Thank you in advance for reading the 2017 annual report of the Berrien County Sheriff’s Office. This report is the official record of our activities and accomplishments for 2017 and provides an overview of the Sheriff’s Office organization and operations for the year. the men and women of the Sheriff’s Office who display these attributes INTRODUCTION each and every day. Their continued commitment to public safety, tireless efforts, and respect for the oath they uphold, gives me great confidence in our future.

We are very fortunate to live and work in a county where community members and law enforcement work together to improve our quality of life. Robert Boyce Chief Deputy 3 Recognition & Awards

On August 25, 2017 a call was put out over the jail radio of a medical issue in Dorm 2R. Deputies Lee, Garza, Tober and Magro along with Nurse Scheppleman responded and found an inmate lying on his back and they observed the inmate to have a blue coloration on his lips, hands, and arms. Nurse Scheppleman instructed the deputies to begin CPR on the inmate Deputies Lee, Garza, Tober, and Magro alternated in providing chest compressions and rescue breaths to the inmate until Medic 1 personnel arrived and took over the life saving efforts. Nurse Scheppleman assisted in monitoring the inmate’s oxygen levels and directed the lifesaving efforts conducted by the deputies. The inmate was transported to Lakeland Hospital where he received Karen Thomas (accepting for Nurse Scheppleman), Sheriff further medical treatment and has since recovered. On April 1, 2017, Lieutenant Mark McKie and Deputy Chad Frantz along with several members of the Niles City Fire Department and the Niles City recognition & awards Police Department were dispatched to the Quality Inn & Suites in Niles City for a priority call of numerous children passed out around the swimming pool area. Lt. McKie and Deputy Frantz along with other First Responders went door to door, floor by floor evacuating all the occupants of the hotel, Lt. McKie and Deputy Frantz also assisted the other First Responders in removing several juveniles, who were breathing but unresponsive from the pool area of the establishment. Due to the actions of Lt. McKie and Deputy Frantz as well as the actions of all the First Responders, there was only one fatality and all the other juveniles survived. An investigation into the incident revealed that the juveniles passed out due to the intake of high levels of carbon monoxide.

On 9/28/17, Deputy William Ashley responded to a call of a medical emergency in Bertrand Township. When he arrived on scene, he found an individual with no pulse or breathing. Deputy Ashley performed CPR and utilized the A.E.D. to shock the individual. Due to Deputy Ashley’s utilization of the A.E.D. and CPR, the individual survived this cardiac arrest. According to SMCAS personnel, the quick response and actions of Deputy Ashely were instrumental in saving the life of this citizen. Deputy James Atterberry was awarded the Berrien County Sheriff’s Office Purple Heart Citation for his actions in the courthouse shooting incident on July 11, 2016. Court Security Supervisor Joseph Zangaro was posthumously awarded the Berrien County Sheriff’s Office Purple Heart Citation for his actions in the courthouse shooting incident on July 11, 2016. Court Security Officer Ronald Kienzle was posthumously awarded the Berrien County Sheriff’s Office Purple Heart Citation for his actions in the courthouse shooting incident on July 11, 2016. The Berrien County Sheriff’s Office Purple Heart Citation is awarded to a Sheriff’s Office member who has been killed or sustained a wound/injury in the line-of-duty resulting from an assailant intending to inflict great bodily harm.

Lieutenant Rick Biggart was selected by his peers as Deputy of the Year for 2017. Lieutenant Biggart has been a key member in the Detective Bureau, demonstrating hard work, superior communication skills, and a team work approach that has contributed to the overall success in many investigations this year. While working with other detectives and officers, Lieutenant Biggart was successful in solving several high profile cases and long term investigations. These investigations have included but are not limited to a two year-long investigation into an Organized Retail Fraud group who were responsible for thefts and returns at several Lowes stores in our area and surrounding states. He helped coordinate the identification and apprehension of a suspect stealing tens of thousands of dollars in valuable wire/metal from local contractors. He assisted in the investigation of the two individuals that attempted to bring a loaded firearm into the Berrien County Lt. Rick Biggart Courthouse. In addition to these and many other cases Lieutenant Biggart has been one of the lead investigators in the homicide of Carla Lewis in Niles Township. Lieutenant Biggart has more than 24 years of law enforcement experience and assists in sharing that experience with new detectives. He is also assigned to the FBI Safe Streets Task Force and is a member of the Berrien County Sheriff’s Office Crisis Negotiator Team.

