 46 bags of English Ivy from the south day use parking lot area and trimmed back the Rhody bushes. Thanks NSC for all of your hard work! It was fun working together. We look forward to working with you in the future for more English Ivy pulling parties. We really can make a difference in just one day. Summer is here and the park is beginning to get busy in the campground and day use areas. If you would like to camp at Larrabee it is suggested to call the reservation call center at 1-888-CAMPOUT. If you need further information about the park please feel free to give us a call anytime at 360-676-2093 or check us out on the world wide web at www.parks.wa.gov With summer arriving we also usher in more staff members to keep up with park facilities and maintenance duties. Please welcome back Kelsie Mullin (in her 8th summer), Rebecca Avery, Kaylen Opsata. First time Park Aides are Lauren Owens, Jacob Anderson, and Matt Tiscornia. Also, there are several campground hosts that volunteer at the park throughout the summer. Returning hosts Liz and Jan are back for their 3rd summer. They will be with us through September. New hosts Vic, Tom and Vicki are doing a great service for our parks. Hosts bundle firewood for us (profit for the park to use for improvements), sell firewood, clean campsites, pick up litter, change toilet paper, give out park information, and generally remain helpful. It is a big help to have them here and we appreciate all of their work. Larrabee would also like to introduce and welcome to the community our new Park Ranger Alex Moularas. Ranger Moularas came to us from Camano Island State Park. He is originally from Bellingham area and is looking forward to working in his home park. Please welcome Ranger Moularas to the Chuckanut Community. Cleator Road and Fragrance Lake road are currently being fixed by Whatcom County road department. Fragrance Lake road will still be closed for vehicle traffic (except for park vehicles and volunteer crews). Cleator Road will re-open after the wash outs and culverts are fixed. Thank you for your patience while we fix these roads and make them safe again for park visitors. The new office at Clayton Beach is nearing completion. Come check us out when we are open. It is a much larger facility with an office for the park manager, a welcome front desk, a restroom, and a large room in the back for two rangers, a construction and maintenance specialist and seasonal staff to operate. Thanks to the construction and maintenance specialist Brian Martin and regional staff Jason Stiles for helping with the project and doing such nice work. Dogs off Leash? Please be aware that Washington State Parks put out a bulletin recently that puts more emphasis on dogs off leash. Larrabee State Park is going to continue emphasis on dogs off leash and plans on doing special enforcement and emphasis this summer. Dogs off leash are illegal in any Washington State Park and are a danger to native plants, wild life and people. Many park visitors are frightened of dogs on leash let alone running about off leash. All dogs must be on leash at all times and under physical control. The park rangers are doing educational contacts and going to give out one warning to dog off leash offenses. After one warning we will be giving an $87 dollar citation. If you have any questions or concerns about dogs off leash law or policy please feel free to give us a call anytime.
