The 227th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 8th - 10th December, 2016 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 227th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

1. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. The institution shall comply with the additional facilities required (additional built-up area, additional staff, additional funds etc) for the SECOND UNIT as prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before 31.10.2015. 6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 7. The Committee suggested to prepare Data Bank for the teachers. 8. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

(iii) As per allotment order, land is in the name of Smt. Padi Kunya, Director, Hill queen Society i.e. in the name of individual. Land is not in the name of institution/society which is not acceptable.

(i) The affiliating body mentioned in the application form is “State Board” whereas NOC issued by North East Frontier Technical University on 14.04.2016. (ii) Land use certificate and Non-encumbrance certificate issued from H.G.B. (Head Gaon Branch), Darka-II, which are not issued from competent Govt. authority. (iii) As per online application, the total built up area is 2400 Sq. Mts. whereas as per building plan built up area is 4008 Sq. Mts. which is mismatching.

(iv) Building plan and building completion certificate is not approved by any Govt. Engineer. (v) The infrastructural and instructional facilities are not shown in the submitted building plan with measurement as per NCTE Regulations, 2014. (vi) The University has submitted single application for B.Ed. programme. Details of existing graduate and under graduate courses not mentioned in the online application.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. a. SCN was issued on 22.10.2016 on the following ground:

(i) The date of application through online is 29.06.2016 and date of receipt of printout of online application is 01.08.2016 i.e. after 15th July 2016 stipulated by NCTE Hqrs.

b. In response to SCN, the institution has submitted its reply dated 11.11.2016 with a request to consider the application for awarding the recognition to applied B.Ed. programme. The ERC considered the representation of the institution and found that the institution is still deficient on the following ground:

(i) The date of application through online is 29.06.2016 and date of receipt of printout of online application is 01.08.2016 i.e. after 15th July 2016 stipulated by NCTE Hqrs.

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No. ERCAPP201646256 of the institution regarding recognition of B.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993. Mahila Mahavidyalaya, Daudnagar, Vill.- Daudnagar, Street/Road:- Nagarpalika Road, Taluka/ Mandal:- Daudnagar, Town/City:- Daudnagar, Dist:- Aurangaabad, Bihar-824143 6. 227.9.6 (B.Ed.-New proposal) (Govt. Aided) (Magadh University) (Application No.- Not generated) (Application ID:11200) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs from time to time and reply in response to SCN issued before VT, the Committee discussed the matter in detail and observed as under:

a. SCN was issued on 22.10.2016 on the following ground:

(i) As per the print out copy of the online application it is observed that Application Number is not available. (ii) Payment details not submitted.

b. In response to SCN, the institution has submitted its reply dated 12.11.2016 informed that this College is a Govt.-Aided College and processing fee is not required. The ERC considered the representation of the institution and found that the institution is still deficient on the following ground:

(i) As per the print out copy of the online application, it is observed that Application Number is not available. (ii) Payment details not submitted.

In view the above, the committee decided as under: The committee is of the opinion that application bearing ID No. 11200 of the institution regarding recognition of B.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993.

(B.Ed. & D.El.Ed.-New proposal) (Private) (Bihar School Examination Board & Lalit Narayan Mithila University) (Application No. ERCAPP201645046) (Application ID:8268) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) The institution applied two programmes simultaneously B.Ed. and D.El.Ed. The uploaded and submitted NOCs are issued in the year 2015 on 28.05.2015 and 25.05.2015 respectively. Latest NOCs for the current academic year 2017-18 not submitted for both of the programmes. (ii) As per online application, name of the institution is „Sonwati College of Education‟ whereas all documents are in the name of „Sonawati College of Education‟.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. Course) (Private) (Bihar School Examination Board) (Application No. ERCAPP201645050) (Application ID:8353) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) The building plan is not uploaded by the institution instead a letter dated 20.02.2016 issued by Executive Engineer regarding approval of building plan and building completion certificate has been uploaded. The institution submitted building plan in piece meal with hard copy of application which is not legible and not approved by any Govt. Engineer. (ii) Uploaded and submitted building completion certificate issued by Executive Engineer on 27.10.2013. It is mentioned in the building completion certificate that the total built up area earmarked is 3588 Sq. Mts. for B.Ed. programme only, however, the built up area for D.El.Ed. programme is not mentioned. The total built up area is less than the required 4000 Sq. Mts. stipulated for running B.Ed.(existing two units) + D.El.Ed. (proposed two units). (iii) The infrastructural and instructional facilities are not shown in the submitted building plan with measurement as per NCTE Regulations, 2014.