5 Budget

In 2017 total budget expenditures for the Sheriff’s Office were $ 20,319,914. General fund budget expenditures totaled $15,822,716, broken down by division as follows: Sheriff’s Office and Patrol $ 5,200,392 Jail Division $ 10,126,868 Training Facility $ 6,324 Sheriff’s Radios $ 48,083 Jail Inmate Rehabilitation $ 28,157 Emergency Management $ 412,892 The Sheriff’s Office had 25 special fund budgets in 2017, which had expenditures total- ing $4,497,198 as follows: Act 302 Training Fund - $ 14,716 expended Two distributions are received each year based on the number of MCOLES certified road officers employed by the Sheriff’s Office. These funds are used to provide training and purchase training Paul Granigan equipment for certified road deputies. Business Manager Drug Law Enforcement Fund - State Forfeitures - $ 42,918 expended Narc Building - $ 15,738 expended These funds are derived from forfeiture of money or items confiscated from individuals convicted of illegal drug offenses and are used to support the Sheriff Office’s continued fight against the sale and distribution of illegal drugs. Drug Law Enforcement Fund – Federal Forfeitures - $ 15,976 expended These funds are derived from forfeiture of money or items confiscated from individuals convicted of illegal drug offenses and are used to support the Sheriff Office’s continued fight against the sale and distribution of illegal drugs. Narc Special Fund - $ 1,163,439 expended These are millage funds that are used to fund and support the Narcotics Unit. Work Crew Program - $ 19,429 expended Part-time deputies funded by this budget provide inmate work crews for the County Parks Department, Bridgman City, litter cleanup from the landfill and other miscellaneous projects. The municipalities are charged for the crews to cover the costs. Secondary Road Patrol Grant - $ 195,436 expended Three deputies were funded for this grant year to patrol county secondary roads. For the grant year 10/1/16 to 9/30/17, the state reimbursed $192,975. OHSP Grant - $ 31,458 expended The OHSP grant provides funding to the County and Local Units for Click It Or Ticket and additional OWI patrols year. The grant covers all overtime worked. During 2017 the county was reimbursed $26,597. Local Correctional Officers Training Fund - $ 46,170 expended BUDGET In March 2004 the Sheriff’s Office began collecting a booking fee of $12 for inmates booked into the jail, pursuant to Public Act 124. For each fee collected, $2 is remitted to the state and $10 is deposited into the Local Correctional Officers Training Fund. The funds retained by the county are used for costs relating to continuing education, certification and recertification for jail personnel. Total amount of money collected for this fund in 2017 was $46,170. Drug Education Coordinator - $ 110,891 expended These funds, which are millage funds, are used to support the Sheriff’s Office Drug Education and Crime Prevention pro- grams. Snowmobiles Enforcement Grant 2016/2017 - $ 10,085 expended (DNR $8,000/County $2,085) This is a grant through the Michigan Department of Natural Resources to fund snowmobile patrols. Usually the grant is funded 85% by the D.N.R. with a county match of 15%. This year the Sheriff Office received $8,000 towards the purchase of a snowmobile. 6 Budget

Berrien Community Foundation Donation Fund – $60,110 expended In 2004 the Sheriff’s Office entered into an agreement with the Berrien Community Foundation to act as a depository for donations for those who wish to support the Sheriff’s Office. Expenditures from that fund in 2017 totaled $43,491, which went to support the following divisions: Motorcycle Unit $ 21,035 Sheriff $10,138 Sheriff Equipment $28,937 Local Police Protection contracts: The Sheriff’s Office contracts with several local municipalities to provide police protection for specific purposes. In 2017 there were ten contracts; seven of the contracts were fully funded by a municipality. In addition to the contract costs for these fully-funded agreements for police protection, an additional amount is charged to the municipality for administrative costs. A special fund budget is set up for each contract so that expenses and revenues can be tracked individually for each municipality. Watervliet Township - Two full-time deputies - $ 230,840 expended Niles Township - Seven full-time deputies and one full-time records clerk - $ 873,522 expended New Buffalo Township - Five full-time deputies - $ 492,745 expended Buchanan Township - Deputies for security at the annual Red Bud Track and Trail event – $ 21,357 expended Department of Health & Human Services - One full-time deputy for security - $ 94,312 expended Parks - Starting in 2012 the Parks Department requested a part time deputy be assigned to Silver Beach during peak hours of attendance. In 2017 due to large crowds during holidays/special events full time deputies were assigned to Silver Beach. Expenditures of 2017 were $52,887. FBI - Violent Crimes Task Force – Several deputies are assigned to the Violent Crimes Task Force to assist when needed, in addition there normal work hours. The overtime expenses are reimbursed up to a certain monthly amount, which is set annually by the F.B.I. $ 30,989 was expended from this special fund budget in 2017. Local Units Records - Two part-time transcriptionist are assigned to transcribe the City of Bridgman, City of Watervliet and Baroda Lake townships reports. During 2017 $22,043 was expended. Court House Security - Eight part-time deputies provide security for the court house. These deputies are fully funded by the courts. Expenditures for 2017 were $ 141,181. Boys and Girls Club - In June of 2016 the Sheriff’s Office assigned one full time deputy to the Boys and Girls club in Benton Harbor. Total expenditures for 2017 were $103,893. Special Teams - These are millage funds which support seven special teams: Emergency Ops $ 297,770, Haz Mat $ 15,554, Evidence Tech $ 10,146, Tactical Response Unit $ 15,507, Bomb $ 14,519, Dive $ 10,204, Crisis Negotiators $ 970, Accident Reconstruction $ 8,943 and Marine Division $ 298,906. Expenditures for 2017 were $672,533.

Benton Harbor Summer Patrols – Provide support to local units during summer months. Expenditures for 2017 were BUDGET $85,999. Michigan Prisoner Reentry Initiative - In 2010 the Sheriff’s Office also entered into a contractual agreement with Berrien County Michigan Prisoner Reentry Initiative (MPRI) and Michigan Works to do community policing to check on high risk offenders. A sheriff’s deputy partnered with a parole agent and accompanied them to perform routine checks of offenders and their residences. This was fully funded by MPRI and $1,412 was expended in 2017. General fund revenues collected in 2017 totaled $1,075,247 - Revenue sources in 2017 for the Sheriff’s Office included payments from TV rental to inmates, inmate commissary sales, reimbursement for housing state prisoners, inmate room and board charges, inmate pay phone usage reimbursement, sheriff’s auction, and charges for various fees such as DNA tests, abandoned vehicle inspections, fingerprinting, sex offender registrations, and photocopying of documents.

The Records Bureau provides many services to both the public and Niles other law enforcement agencies. Located in the front lobby of the Sheriff’s Office, the Records Bureau fields numerous requests for general information and is the main reception area for anyone vis- iting the department. The office is responsible for preparing and maintaining all of the police reports and traffic citations for the Sheriff’s Office, the Baroda - Lake Township PD, the Watervliet City PD, and the Bridgman City PD. The Records Bureau has custody of all jail records – inmate criminal files, mugshots, and fingerprints. Staffing Debra Posey

Kim Biggart consists of five (5) full-time employees and four (4) part-time employ- ees. The four (4) part-time positions are partially funded by the three other police departments for which our Records Bureau provides service. Services provided to the public include permits to purchase handguns, recording handgun sales, fingerprinting for concealed weapons permit applications and various types of employment, (such as bank employees, teachers, anyone working with children, and health care providers), criminal background searches, and the release of records and reports under the Michigan Carolyn Fannin Freedom of Information Act of 442 of 1976. In 2017, the Records Bureau issued 3,876 individual permits to purchase handguns and pistol sales records. This is a decrease of 15% from 2016. This is due to a change in the law in which Federal Firearms Licensed dealers now issue permits to purchase at the point of sale. A total of 4,111 individual and dealer handgun purchases were recorded, showing a decrease of 11% from 2016. Fingerprinting services were completed for approximately 628 Berrien County residents applying for new concealed pistol licenses. Marcie Aurand The Records Bureau continues to utilize “Offender Watch” on-line system to better track and maintain data regarding convicted sexual offenders living in Berrien County. Federal guidelines require that all offenders must now report all phone numbers, vehicle information, employment information, e-mail addresses and screen names, etc. A $50.00 fee, payable once a year, is also required. A portion of this fee stays with the County to help cover costs incurred. Offenders may report to either their local agency, the local Sheriff’s Office, or to the Michigan State Police Post. A total of 882 such offenders reported addresses in Berrien County in 2017. Approximately 40% of these offenders report to the Berrien County Sheriff’s Office either quarterly, semi-annually, or annually.

The Sheriff’s Records Bureau has seen the implementation of new technology, which has yielded the capability RECORDS to capture many types of information on various types of crimes. This has helped to keep our department on the cutting edge of law enforcement reporting and procedures. The Records Bureau personnel have received highly specialized training in all areas and are very dedicated to providing the highest level of service to the citizens of Berrien County. St. Joseph

9 JAIL DIVISION

The Berrien County Jail houses persons at all stages of the criminal process. From those accused of committing a crime and awaiting trial to those convicted who are serving a jail sentence. At times we also house probation violators, persons wanted by other jurisdictions, parole violators for the Michigan Department of Corrections and juveniles that have been waived into adult court. The jail has a rated capacity of 341 classified inmates along with the newly arrested/detained awaiting their initial court appearance, or arraignment. On average, the daily number of classified inmates in 2017 was 365.