Course) (Private) (Bihar School Examination Board) (Application No. ERCAPP201645055) (Application ID:8149) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) NOC for the applied D.El.Ed. programme issued from Bihar School Examination Board on 29.05.2015. Latest NOC for the current academic year 2017-18 not submitted. (ii) Uploaded document relating to LUC is not matching with the hard copy of the LUC attached with online application form. (iii) Uploaded building plan issued by Zilla Parishad, Kaimur mentioning total built up area 2316.33 Sq. Mts. which is less than the required 3500 Sq. Mts. stipulated for running B.Ed. (existing two units) + D.El.Ed.(proposed one unit). The submitted building plan is not approved by any Govt. Engineer. (iv) Submitted building completion certificate is not in prescribed format and total land area and total built up area is not mentioned.

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) Uploaded and submitted NOC issued from affiliating body in the year 2015 on 25.06.2015. Latest NOC for the current academic year 2017-18 not submitted. (ii) Building plan is in small font which is not legible and not approved by any Govt. Engineer. (iii) Multipurpose hall is not shown in the submitted building plan. (vii) The infrastructural and instructional facilities are not shown in the submitted building plan with measurement as per NCTE Regulations, 2014. (iv) The date of payment mentioned in the online portal is 19.08.2016 whereas as per submitted merchant details, the payment made on 25.05.2016 which differs from each other.

Course) (Private) (Bihar School Examination Board (Application No. ERCAPP201645001) (Application ID:7146) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) The submitted NOC is issued on 22.05.2015 by Bihar School Examination Board. Latest NOC for the current academic year 2017-18 not submitted. (ii) Building plan is not uploaded by the institution. As per hard copy of submitted building plan, total land area is 2530 Sq. Mts. which is less than the required 3000 Sq. Mts. for existing B.Ed. + D.El.Ed. (Proposed) programmes. Further, the total built up area is mentioned 1400.80 Sq. Mts. which is less than the required 4500 Sq. Mts. stipulated for B.Ed.(existing two units) + B.Ed.-Addl. Intake (proposed two units) + D.El.Ed.(proposed one unit). As per building plan, plot Nos. are 1023, 899 whereas as per land document and affidavit etc. plot Nos. 1023, 899 & 202. The institution has not submitted the consolidated building plan for (existing + proposed) programmes indicating total land area and built up area. (iii) It is observed that the submitted building plan of 3505.77 Sq. Mts. for both B.Ed. and D.El.Ed. has been designed and signed by Executive Engineer, B.C.D., Aurangabad on 11.04.2016, also building completion certificate has been signed by the same Engineer on same date i.e. 11.04.2016 that indicate the same 3505.77 Sq. Mts. building has been constructed and completed on 11.04.2016 i.e. in the same day.

(i) NOC from affiliating body issued on 28.05.2015. Latest NOC for the current academic year 2017-2018 not submitted.

(ii) The uploaded and submitted building plan is in small font and not legible clearly. As per online portal, the total built up area is mentioned 2104.97 Sq. Mts. which is less than the required 4500 Sq. Mts. stipulated for B.Ed.(existing two units) + B.Ed.-Addl. Intake(Proposed two units) + D.El.Ed.(proposed one unit). (iii) The infrastructural and instructional facilities are not shown in the submitted building plan with measurement as per NCTE Regulations, 2014.

(iv) As per uploaded affidavit, the total land area is mentioned 6977 Sq. Mts. whereas in the online application form, the total area is 4447 Sq. Mts. which do not tally to each other.

(iii) The seal and signature of the issuing authority of the submitted Non-encumbrance certificate and Land use certificate is not legible.

Guru Prakash B.Ed. College, Vill - Kekadha, Street/ Road - 1, Taluka/ Mandal - Chand, Town/ City - Dist. - Kamur, Bihar - 821106 (D.El.Ed.-Addl. a. Show Cause Notice was issued on 07.11.2016 on the following grounds: (i) The applicant submitted demand draft of Rs. 1,50,000/- as processing fee. As per the online NCTE portal, payment through online only is accepted. (ii) The applicant mentioned in the online application that the type of management is Government but proof for being a Government institution is not submitted.

b. In response to SCN, the institution submitted its reply dated 09.11.2016 through E-mail informing that the institution is constituent College. The ERC considered the representation of the institution and found that the institution is still deficient on the following grounds:

Accordingly, rejection of the intake order dated 1st May, 2016 is hereby quashed and set aside.

That the institution again filed W.P. No 24937 (w) of 2016 for granting recognition of 2 basic units for the applied B.Ed & D.El.Ed programmes from the session 2016-17. The Hon‟ble Court has passed and interim order on 11.11.2016 as mentioned below:

“ In such circumstances, it would be appropriate to request the ERC of NCTE to write to the respective institutions or Universities from which faculty members of the petitioner No. 1 claim to have received relevant educational qualifications, if it has any doubts as to its authenticity. The ERC of NCTE will be entitled to call upon the petitioner No. 1 to furnish any other documents or information in support of the claim of requisite educational qualifications of its faculty members. Therefore, the ERC considered the case and decided to issue formal permission order as on date for another one unit (Additional intake) in 4 yr B.A. B.Sc. B.Ed. Intergrated course from the session 2017-2018 be issued to the institution. Course) (Private) (West Bengal Board of Primary Education) (ERCAPP3695) The ERC vide its order No. ER-213.6(i).154/ERCAPP3695/D.El.Ed./2016/46358 dated 02.05.2016 granted permission for conducting one unit of D.El.Ed course against an application for two units.

The appellate authority vide No. 89-371/2016 Appeal/12th Meeting-2016/43516 dated 26.09.2016 noted that in the 210th meeting of ERC held on 7th -9th April, 2016 it was decided to issue LOI under clause 7(13) of NCTE Regulations, 2014 but no formal LOI was issued as required under the regulations. After considering the reply/compliance which was submitted by the appellant institution in response to the minutes of 210th meeting of ERC, it was decided to issue formal recognition for D.El.Ed. programme with an intake of 50 seats. Appellant institution was not informed of any reason as to why recognition for one unit is being granted whereas inspection was conducted for assessing preparedness of two units and appellant had furnished affidavit and faculty list to meet the requirement of two units. Appleal committee, therefore decided to remand back the case to ERC for either granting recognition for two units of D.El.Ed. course or giving an opportunity to the appellant institution to make a written representation against the ground on the basis of which ERC decided to reduce the intake applied for.

The ERC reviewed the matter in accordance with the appeal order and observed that the institution had submitted a faculty list of 16 members alongwith their educational and other required documents. On verification of mark sheet and certificates of faculties submitted for grant of permission of D.El.Ed. course, the following deficiencies were observed:

(i) That Sri Krishna Kanta Sahoo was appointed as Mathematics teacher, on verification of marks sheet and certificates it was observed that the seal & signature of the issuing authority in his M.Ed. mark sheet is not visible, which is not accepted as valid mark sheet. Hence, the committee could not ascertain his validity of mark sheet and authenticity of degree.

(ii) That Sri Guru Preet Kaur was appointed as Chemistry teacher, on verification of marks sheet and certificates it was observed that his M.Sc.(Chemistry) final mark sheet is not signed by the competent issuing authority, which is not accepted as valid mark sheet. Hence, the committee could not ascertain his validity of mark sheet and authenticity of degree

That on verification of faculty list, the institution has appointed 16 faculties, out of which 14 teachers were qualified. Whereas as per Appendix 2 of the NCTE Regulation 2014, at point 5.1 for an intake of up to two basic units of 50 students each, the faculty strength shall be 16 the principal or HoD is included in the faculty.

That the Norms & Standard in Appendix-2 of the Regulation, 2014 of NCTE at 5.1 (Note-1) envisages if the students strength of one unit of 50 students for Two years is 100 only the number of faculty shall be reduced to 8 (eight).