The Berrien County Patrol Division consists of 41 deputies, who patrol the wide ranging 585 square miles that make up the County of Berrien. The county is a popular destination for tourism during the summer months. This increase in population brings an additional call volume for services for our Patrol Division. The primary responsibility for the Road Patrol Division deputies is to prevent and investigate crimes that occur in the areas they are assigned. In addition to patrol duties, deputies conduct criminal investigations, serve civil process, enforce traffic laws, and respond to emergencies that occur within the county.

The Berrien County Sheriff’s Office Road Patrol Division continues to provide Cpt. Miller twenty-four hour police services for our citizens and visitors in the County of Berrien. The Sheriff’s Office Road Patrol division patrolled 634,532 miles in Berrien County during 2017. The Berrien County Sheriff’s Office also provided patrols to Silver Beach during the busy weekend hours in 2017. Following a disturbance that occurred at Silver Beach during the Fourth of July holiday in 2015, the Sheriff’s Office increased its patrol for the Fourth of July holiday in 2017. From this increase in patrol to Silver Beach, deputies assigned to this duty handled 45 “Calls for Service”, issued 90 citations for violation of the County Ordinance, which prohibits alcoholic beverages on the park property, issued 61 verbal warnings for violation of State Law or County Ordinances and also assisted other agencies on 9 various “Calls for Service.” Deputies assigned to this duty also made 20 misdemeanor arrests and 1 felony arrest. ENFORCEMENT

Sgt. Johnson Dep. Williams The deputies assigned to this detail noted that during their patrols of the Silver Beach County Park that the patrons of the County Park were respectful and expressed their appreciation to the deputies that were present. Several of the patrons commented to the deputies that they felt safe and secure during their adventures at Silver Beach County Park. The Sheriff’s Office Road Patrol also assisted the City of Benton Harbor with police patrols three days per week (usually the weekends) from April 19 until September 3, 2017. Sheriff Deputies drove 4,726 miles and made 163 misdemeanor arrests, 42 felony arrests, investigated 185 complaints, and assisted the Benton Harbor Department of Public Safety with 70 calls for service. There were many challenging activities brought before us this year and our team worked well to overcome them, and to enhance preparedness in Berrien County.

Although there are many accomplishments I am proud of, the ones I’d like to highlight are: EMERGENCY MANAGEMENT / ◊ Over 1,100 personnel were trained by Emergency Management on Radiological Emergency Preparedness Operations. ◊ Over 1,000 critical infrastructure partners were given Active Violence Response seminars. ◊ Over 100 new trainers were added through Train-the-Trainer programs on various Homeland Security Topics. ◊ Over 1,000 additional personnel were provided training on topics such as: • Community Emergency Response Team Operations • Bus Driver Safety and Security Operations • Mass Search and Rescue Operations • Fatality Management • Weather Spotter Operations • Continuity of Operations for Businesses • Biological Incident Awareness ◊ The Integrated Public Alert and Warning System was added successfully to our primary alerting process, allowing us the ability to send EAS messages using wireless emergency alerts to reach cell phone and other similar devices directly. ◊ B-WARN! was deemed operational at the end of the year and will be promoted publicly in 2018. This system allows the public to sign up for alerts that can be received via phone, email, text messages, and other similar means. While I look back through 2017’s accomplishments, of which there are many more, I am also excited to begin 2018’s major projects. The major goals for 2018 are: ◊ Revising the Threat & Hazard Identification and Risk Assessment along with the adoption of a new Hazard Mitigation Plan. ◊ Revising the Continuity of Government Plan and guidance. ◊ Strengthening the education of responders through use of a responders network and releasing integrated response guidance. ◊ Making improvements to the Alternative EOC site. I am confident that 2018 will be an even bigger success because I have amazing support frommy leadership and an energetic team striving for great achievements. 2017 HIGHLIGHTS OFFICE OF HOMELAND SECURITY OFFICE OF HOMELAND Capt. Adams was named Vice-Chair on the 5th District Regional Homeland Security Stakeholders Board. He is also the lead project coordinator for the SWAT teams. He oversees the strategic planning objectives of the project which includes sustaining interagency capabilities to respond as a regional team.