That the Committee taken up the faculty position of the Institution for granting final recognition in its 213th Meeting held on 29th -30th April, 2016 & 1st -2nd May, 2016.

That as per direction of the Hon‟ble Apex Court in I.A No 9 of 2016 in W.P. (S) civil No 276/2012 Maa Vaishno Devi Mahila MahaVidlayaVs State of U.P. & Ors vide order dated 28.03.2016 the cut of date for granting recognition was 02.05.2016 for the session 2016-2017.

That the Committee keeping in view that the cutoff date i.e. 2nd May, 2016 for granting permission/recognition for the session 2016-2017 decided not to issue show cause notice which amounts to complete loosing of enrolment of students for the session 2016-2017.

That the Committee in its 213th Meeting held on 29th -30th April, 2016 & 1st -2nd May, 2016 discussed the matter in detail and decided in terms of 5.1 (Note-1) of Appendix-2 of NCTE Regulation, 2014 to grant formal recognition under clause 7(16) of the NCTE Regulation 2014 for applied D.El.Ed programme with an intake of 50 (one basic unit) from the academic session 2016-2017 against the appointment of 14 qualified faculties in the greater interest of the Institution.

That the above decision has been taken fairly to the best of its fitness in terms of the stipulation in the NCTE Regulation 2014 and any allegation to the contrary is unfounded and imaginary.

That the prayer of the petitioner to accord revised recognition for the required one unit is not at all possible at present as the cutoff date for grant of recognition is over and in no circumstances, the same can be taken for consideration. As such the application of the petitioner for grant of recognition stands disposed of and it is open for the applicant to make afresh application as per NCTE Regulation, 2014 for the next academic session for consideration.

In view the above, the committee decided as under: As per direction of the appeal committee, the case was reconsidered as per NCTE Regulation 2014 and the previous decision of the ERC is remain unchanged. The case is forwarded to appeal committee as a miscellaneous application for perusal and furhter direction in the matter, if any. (Private) (Vidyasagar University) (ERCAPP2306) The Appeal Committee vide order No. 89-364/2016 Appeal/11th meeting-2016/42168 dated 02.09.2016 is of the view that if the ERC had some doubts abouts the ownership of land, the same should have been sorted at the initial stage and not after getting the inspection conducted. Consdidering all aspects of the case in totality, Appeal Committee remanded back the case to ERC for further processig of the application.

The ERC re-viewed the matter in accordance with the appeal order and observed as under: a. As per online application, the institution name is “Kharagpur B.Ed. College”. b. As per online application, the trust name is “Kangsabati Development Employment and Service Trust”. c. The applicant trust submitted two land deeds registered in the name of “Khagarpur Tribal Primary Teachers Training Institute”

As per submitted land deeds, the land niether in the ownership of sponsoring trust namely “Kangsabati Development Employment and Service Trust” nor in the name of applied institution namely “Kharagpur B.Ed. College”. It is surprising that the appeal committee remanded back the case to ERC for futher processing of application without ownership of land in the name institution and/or sponsoring trust is therefore, beyond the NCTE Regulation, 2014.

As per Clause 8(4) (i) of NCTE Regulation 2014, No institution shall be granted recognition under these regulations unless the institution or society sponsoring, the institution is in possession of required land on the date of applicatin. Further, as per Clause 8(4)(iii) The society sponsoring the institution shall be required to transfer and vest the title of the land and building in the name of the institution within a period of six months from the date of issue of formal recognition order under sub-regulation 16 of regulation 7.

Keeping in view of the Clause 8(4)(i) of NCTE Regulation 2014, the land in question on the date of online application is not in the name of “Kharagpur B.Ed. College” and/or sponsoring trust namely “Kangsabati Development Employment and Service Trust” rather the said land is registered in the name of different institution i.e. „Kharagpur Tribal Primary Teachers Training Institute‟. However, the sponsoring trust neither is not in position to tranfer the land in the name of “Kharagpur B.Ed College” nor the sponsoring trust namely “Kangsabati Development Employment and Service Trust” has required land on ownership basis on the date of online application.

The ERC re-viewed the matter in accordance with the appeal order and observed as under: a. As per online application, the institution name is “Pt Iswarchandra Vidyasagar PTT & B.Ed. College”. b. As per online application, the society name is “Marichya Pt Iswarchandra Vidyasagar Welfare Society”. c. The applicant society submitted two sale deeds registered in the name of “Pandit Iswar Chandra Vidyasagar Primary Teachers Training Institute”

Swami Vivekananda Universal College of Education, Plot No.-74, Vill-Krishnanagar, 171. 227.4.10 Po-Mahurapur, Tehsil/Taluka/ Town/City-Mayureswar- I, Dist -Birbhum, West Bengal- 731218 (B.Ed.-Addl. Course) (Private) (University of Burdwan) (ERCAPP2421) The Appellate Authority Vide order No. 89-375/2016-Appeal/12th Meeting-2016/43532 dated 26.09.2016 noted that during the course of appeal presentation on 26.08.2016, the appellant submitted two lists of faculty approved by affiliating bodies-one each for B.Ed. course (Code No. 2421) and D.El.Ed. course (Code No. 2420). The faculty list approved by West Bengal Board of Primary Education for D.El.Ed. course contains the names of two Maths teachers. Norms and standards for as per NCTE Regulations, 2014 for B.Ed. and D.El.Ed. course in so far as qualification of faculty is concerned differ with regard to percentage of marks. Whereas faculty for D.El.Ed. course is required to possess minimum of 50% of marks in Master‟s degree or M.Ed., faculty of B.Ed. is required to possess a minimum of 55% of marks. In both the courses faculty can be utilized for teaching in flexible manner so as to optimize academic expertise available. Moreover, appellant institution was not given any opportunity to submit written representation (SCN) for reduction in the intake from 2 units applied for and one unit for which recognition was granted. The appellant institution is a composite institution already recognised for conducting D.El.Ed., Appeal committee decided to remand back the case to ERC for modifying the recognition order dated 02.05.2016 so as to grant recognition for two units of B.Ed.

The ERC reviewed the matter in accordance with the appeal order and observed that the institution had submitted a faculty list of 16 members alongwith their educational and other required documents. On verification of mark sheet and certificates of faculties submitted for grant of permission of B.Ed. course, the following deficiencies were observed:

(i) That Sri Chinmoy Chakraborty was appointed as History teacher, on verification of marks sheet and certificates it was observed that his M.Ed. mark sheet is not signed by the issuing authority only stamp of Registrar is there, which is not accepted as valid mark sheet. Hence, the committee could not ascertain his validity of mark sheet and authenticity of degree.

(ii) That Sri Anibrata Ghosh was appointed as Faculty of Education, on verification of marks sheet and certificates it was observed that his B.Ed. mark sheet is a downloaded copy without seal and signature of the issuing authority, which is not accepted as valid mark sheet. Hence, the committee could not ascertain his validity of mark sheet and authenticity of degree.

(iii) That Ms. Ananya Banerjee was appointed as Science teacher, on verification of marks sheet and certificates it was observed that her B.Ed. mark sheet is without seal and signature of the issuing authority, which is not accepted as valid mark sheet. Hence, the committee could not ascertain his validity of mark sheet and authenticity of degree.

That on verification of faculty list, the institution has appointed 16 faculties, out of which 13 teachers were qualified. Whereas as per Appendix 4 of the NCTE Regulation 2014, at point 5.1 for an intake of up to two basic units of 50 students each, the faculty strength shall be 16 the principal or HoD is included in the faculty.

b. In response to Show cause notice, the institution submitted its reply dated 27.04.2016 on the basis of proceedings uploaded in ERC website. c. Further, the VT Member Dr. Nirmala Sharma and Dr. S.A. Khan vide letter dated 27.04.2016 informed that the built up area of the institution is 2039.97 Sq. Mts. only. d. The ERC considered the representation dated 27.04.2016 received from the institution and VT experts letter dated 27.04.2016 and found that the institution is still deficient on the following grounds:

(i) The institution does not possess the required built up area for running D.El.Ed.(Existing)+ B.Ed.(proposed)+ D.El.Ed-Additional Intake(proposed) as per NCTE Regulation 2014.

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No. ERCAPP3764 of the institution regarding permission of B.Ed. Programme is refused under section 15(3)(b) of NCTE Act 1993.