Sgt. Bush was awarded the 2017 Distinguished Service Award by the Michigan Emergency Management EMERGENCY MANAGEMENT / Association for his work and dedication on getting the Integrated Public Alert & Warning System (IPAWS) operational in Berrien County. He was also appointed by the Governor to the Michigan Public Safety Interoperability Board in September. Deputy Albers keeps especially busy during the school year as the school liaison for all 83 school buildings in Berrien County. In 2017, he personally attended 77 school lockdown drills. Each year, all schools are required to submit their lockdown schedule by September 15. Dep. Albers revised over 80 facility specific plans for critical infrastructure sites. Gayle coordinated the Public Information Committee in the update/rewrite of the Berrien County Emergency Preparedness Guide for citizens. This update took approximately 6 months and is full of helpful information to get you prepared in case of an emergency or disaster. The entire EM staff keeps busy with stakeholder meetings, reviewing/revising plans, providing training, maintaining equipment, and conducting drills. Each month, we test our radio communications with the 5th District Counties and State Police. The first Saturday of every month, you may hear the D.C. Cook sirens being tested. These are also silently tested each Wednesday. Our BCPSCC is also drilled upon initial warning communications monthly with D.C. Cook. A sampling of monthly meetings include the Fire Chief’s, D.C. Cook, LEPC, Firefighter’s Association, Lakeland Health, MSP/EMHSD, 911, RACES, and Homeland Security Stakeholders, to name a few. Our office monitors various situations throughout the year. Severe weather is often the most frequently watched event; looking for any sudden changes, especially if there are events taking place anywhere in Berrien County such as fairs, picnics, marathons, etc. It is essential that we work closely with the National Weather Service and our Storm Spotters so warnings can be issued quickly when needed.

As part of building disaster resilience in the community, we encourage businesses and other service providers to main-tain emergency plans and continuity of operations plans. In June, a Ready Business Workshop was held that talked about the Continuity of Operations (COOP) for business leaders to help them through the planning process. Secondly, we believe that all emergency response starts within our neighborhoods. We have maintained a continued rela-tionship with the Berrien County Firefighters Training Council to provide residents training on how to safely respond through our CERT program. The CERT academy that was held in October/November graduated 34 citizens trained in basic emergency response functions. This training allows them to be able to help their neighbors and themselves in the event of an emergency until first responders arrive.

Exercise SPOTLIGHT Berrien County was mentioned by FEMA as demonstrating a best practice in public alerting by using the Integrated Public Alert and Warning System (IPAWS) as a primary alerting method. The formal demonstration of this system to FEMA was the first exercise evaluated use in the nation under the Radiological Emergency Preparedness Program. Sgt Bush was tasked with making this program operational and we are proud that he was able to implement this beyond expectations.

The LEPC recognized retired EM Coordinator Mike Bradley for his many accomplishments during his career with the Berrien County Sheriff’s Office. Those presenting him with certificates and awards included FEMA, MSP/EMHSD, Fred Upton’s Office, John Proos’ Office, Retired Sheriff Nick Jewell, American Red Cross, Board of Commissioners, and Sheriff Bailey. Mike was hired in March, 1990 by Sheriff Jewell, and retired under the command of Sheriff Bailey. His family was also able to join us on this day.

In May of 2017, we conducted our bi-annual D.C. Cook NPP full scale exercise. There are over 500 exercise participants that are put under extreme exercise conditions. The main objective of these exercises is for us to ensure our plans and procedures will allow us to respond in a manner that will protect the public. We look at many areas of our response to ensure that we are able to work as a team to respond appropriately. FEMA is tasked with evaluating our performance and ensuring that we meet standards that are outlined in the Code of Federal Regulations. Our performance in this exercise met all exercise objectives and met the standards that show a reasonable assurance that the public will be protected. There is a lot of information in the public information calendar that is mailed to Berrien County households by DC Cook. We collaborate each year on the information that it contains. We encourage each person in Berrien County to review that information, make an emergency plan on what you would do, and keep it handy for review later.

The NWS determined this tornado was an EF-1 with recorded wind speeds of 105 mph. The tornado was on the ground for less than a mile and only lasted a few minutes around 9:00 p.m. on Tuesday, Feb. 28. The following day, our office, along with the National Weather Service, Equalization, Niles Fire and the Niles Building Inspector, conducted a rapid damage assessment of the area. This information was shared with the Michigan State Police Emergency Management/Homeland Security Division. Thirty-two different structures were assessed with varying degrees of damage near Eastside Elementary School in a five-block area. 2,395 power outages statewide were reported. All power to Niles was restored by Friday, March 3rd.

With another successful year behind us, myself and the Berrien County Sheriff’s Office staff look forward to 2018 with new ideas, challenges, and better ways to serve our county. We will continue to look for effective methods to contain costs, and continue to deliver quality programs and services to all who work, live, and visit Berrien County.
